41-047 Wton Rd ZPA determination 2016-01-15City of Northampton Massachusetts DEPARTMENT OF BUILDING INSPECTIONS 212 Main Street ● Municipal Building Northampton, MA 01060 Delores Weise 53 Pinecrest Drive Chicopee, MA 01020 41-047 January 15, 2016 Dear Ms. Weise, You requested a determination as to whether the parcel of land on the southerly side of Westhampton Road and identified as map 41, lot 047 is a legal building lot. The application includes a plot plan showing an additional piece of land along the east side of the property that increases the lot width to 175’ from Rt. 66 to a point ~365’ south along the side lot line. The lot is in the Rural Residential district. The lot, including the additional land, meets the frontage, area and lot layout requirements for a building lot in the Rural Residential district and is therefore a legal building lot. The plot plan you presented shows a house located at the rear of the lot. It may not be possible to construct a house in that location based on the definition of lot width and lot depth. I have attached relevant sections of the zoning ordinances. Massachusetts G.L. 40A, §§ 8 and 15 provide for appeals. The appeal must be taken within 30 days of this decision. An appeal under § 8 is made to the permit granting authority; in Northampton, the Zoning Board of Appeals.
