Dragon, Chairman Board of Appeals Northampton, MA 01060 OPINION OF THE PLANNING BOARD IN THE MATTER OF — Request by Steven Kloc of Northampton for a special permit and a variance to construct an addition to an existing building. The Planning Board, at its meeting of July 6, 1977, voted unani- mously to express to the Board of Appeals its opinion that the subject application should be denied. The Board noted that the use of the property is already intensive, particularly underscored by the lack of adequate parking on site. The Board also expressed concern with the tenuous nature of present and potential arrangements for parking to serve either the existing facility or an expanded one. Hurley, License Commission Re: Captain' s Table Proposed Lawn Patio — Required Permits Date: March 18, 1980 Augustus A. Perfito, d/b/a Captain' s Table, 48 Damon Road, Northamp- ton has filed an application with this Commission for the extension of use/premises of his all alcoholic liquor license to include a lawn patio. When Mr. Perfito was asked whether he had the proper permits and/or certification for the extension from the Building Inspector and the Zoning Board of Appeals, he stated that he had been in contact with your office and was told that no permits were needed as he was not constructing any additions to the building. Please advise this Commission on the results of Mr. Perfito' s con- tact with your office, or if this is not the case, please advise this Commission on what permits or certification from your depart- ment is required before approval on his extension of use can be made. Clark, Building Inspector RE: Captain's Table Proposed Lawn Patio DA'TEt March 190 1980 Re your memo of March 18, 1980 concerning the above proposal, please be aware of the followings The Captain's Table, located on 48 Damon Road, Page 18D - Plot 35 & 36, is zoned G.I. Eating and Drinking places in a General Industrial Zone now require a Special Permit. The Captain's Table is nogvf a nonconforming existing use. Section 9.2 and Section 9.3 of the Zoning Ordinances apply to this use. It is my opinion that a special Permit would be required from the Z.B.A. for an extension of this use. NORTHAMPTON OWNER: AUSUSTUS PERFITO I was requested by Chief Jeremiah P. Driscoll to inspect this property for fire hazards and/or violations. Upon my inspection with the owner the following conditions were found to exist. 10 Two(2) out of the three exit lights were found inoperative. 2. All three(3) emergency lights were found inoperative. 3. There are two(2) womans rest rooms that are in need of self closing waste containers. 4. Missing fire extinguishers. Mr Perfito indicated to me that the Exit and Emergency lights were working a couple weeks ago. He said he would purchase self closing waste containers for the womans rest rooms. As for the fire extinguishers he said that they are in the cellar and will place them where needed , I told Mr Perfito that Vhese problems needed to be corrected, he said that they will 'be taken care of within a couple days and will call my office for a re—inspection. (Dallas). The attached report by Capt. Jones relates the information. You can be assured that we will follow up on the recommendations of his report. The only other possible problem I can possibly foresee at this time would be possible over- crowding beyond the legal capacity of the certificate of occupanyo I do not anticipate this but we will monitor the situation with our regular evening inspections.
