At a meeting conducted on February 27, 1995, the Northampton
Planning Board unanimously voted 5: 0 to grant the request of
O'Connell Oil Associates, Inc. for a SITE PLAN SPECIAL PERMIT
under the provisions of Section 10. 11 in the Northampton Zoning
Ordinance, to construct a 7, 645 square foot building at 25 Texas
Road, in accordance with the plan by Associated Builders, Inc. ,
dated 11/14/95, revised ,2/22/95, plan #L1-4665 & Al-4665.
Planning Members present and voting were: Vice Chairman Daniel
Yacuzzo, Jody Blatt, Joseph Beaujregard, Kenneth Jodrie and Mark
NeJame.
In Granting the Special Permit, the Planning Board found:
A. The proposed addition will not affect the adjoining premises
because the site and buildings are presently used for
storage and the addition will be used for the same purposes.
B. Existing traffic flow will not be altered by the building
addition. The Board found that the only change in traffic
patterns will be from the addition of one loading dock and
one drive-in garage door. The doors have been located so
they will not interfere with the vehicular and pedestrian
traffic flows. The building addition will still allow
emergency vehicles access on all sides of the buildings and
currently allows access to disabled persons as the building
was designed in -accordance with the ADA and the AAB.

C. The proposed use of the addition will be identical to the
existing use. Therefore, it will not have a new effect on
its surroundings.
D. Electrical and heating are the only utilities which will be
used in the building addition, so there will not be an
overload or an adverse effect on the City's resources.
Existing catchbasins were found to be sufficient to handle
any net increase in run-off, resulting from the new
construction.
E. The applicant has met Site Plan Approval Requirements as
listed in the Zoning Ordinance.
F. The proposed use will allow the storage of tanks and
containers to be moved into an enclosed building, removing
it from outdoor storage, and will thus clean up the site's
appearance which will improve the character of the district.
G. The proposed use of warehouse/storage will promote City
Planning Objectives as it is an allowed use in the General
Industrial District.
In reviewing the Site Plan, submitted with the Special Permit,
the Planning Board voted 5:0 to Grant the waivers as requested
and listed below:

C. Estimated daily and peak hour vehicle trips (traffic
patterns will not be altered due to the fact that the sole
purpose of the addition is to store existing products in a
more organized manner) .
Conditions imposed upon the project are as follows:
1. The access areas to both of the driveways shall be paved
with a minimum of 15' of pavement and graded so that no
drainage/run-off leaves the property and flows out to the
road.
2 . Property owner shall regrade parking area, if necessary, to
assure that all run-off/drainage from the parking area is
directed toward the existing catch basins.

the Planning Board found the following:

F. 1. Curb cuts on the street and drives are pre-existing and
will not be altered.
2 . The pedestrian, bicycle and vehicular traffic will not
be altered by this project.
3 . Applicant provided information during the hearing,
which demonstrated that existing catchment areas are
sufficient to control all existing run-off from the
site, and any increase which may result from the
construction of the new structure.

Pursuant to Massachusetts General Laws (MGL) , Chapter 40A,
Section 11, no Special Permit, or any extension, modification or
renewal thereof, shall take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed after the decision has been filed, or if such an appeal
has been filed that it has been 'dismissed or denied, is recorded
in the Hampshire County registry of Deeds or Land Court, as
applicable and indexed under the name of the owner of record or
is recorded and noted on the owner's certificate of title. The
fee for such recording or registering shall be paid by the owner
or applicant. It is the owner or applicant's responsibility to
pick up the certified decision from the City Clerk and record it
at the Registry of Deeds.
The Northampton Zoning Board of Appeals hereby certifies that a
Special Permit has been Granted and that copies of this decision
and all plans referred to in it have been filed with the Planning
Board and the City Clerk.
Pursuant to Massachusetts General Laws, Chapter 40A, Section 15,
notice is hereby given that this decision is filed with the
Northampton City Clerk on the date below.
If anyone wishes to appeal this; action, an appeal must be filed
pursuant to MGL Chapter 40A, Section 17, with the Hampshire
County Superior Court and notice of said appeal filed with the
City Clerk within twenty days (20) of the date of that this
decision was filed with the City Clerk.
