The application must be completed using a typewriter or hand printed block-type letters. All numbered items on the application must be completed. When completed and signed by the applicant, the application should be submitted to the Building Inspector for filing. Even though received, the application will not be considered "filed" with the Building Inspector until it has been-reviewed to insure proper completion. A review of the application will be made within two business days from the date received by the Building Inspector. The applicant will be notified of any additional information required. Applicants seeking a VARIANCE should note that the Zoning Board of Appeals has the power to authorize a variance from the terms of the applicable zoning ordinance where the Board determines that the applicant has met all requirements set forth in Massachusetts General Laws, Chapter 40 A, Section 15. Officer Date lwab PVP i Northampton Zoning Board of Appeals Public Hearing on Application of Pamela Pomeroy December 17, 1986 The Zoning Board of Appeals of the City of Northampton held a public hearing at 7:35 on December 17, 1986 in Council Chambers, Wallace J. Puchalski Municipal Building to consider the request of Pamela Pomeroy for a Finding under the provisions of Section 9.3, Page 9.1, Paragraph A.l. of the Zoning Ordinance of the City of Northampton for the purpose of expanding a rear porch which would extend its nonconformancy with the side and rear setback requirements at property located at 21 Meadow Street (Florence) Northampton, MA (URB Zone). Present were: Chairman Robert C. Buscher, Peter Laband and Sanford Weil, Jr. The Chairman read the public notice as it appeared in the Daily Hampshire Gazette on December 3 and 10, 1986. He read Section 9.3 (A) and advised those present of their right to appeal. He read a memo from L. Smith, Planner, on behalf of the Northampton Planning Board recommending in favor of the request. Pamela Pomeroy stated that her existing porch is in need of repair and represents a safety hazard, and she wishes to construct a deck that was designed by an architect, and will extend the nonconforming setback. She read a letter from Susan Bourque, abutting property owner in rear, speaking in favor of the request. She also noted that the librarian for Lilly Library is in favor of the request, as it will upgrade the area. The Chairman called on proponents. There were none. The Chairman called on opponents. There were none. The Chairman called for general comments. S. Weil stated that after viewing the site, he found the application at variance with the actual circumstances, as the porch is actually in the middle of the structure and does not presently extend beyond the house and is conforming on the side. Referring to Section 9.3 (A.2), Mr. Weil suggested that a Variance may be necessary specific to this request, as the porch, as presented, will create a new nonconformity. He also stated that the rear yard referred to is a black-topped area. Ms. Pomeroy noted that the architect's sketch extended the proposed porch 3 feet past the house, and she wishes only a one foot extension. She stressed that she also needs this space for storage of garden tools and bicycles. Gertrude Fisher, housemate, stated that the Building Inspector suggested that the submitted sketch was acceptable. She referred to the architect's sketch and further explained the proposal. When asked to modify her request, so that the porch would not extend past the side of the house, and thus, not create a new nonconformity, Ms. Pomeroy responded that she could not do that. After some discussion,it was moved, seconded and voted unanimously to allow the applicant to withdraw without prejudice and reapply at a later date (without applica- tion fees) with a modified request.
