Northampton State Hospital
Dear Mr. Vincent:
Tighe & Bond has completed post-abatement inspections at the Power Plant and Laundry
facilities. The Power Plant is free of all specified asbestos containing materials except for (3)
concealed pipe flanges, concealed metal mating surfaces associated with Boilers #3 and #4 and
concealed gasketing associated with the seams of the breeching ductwork. These non-friable
Category II materials will be made accessible during demolition, removed intact and disposed of
as ACM in accordance with applicable regulations. The Laundry Building is free of all specified
asbestos containing materials except for window caulkings, roof flashings and parapet wall
caulkings. These materials will remain in place until future plans dictate the future use of the
building.
All contractor waste shipment records and clearance air sampling results were reviewed for
accuracy and approved.
Engineering controls during demolition shall consist of constant water use during all facets of
demolition and demarcation of the work area in accordance with OSHA regulations. If
unspecified asbestos is encountered during demolition activities, the contractor is required to stop
work and remove asbestos in accordance with applicable regulations.

Conditional Approval
Dear Mr. Holmes:
The Department of Environmental Protection Western Regional Office ("Department") has
received your letter dated February 21, 2003 requesting an exemption from certain Department
regulations governing asbestos removal and handing. You have described a situation where
your firm is engaged in removing all asbestos—containing material from an antiquated multi-
story boiler. The project involves the demolitionof the boiler and all associated pipes and ducts
and ultimately the demolition of the building itself.
You request an exemption from the Department regulations, which require the stripping of
asbestos from all facility components prior to disposal. Your request is based upon the age of the
boiler and the high temperatures at which it has operated and the discovery that the asbestos
gaskets between the pipe and valve flanges has become fused to the metal surface and cannot be
removed. You have further discovered that many of the bolts holding these valves and flanges
have become rusted and cannot be opened.
You propose that you be allowed to dispose of certain of these metal parts in their entirety as
asbestos waste. Your letter(attached) explains that you shall attempt to open the pipe and valve
flanges and clean those, which can be cleaned. Flanges, which cannot be opened or cannot be
cleaned, shall be disposed of as asbestos waste in air- tight & leak - tight containers of suitable
sturdy construction to withstand the weight of the metal parts. You also indicated that when you
remove these flanges you will cut the metal in such a manner so as not to impact the asbestos and
will remove the least metal as possible for disposal as asbestos waste.

310 CMR 7.15(1)(c)2 c which requires that after handling a facility component covered or
coated with asbestos, that all asbestos material be removed from that component utilizing wet
methods, a sealed work area and air cleaning, as described in the said regulations.
Department personnel have inspected the site and observed the asbestos—containing materials
you have described in your letter. Based upon the Department's observations, your request for
an exemption is granted with the following conditions:
1. Any violation of any condition listed herein shall be considered a violation of the
regulation from which the exemption is sought and shall:
a. immediately revoke this Conditional Approval and
b. potentially subject ACT Abatement Corp, the facility owner, the general
contractor, their contractors, subcontractors and consultants to enforcement action
by the Department.
2. The gasket material shall not be impacted in any way during the cutting of the metal
adjacent to the flanges.
3. All work on metal parts such as, but not limited to, opening and cleaning shall be
performed using wet methods, within a sealed work area with air cleaning in accordance
with Department regulations 310 CMR 7.15(1)(c)3. and 310 CMR 7.15 (1)(d)2.
4. Should any flanges need to be cut to fit into the proper container, all such cutting shall be
performed within a sealed work area with air cleaning in accordance with Department
regulation 310 CMR 7.15(1)(c)3. and 310 CMR 7.15 (1)(d)2.
5. A proper container for small flanges and valves shall include; nylon grain bags (or
equivalent)placed into two (2) six—mil (0.006 inch thick) polyethylene ("poly") asbestos
waste bags, fiber drums or Gaylord boxes or other rigid sided, sturdy, leak - tight
containers, which cannot be punctured or cut by the metal components. Larger valves
shall be wrapped in at least two (2) layers of six-mil poly sheeting with protective
material covering any sharp or.protruding area, which could puncture or otherwise
penetrate the poly. All containers shall be sealed such that they are leak tight.
6. All of these containerized parts shall be loaded into lined roll-offs or waste trailers,which
have been lined with a minimum of two(2)ten-mil(0.010")thick poly liners, for disposal as
asbestos waste. All trailers and roll-offs shall be in good condition with no rusted out areas.
The doors or tailgates shall close tightly and be lockable. The liners shall be sealed across
the top of the load before shipment to the appropriate special waste landfill. A cover shall
be utilized on open top roll-offs to prevent the accumulation of rain and snow. The
contractor shall ensure that no water leaks'from any of the asbestos waste trailers or roll-off
dumpsters en-route to the landfill, and that the waste is covered during transport.

7. Asbestos waste shall not be stockpiled outside of the work area. All waste shall be stored
either inside the work area or in the lined waste trailer or roll-off.
8. This conditional exemption does not negate the responsibility of the facility owner, the
general contractor,ACT Abatement Corp..„ and its sub-contractors and the consultants from
.conforming with all other applicable federal, state and local regulations. All other
Department asbestos regulations are in full force for this asbestos handling operation.
Failure to comply with the conditions herein as well as with the work plan described in your
letter(attached) constitutes a violation of 310 CMR 7.15(1)(c)2.c. and shall automatically
revoke this conditional exemption.
9. Should asbestos become released,ACT Abatement Corp.,the facility owner, the general
contractor, subcontractors and consultants may be subject to enforcement action by the
Department and may be held liable for abatement of the release.
10. This exemption from the Department regulation mentioned above applies specifically to the
removal of asbestos gaskets on metal valves and flanges in the Power Plant at the
Northampton State Hospital in Northampton,MA. This exemption does not apply to any
past or future asbestos-handling project at the Northampton State Hospital. All other
Department regulations are in force for the duration of this demolition operation.
11. ACT Abatement Corp. shall ensure that a responsible representative from each of the
entities involved in this project signs and dates the Certification section of this Conditional
Approval. The entire document shall then be returned to the Western Regional Office of the
Department of Environmental Protection for signature by the Department. Upon receipt of
the signed Conditional Approval,ACT Abatement Corp. shall then distribute copies to each
entity in the Certification section prior to beginning the project. A copy of this approval
shall be kept on site for the duration of the,project.

Dear Mr. Schultz
During the asbestos abatement of the boiler room,ACT Abatement encountered between
100-150 Pipe Valves, which contained asbestos adhesive between the metal flanges. ACT
attempted to remove the lug nuts (which held the flanges together) manually with pipe
wrenches. This process was very difficult and time consuming. It took approximately 45
minutes to remove the eight lug nuts that are on each pipe valve. After removing the
flanges, ACT Abatement attempted to remove the asbestos-adhesive with metal hand-
scrappers. This procedure was unsuccessful. ACT Abatement could not remove.all of the
asbestos-adhesive. The asbestos-adhesive was imbedded into the metal, due to the age of
the valves. Because the facility is over 100 years old,the valves have become rusted and
cannot be opened in a timely manner.
ACT Abatement would like to remove the pipe valves and flanges intact, as asbestos
waste. We will cut the pipe in manner that no asbestos will be the impacted. We will cut
the pipe between 5-6 inches away from were the asbestos is located. ACT Abatement will
properly wet and clean all the pipe valves and wrap them with poly woven grain sacks
and-bagged in two six-mil poly asbestos bags and then they will be placed in a double
(Six mil) lined dumpster. We are requesting a waiver exemption to 310 CMR 7.15 (1)
(c)3. and CMR 7.15 (1 ) (d)2.
