Your letter has been submitted on behalf of the facility owners/operators the Massachusetts Development Finance Agency. Specifically you request that asbestos - containing material be allowed to remain co-mingled with the portico rubble during the demolition operation. This request is based on an evaluation of the structural stability of the portico, which has partially collapsed due to lack of maintenance since the facility closed approximately ten (10) years ago. Department personnel have inspected the site and agree with your assessment that the construction of a containment for the removal of the co-mingled roof and associated rubble and containerization thereof are infeasible. Your letter indicates that engineering controls will be implemented to prevent the release of asbestos emissions during the demolition and that air monitoring will be performed to verify that emissions have been controlled. The specific sections of 310 CMR 7. 15 from which you request exemption are: 310 CMR 7 . 15 (1) (c) 1 . - Remove any asbestos - containing material from a facility or facility component prior to demolition/renovation operations if such operations will cause asbestos emissions, or will render the asbestos - containing material friable, or will prevent access to the asbestos - containing material for subsequent containment and removal. 310 CMR 7 . 15 (1) (e) l . a. - Each owner/operator shall : 1 . Discharge no visible or particulate emissions to the ambient air during the collection, processing, packaging, transporting, transferring, or disposing of any asbestos- containing waste material, and use the disposal methods specified in 310 CMR 7 . 15 (1) (e) such that the asbestos- containing material is non-friable; a. adequately wet asbestos-containing waste material obtained from air cleaning equipment or from removal operations and, while wet, containerize and seal the asbestos-containing waste material in leak-tight containers, (emphasis added) Your request for an exemption is granted under the following conditions : 1 . Any violation of any condition listed herein shall be considered a violation of the regulation from which the exemption is sought and shall: a. immediately revoke this Conditional Approval and b. potentially subject the Massachusetts Development Finance Agency, their contractors, subcontractors and consultants to enforcement action by the Department . 2 . The demolition contractor shall submit a completed Demolition Notification Form (BWP AQ06) , with the appropriate fee, to the Department at least ten (10) working days prior to commencing with the demolition operation. 3 . A licensed asbestos abatement contractor shall be on site during the demolition operation. The asbestos abatement i Exemption Request Northampton State Hospital Main Building Portico Demolition Page 3 contractor shall submit an Asbestos Notification Form, ANF- 001 with the appropriate fee, to the Department at least ten (10) working days prior to commencing the demolition operation. 4 . The work area shall be excluded to prevent access by any personnel who are not part of the demolition operation. All demolition and loading operations shall be done with wet methods so that no dust is generated. S . Large capacity water hoses shall be used during all phases of the demolition and loading operation to eliminate dust generation. 6. Water runoff control shall be implemented to ensure the capture and containment of all asbestos contaminated water from the work site. Asbestos contaminated water must pass through filters capable of capturing and containing particles greater than or equal to five (5) microns in size, before disposal to a sanitary sewer is permitted. 7 . All equipment and personnel associated with the demolition and loading operation shall be fully decontaminated on a daily basis and before being released to other service. 8 . Ambient air monitoring around the circumference of the work area shall be performed on a continuous basis during the demolition and loading operations where sections of the building, which are in contact with the basement area are being handled. Additional air sampling pumps shall be placed in the downwind direction as well as between the site and all sensitive receptors in the vicinity of the work area if they do not coincide with the circumferential monitoring points . Analysis of the air samples shall be performed on site so that corrections in the work practices can be made immediately. If the air monitoring results exceed the Massachusetts Department of Labor and Workforce Development' s clean air criteria of one - one hundredth fiber per cubic centimeter (0 . 01 f/cc) of air, then all work shall stop. The work methods shall be evaluated prior to continuing any further work and the Department shall be notified. If the airborne fiber concentrations reach or exceed the OSHA Permissible Exposure Limit (PEL) of one- tenth fiber per cubic centimeter (0 . 1 f/cc) of air, then work shall stop and the Department shall be notified by telephone within two hours . All air monitoring and sample analysis shall be performed by consultants, who are properly trained and licensed in the Commonwealth of Massachusetts to perform such work and are successful participants in the AIHA' s AAR, or alternatively, who work for a laboratory, which is licensed by the Commonwealth of Massachusetts to Exemption Request Northampton State Hospital Main Building Portico Demolition Page 4 perform such analysis and is accredited with either the AIHA or NVLAP. 9 . Items to be saved for their historic value shall be placed into a sealed work area with air cleaning for decontamination. Visual inspection of these items as well as any large wooden or steel beams, that will be disposed of as construction waste or recycled, shall be performed by an independent consultant prior to disposal as non-asbestos waste . Should it be observed that any objects intended for re-use have contacted or are contaminated with asbestos, said demolition debris shall be loaded into the lined roll-offs for disposal as asbestos waste or cleaned in the sealed work area. A written record of these items shall be maintained on site by the consultant . The consultant shall be properly trained and licensed in the Commonwealth of Massachusetts as an Asbestos Project Monitor. 10 . All other waste shall be bulk loaded into lined roll-offs or dump trailers , which have been lined with a minimum of two (2) ten mil (0 . 010") thick poly liners, for disposal as asbestos waste. All trucks and roll-offs shall be in good condition with no rusted out areas . The doors or tailgates shall close tightly and be lockable. The liners shall be sealed across the top of the load before shipment to the appropriate special waste landfill . 11 . Following the asbestos removal portion of the job and prior to any continued demolition at the site, a final visual inspection shall be performed to ensure that no remnant asbestos, co-mingled asbestos contaminated demolition debris or asbestos - contaminated water remains on the ground around the work site, at the loading site, in the adjacent asbestos work area or any other area at the site . The consultant who performs this inspection shall be properly trained and licensed by the Commonwealth of Massachusetts as an Asbestos Project Monitor. 12 . All of the demolition waste shall be immediately loaded into trucks or roll-off dumpsters for disposal as C&D waste. No waste is to remain on the ground overnight in an uncovered state . The contractor shall ensure that no water leaks from any of the asbestos waste or demolition waste trucks or roll- off dumpsters en-route to the landfill, and that the waste is covered during transport . 13 . All documentation regarding air. monitoring results, visual inspections and waste disposal shall be kept on site for inspection by Department personnel during the demolition operation. Copies of the documentation are to be supplied to the Department upon completion of the work. i Exemption Request Northampton State Hospital Main Building Portico Demolition Page 5 14 . This waiver does not negate the responsibility of the Massachusetts Development Finance Agency, the contractor, subcontractors and consultants from conforming with all other applicable federal, state and local regulations . 15 . Should asbestos become released, the Massachusetts Development Finance Agency, the contractor, subcontractors and consultants may be subject to enforcement action by the Department and may be held liable for abatement of the release . 16 . This exemption from the Department regulation mentioned above applies specifically to the demolition of the collapsed Portico at the Main Building at the Northampton State Hospital in Northampton, MA. This exemption does not apply to any past or future asbestos-handling project at the Northampton State Hospital. All other Department regulations are in force for the duration of this demolition operation. 17 . The Massachusetts Development Finance Agency shall ensure that a responsible representative from each of the entities involved in this project signs and dates the Certification section of this Conditional Approval . The entire document shall then be returned to the Western Regional Office of the Department of Environmental Protection for signature by the Department . Upon receipt of the signed Conditional Approval the Massachusetts Development Finance Agency shall then distribute copies to each entity in the Certification section prior to beginning the project. A copy of this approval shall be kept on site for the duration of the project. ASBESTOS ABATEMENT 1.0 SCOPE OF WORK This Scope of Work addresses the abatement of asbestos-containing and asbestos contaminated materials described in Section 1.1 only. CONTRACTOR responsible for asbestos removal shall furnish all labor, materials and equipment and shall perform all work required to safely remove and legally dispose of all asbestos-containing materials. CONTRACTOR shall provide all insurance, certifications and licenses necessary for the work. All CONTRACTOR representatives who will come in contact, load, decontaminate, etc. asbestos shall be licensed asbestos workers. This includes any heavy equipment operator that will be impacting asbestos during the course of their work activities. This Scope of Work pertains to the removal and legal disposal of asbestos containing materials in accordance with the specified scope of work and all applicable federal, state, and local government laws; statutes, regulations, ordinances, standards and guidelines. CONTRACTOR shall file all necessary notices, obtain all permits and licenses, and pay all governmental taxes, fees, and other costs in connection with the work. Obtain all necessary approvals of all governmental departments having jurisdiction. 1.1 LOCATION / DESCRIPTION OF WORK The exterior Portico entrance at the Northampton State Hospital Main Building recently collapsed. The Portico area was two stories with a room above the entrance. The area was constructed with wood, metal, concrete, copper, brick and red decorative stone. The pile of debris is contaminated with varying quantities of friable and non-friable asbestos-containing materials (ACM). A thorough survey of all suspect ACM's contained within the pile has been performed. The Contractor must provide all temporary water and electricity services and perform a segregation of ACM during demolition in order to separate heavy decorative brownstone, brick and some concrete pieces from the pile. The Contractor will be required to demarcate the area, construct and maintain a remote decontamination unit for personnel use, implement water usage to control fugitive emissions, construct and maintain a decontamination area complete with a water collection and filtration system in accordance with applicable regulations and dispose of all wood, copper roofing, windows, some soil and select concrete, brick, etc. The decontamination area shall be used for the abatement of non-friable caulkings and flashings from decorative brownstone, washing of all decorative stone, brick, concrete and some wood pieces as selected by the Owner or Engineer. The area will be cleaned to a level of no visible ACM debris. Only salvageable pieces and large wooden sections of the collapsed area will be decontaminated and palletized for future use or disposed of as non-ACM construction and demolition material. All other materials shall be disposed of as ACM. All palletized items will require i movement and storage to an o -site location as identified by the Owner or Engineer. Refer to the ABATEMENT SCHEDULE for quantities of ACM, non-ACM and requirements for the removal of caulkings and flashings from salvageable stone,. and the palletization of brick and stone pieces. A. The ABATEMENT SCHEDULE identifies all suspect ACM materials that were sampled and have potential for impact during the clean up. The quantities are provided for general guidance and may not correspond exactly to the quantity to be removed and disposed. CONTRACTOR shall determine quantities and identify all levels of effort for bidding purposes. 1.2 REFERENCES CONTRACTOR is responsible to determine the most recent asbestos removal and disposal requirements established by all applicable federal, state, and applicable local government'laws, statues, regulations, ordinances, standards, and guidelines. A. USEPA Regulations for Asbestos, 40 CFR 61, Subpart M, National Emissions Standards for Hazardous Air Pollutants (NESHAPS). B. USEPA Regulations for Asbestos, Asbestos Abatement Projects, 40 CFR 763, Subpart G. C. US Department of Labor, Occupational Safety and Health Administration (OSHA) Asbestos Regulations, 29 CFR 1926.1101. D. All NIOSH air sampling and evaluation standards. E. Massachusetts Department of Environmental Protection Regulations 310 CMR 7.00, 310 CMB 18.00, and 310 CMR 19.00. F. Massachusetts Division of Labor and Workforce Development Regulation 453 CMR 6.00. G. All applicable local ordinances, regulations, or rules pertaining to asbestos, including its storage, transportation, and disposal. 1.3 AIR MONITORING A. Responsibilities - CONTRACTOR shall conduct appropriate personnel exposure monitoring to determine compliance with OSHA requirements. All air samples collected by CONTRACTOR will be analyzed by a laboratory accredited by the American Industrial Hygiene Association. Sampling equipment shall be calibrated before and after each use. 2 B. The Engineer will perform all requisite perimeter air sampling and analysis as required by applicable regulations. The samples shall be collected from upwind and downwind locations as selected by the licensed asbestos monitor /Engineer. C. Air Quality Standard - All air tests made in proximity to any removal area, and to document "clean air," shall be compared to an air quality standard of 0.01 fibers per cubic centimeter (f/cc) as required by applicable regulations. If any air sample exceeds the air quality standard, CONTRACTOR shall immediately stop all work until the cause is identified and corrected. D. Air Monitoring Methods - NIOSH Method 7400 shall be used for measuring levels of airborne asbestos fibers. All monitoring methods shall comply with the requirements of 29 CFR 1926.1101 and applicable state regulations. E. Results - CONTRACTOR shall provide OWNER copies of all personal exposure monitoring results, and shall post results at the work site after obtaining the results, but not later than 48 hours. F. Upon completion of all work in any defined work area, CONTRACTOR and Engineer shall conduct a final inspection for the purpose of certifying work completion. Unsatisfactory conditions shall be immediately corrected in a manner specified by Owners Engineer. Final payments shall be approved by Owner only after CONTRACTOR provides a certificate of completion and all properly completed Waste Shipment Record Disposal Documentation Forms as required by law. 1.4 WORKER PROTECTION AND SAFETY A. CONTRACTOR shall comply in all respects with regulatory requirements pertaining to worker health and safety protection, respiratory protection, asbestos fiber exposure control. The requirements shall be closely monitored and strictly enforced throughout all work. Any deficiencies shall be promptly corrected or CONTRACTOR shall stop work. 1.5 WORKER QUALIFICATIONS, TRAINING, AND EDUCATION A. CONTRACTOR is required to have a Supervisor or Foreman in the work area at all times work is in progress. B. The Supervisor shall be thoroughly familiar and experienced with asbestos abatement and related work, and shall enforce the use of all safety procedures and equipment. He/she shall be knowledgeable of EPA, OSHA, and NIOSH requirements and guidelines. The Supervisor shall be licensed in accordance with applicable state regulations. PART 2 PRODUCTS 3 i i i 2.1 GENERAL A. All materials or equipment delivered to the site shall be unloaded, temporarily stored, and transferred to the world area in a manner which shall not interfere with operation of others at the facility, or employee's access and safety. B. Damaged or deteriorated materials shall not be used and shall be promptly removed from the premises. Materials that become contaminated with asbestos- containing material shall be thoroughly cleaned, or sealed in plastic bags or sheeting, labeled, and legally disposed of in an approved, secure landfill. C. All materials and equipment shall comply, at a minimum, with all sections of this specification, relevant federal, state, and applicable local codes, and industry standards. 2.2 SAFETY SUPPLIES AND EQUIPMENT A. Respirator Types - Provide all workers with a full or half facepiece respirator which is approved by NIOSH/MSHA for protection against airborne asbestos, and meets the requirements of the OSHA Asbestos Standard. Provide respirators for each worker and at least two extra respirators for use by approved visitors. B. Protective Clothing - Provide all workers and approved visitors with disposable coveralls, head and foot coverings, gloves, and eye protection (i.e., safety glasses with half-face respirators). PART 3 EXECUTION 3.1 GENERAL PREPARATION PROCEDURES A. Upon receipt of a Notice to Proceed, CONTRACTOR shall meet at the site with Owner or Engineer to reach agreement on: 1. Scope and manner of work performance and all schedules. 2. CONTRACTOR and supporting vendor vehicle access and parking. 3. CONTRACTOR access to the work areas, including approved doors, stairways, and corridors. 4. Location of wastewater drain connection points, if available. 5. Determination of all equipment and other items to be removed from the work areas, and the location of temporary storage space, if applicable. 6. Any other logistical factors to minimize interference with public safety and health, and other CONTRACTOR's activities. 4 B. To comply with applicable regulations, notify appropriate regulatory agencies of abatement activities. The Engineer is in the process of obtaining a waiver for exterior impact to friable ACM without containment. Contractor shall be responsible for all other required notification including, but not limited to, the following: 1. Provide the required written notification at least 10 days before the start of the asbestos abatement activity to the United States Environmental Protection Agency and all required state agencies. 2. Provide the required written notification by registered mail to local authorities as required. 3. Obtain and process all applicable forms and permits required. C. Prepare the work areas according to the following general sequence of procedures to ensure that proper fiber containment and protection systems are installed before any work which could generate airborne asbestos fibers. 1. Erect barricades, post access restriction signs, seal all openings to the building airtight (including doors, chases, shafts, and other vertical penetrations, if applicable), and erect or install Decontamination Facilities. 2. Obtain formal approval from Engineer of all preparation work and decontamination areas before commencing clean up activities. 3. If saw cutting is utilized during asphalt-based, asbestos-cdntahiing roofing removal, then a negative air containment area must be erected. 3.2 DECONTAMINATION FACILITIES (Personnel and Decontamination Area) A. Description - Any person or thing exiting from the work areas must pass through a Decontamination Facility consisting of three separate, adjacent rooms separated by curtained entrances, constructed in accordance with applicable regulations. Packaged nonfriable asbestos which was packaged in a clean environment does not require decontamination in a shower. B. Decontamination Area - CONTRACTOR shall construct a decontamination system or basin capable of holding a minimum of 250 gallons of water. The system shall also be constructed in order to support 500 pounds of additional weight, without leaking. The system shall be constructed Within the demarcated work area and must contain a 5 micron asbestos filtering device for all water passing through the system. Filtered water can be discharged onto the ground. Upon completion of use, the CONTRACTOR shall dismantle -and remove the system from the site. 5 a 3.3 FINAL WORK AREA CLEANUP, DECONTAMINATION, AND WASTE DISPOSAL 1. After all asbestos-containing or contaminated materials have been removed, remove all wastes and perform a final cleanup and decontamination of the work area. Final cleaning shall be performed only after all waste is packaged and removed, but before reinstalling, demolishing any equipment, or dismantling any barrier, Decontamination Facility, or protective covering. Once CONTRACTOR has finished fine cleaning, Owners Engineer will perform an inspection. If any waste or fibers are observed within the work area during the inspection, CONTRACTOR shall perform additional cleanup and decontamination. 3.4 WASTE DISPOSAL 1. Definition - Asbestos wastes are defined as all building materials and debris, insulation, disposable clothing and protective equipment, plastic sheeting and tape, exhaust systems or vacuum filters, or any abatement equipment that has been contaminated with asbestos and cannot be completely cleaned by vacuuming and by washing in the Decontamination Facility. 2. General Requirements - All asbestos wastes (e.g., contaminated items, caulkings . and flashings, etc.) must be handled, packaged, stored, transported, and disposed of in compliance with all federal, state, and local regulations and codes. 3. Waste Labeling - If waste containers are not already so preprinted, warning labels having waterproof print and permanent adhesive shall be affixed to the lid and/or sides of the containers, whether or not these containers are further packaged. Warning labels shall be conspicuous and legible, and conform to the latest OSHA, EPA and DOT labeling requirements. 4. Waste Container Removal and Disposal Documentation - To comply with the requirement that waste disposal of an approved landfill be documented, CONTRACTOR shall remove waste containers from work areas only under the direction of Engineer and shall complete appropriate documentation for each load of waste removed from the site. 5. Provide legal transportation of the waste to the disposal landfill, and complete or obtain all required licenses, manifests, dump slips, or other forms. Contaminated materials consist of wood, metal, windows and associated roofing materials. In addition, contractor required to remove ACM caulking and decontaminate approximately(20)large red stone pieces and 5 YDS of brick under the supervision of a licensed asbestos monitor. Stone pieces and brick are then to be palletized and moved to a secure on-site location. Proper handling is necessary to ensure that the historical value is not compromised. In addition, there is approximately 10 YDS. of non-contaminated materials requiring disposal as construction and demolition waste. During all activities, contractor required to use wet methods and proper PPE. A licensed asbestos monitor, provided by Owner, will observe the work and collect!analyze any required air samples other than personnel monitoring air samples. Your letter has been submitted on behalf of the facility owners/operators, the Massachusetts Development Finance Agency. Specifically you request that asbestos - containing material be allowed to remain in the building during the demolition operation and that you then be allowed to bulk load that asbestos waste into lined roll-off dumpsters or trucks . This request is based on an evaluation of the structural stability of the building, which had become severely deteriorated due to lack of maintenance and vandalism having occurred since the facility closed approximately ten (10) years ago. Department personnel have inspected the site . Building 31 is a residential type structure with a flat built-up asbestos asphalt roof . Failure to maintain the roof has led to the collapse of significant sections of the upper floors into the basement and a significant bowing of the south wall . A significant amount of thermal pipe insulation was observed to be in the building. This material is found inside the walls and in the basement of the structure . This insulation is presumed to be asbestos-containing material due to its appearance and the vintage of the, building. Based on this inspection, the Department agrees with your assessment that the building is structurally unsound. Your letter of January 31, 2003 indicates that engineering controls will be implemented to prevent the release of asbestos emissions during the demolition and that air monitoring will be performed to verify that emissions have been controlled. Your subsequent addendum of March 7, 2003 indicates that all building materials will be disposed of as asbestos waste, that the facility owners do not wish to segregate any asbestos materials from the construction and demolition ("C&D" ) debris . The specific sections of 310 CMR 7 . 15 from which you request exemption are : 310 CMR 7 . 15 (1) (c) 1 . - Requires the removal of any asbestos - containing material from a facility prior to demolition/renovation operations . 310 CMR 7 . 15 (1) (c) 3 .d. - Requires the capture and containment fugitive dust by utilizing sealed work area with air cleaning during asbestos removal operations . 310 CMR 7 . 15 (1) (e) l .a. - Requires that asbestos waste materials be sealed into leak tight containers prior to disposal . Your request for an exemption is granted under the following conditions : 1 . Any violation of any condition listed herein shall be considered a violation of the regulation from which the exemption is sought and shall : a. immediately revoke this Conditional Approval and b. potentially subject the Massachusetts Development Finance Agency, their contractors, subcontractors and consultants to enforcement action by the Department . 2 . The demolition contractor shall submit a completed Demolition Notification Form (BWP AQ06) , and an Asbestos Notification Form, (ANF-001) , to the Department at least ten (10) working days prior to commencing with the demolition operation. Both forms shall be have the appropriate fee decal (s) affixed. 3 . A licensed asbestos abatement contractor shall be on site during the demolition operation. This asbestos abatement contractor shall also submit an Asbestos Notification Form, ANF-001 with the appropriate fee decal affixed, to the i I I 'Exemption Request Northampton State Hospital Building 31 Demolition Page 3 Department at least ten (10) working days prior to commencing the demolition operation. 4 . The work area shall be excluded to prevent access by any personnel who are not part of the demolition operation. All demolition and loading operations shall be done with wet methods so that no dust is generated. 5 . Large capacity water hoses shall be used during all phases of the demolition and loading operation to eliminate dust generation. 6 . Water runoff control shall be implemented to ensure the capture and containment of all asbestos contaminated water from the work site. Asbestos contaminated water must pass through filters capable of capturing and containing particles greater than or equal to five (5) microns in size, before disposal to a sanitary sewer is permitted. 7 . All equipment and personnel associated with the demolition and loading operation shall be fully decontaminated on a daily basis and before being released to other service. 8 . Ambient air monitoring around the circumference of the work area shall be performed on a continuous basis during the demolition and loading operations where sections of the building, which are in contact with the basement area are being handled. Additional air sampling pumps shall be placed in the downwind direction as well as between the site and all sensitive receptors in the vicinity of the work area if they do not coincide with the circumferential monitoring points . Analysis of the air samples shall be done on site so that corrections in the work practices can be made immediately. If the air monitoring results exceed the Massachusetts Department of Labor and Workforce Development' s clean air criteria of one - one hundredth fiber per cubic centimeter (0 . 01 f/cc) of air, then all work shall stop. The work methods shall be evaluated prior to continuing any further work and the Department shall be notified. If the airborne fiber concentrations reach or exceed the OSHA Permissible Exposure Limit (PEL) of one- tenth fiber per cubic centimeter (0 . 1 f/cc) of air, then work shall stop and the Department shall be notified by telephone within two hours . All air monitoring shall be performed by consultants, who are properly trained and licensed in the Commonwealth of Massachusetts ( "Commonwealth" ) as Project Monitors . All sample analysis shall be performed by consultants who are properly trained, are successful participants in the American Industrial Hygiene Association' s Asbestos Analytical Registry (AIHA' s AAR) , or alternatively, who work for a laboratory, which is _ i Exemption Request Northampton State Hospital Building 31 Demolition Page 4 licensed by the Commonwealth to perform such analysis and is accredited with either the AIHA or National Voluntary Laboratory Accreditation Program (NVLAP) . 9 . During the demolition of the building, all steam lines, which are encountered, shall be set aside in a segregated work area for subsequent abatement of all asbestos insulation. This work area shall be lined with reinforced polyethylene sheeting. These pipe sections shall be covered with six-mil (0 . 006 inch thick) polyethylene sheeting ("poly") at all times until : testing of the insulation reveals that the insulation is not an asbestos-containing material and is not contaminated with asbestos; or the pipes are placed into a sealed work area with air cleaning for proper removal of the asbestos insulation or debris there-on. All asbestos waste material from obtained from the pipes shall be wetted and sealed into leak tight containers, which have been properly labeled. All pipe sections shall be visually inspected by the Project Monitor for remnant asbestos prior to recycling of the metal . Handling of this material is not subject to any exemption from any regulation. 10 . All of the demolition waste shall be considered asbestos waste. None of the asbestos demolition waste from the building shall be stockpiled at the site . No asbestos demolition waste is to remain on the ground overnight . 11 . If it is necessary to .leave the cellar hole open over night or if loading of the asbestos demolition material is not completed, then the asbestos abatement contractor shall cover the site with at least one layer of reinforced polyethylene sheeting, which has been secured to the ground. 12 . All asbestos demolition waste from the building shall be live loaded into trucks or roll-off dumpsters, which have been lined with a minimum of two (2) ten-mil (0 . 010 inch thick) pre-formed poly liners . These liners shall be of sufficient size so that they can be sealed across the top of the load. After sealing the exterior liner, it shall be properly labeled. The asbestos demolition waste shall not be compacted. The contractor shall ensure that no water leaks from the trucks or roll-off dumpsters en-route to the landfill, and that the waste is covered during transport . The trucks or roll-off dumpsters shall be in good condition with no holes or rusted out areas and with tailgates, which close tightly and are lockable. 13 . Following the demolition operation and asbestos removal but prior to any continued site work, excavation or backfilling of the cellar hole, a final visual inspection shall be Exemption Request Northampton State Hospital Building 31 Demolition Page 5 performed by the Project Monitor to ensure that no remnant asbestos, co-mingled asbestos demolition debris or asbestos - contaminated water remains on the ground around the work site, at the loading site, in the adjacent asbestos work area, as well as in the basement of the building or any other area at the site. 14 . All documentation regarding air monitoring results, visual inspections and waste disposal shall be kept on site for inspection by Department personnel during the demolition operation. Copies of the documentation are to be supplied to the Department upon completion of the work. 15 . This waiver does not negate the responsibility of the Massachusetts Development Finance Agency, the contractor, subcontractors and consultants from conforming with all other applicable federal, state and local regulations . 16 . Should asbestos become released, the Massachusetts Development Finance Agency, the contractor, subcontractors and consultants may be subject to enforcement action by the Department and may be held liable for abatement of the release. 17 . This exemption from the Department regulation mentioned above applies specifically to the demolition of Building 31 at the Northampton State Hospital in Northampton, MA. This exemption does not apply to any past or future asbestos- handling project at the Northampton State Hospital . All other Department regulations are in force for the duration of this demolition operation. 18 . The Massachusetts Development Finance Agency shall ensure that a responsible representative from each of the entities involved in this project signs and dates the Certification section of this Conditional. Approval . The entire document shall then be returned to the Western Regional Office of the Department of Environmental Protection for signature by the Department . Upon receipt of the signed Conditional Approval the Massachusetts Development Finance Agency shall then distribute copies to each entity in the Certification section prior to beginning the project .
