NOftir�! �;1, DECISION OF THE �lj L ZONING BOARD OF APPEALS The Zoning Board of Appeals for the City of Northampton met on Jan_nary_ 13�1QR�and voted unanimously to grant the petition of Labee/Dulong for a variance to erect a sign within two feet of the property line at-285 North << Kin�S� i Based on the evidence presented to the Board, the Board made the follow- !? ing findings in regard to the variance: i I� 1. That the property on which the sign is to be erected is unique in that it was originally a much larger parcel which was re- duced in size by the construction of I-91 to the rear. 2. The topography of the land is such that the land drops sharply toward the highway, and that the Realty World building, former- ly used as a dwelling, is peculiarly located on the lot in that it is so close to the highway that the 15 foot setback required for the sign would be impossible to achieve. Since advertising is important to the applicants ' real estate business, a literal enforcement of the 'Zoning Ordinance would create a hardship for them if they were denied the right to !j advertise the type of business in which they were engaged, and iI its location. 4. The proposed sign would be placed further back from the road than the sign now in place which was allowed by the Building Inspector on a temporary basis. I 5 . The proposed sign will not derogate from the intent of the �j Zoning Ordinance because the sign would not impair visibility, and thus would not pose a safety problem for motorists leaving the property or travelling on Route 5. The variance is, however, granted subject to the following conditions: !! 1. That the sign comply with the standards set by the appropriate City agency; and 1 �I 2.
