March 4, 1992 meeting
The Northampton Zoning Board of Appeals met on Wednesday, March 4,
1992 at 7 : 00 p.m. in Council Chambers, Wallace J. Puchalski
Municipal Building, 212 Main Street, Northampton. Present and
voting were: Chairman Robert C. Buscher, William R. Brandt, and
Dr. Peter Laband. Also present was Mary H. Martineau, Board
Secretary.
Ronald G. White -- Request for Special Permit and site Plan
Approval to allow renewal of a home occupation involving diemaking
and specialty printing at 117 NORTH MAIN STREET, FLORENCE.
Robert Buscher read the legal notice which was published in the
Daily Hampshire Gazette on February 19, 1992 and February 26, 1992
regarding this request. Buscher read a memo to the Zoning Board
from the Planning Board dated March 4, 1992 in which the Planning
Board voted to recommend approval of the renewal of the Special
Permit and Site Plan for home occupation. Present and voting were:
Chairman Robert C. Buscher, William R. Brandt, and Dr. Peter
Laband.
Ronald White, 117 North Main Street, Florence addressed the Board.
White said the purpose of his being at the meeting was because one
of the specifications of the home occupation special permit and
review process was that after a period of one year the applicant
must go before the Board to ask for permanent renewal of the
Special Permit and Site Plan. White said that during the last year
he had operated his business in good faith with the agreement that
the ZBA and her had made last year. I installed a service gate in
the back lot as per instructions of George Andrikidis. I have
continued to respect the rights and privileges of my neighbors. I
would appreciate the renewal of my home occupation permit. I would
be happy to answer any questions you may have. I have a good
rapport with my neighbors and am a conscientious taxpayer. Dr.
Laband moves to close the Public Hearing. Bill Brandt seconded the
motion which passed unanimously.
Dr. Laband said he would be happy to move that the Special Permit
be approved. Bill Brandt seconded the motion which passed
unanimously.

Pursuant to Mass. General Laws, Chap. 40A, §11, no variance,
finding, or special permit, or any extension, modification or
renewal thereof, shall take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed after the decision has been filed with the City Clerk and
that no appeal has been filed, or if such an appeal has been filed
that it has been dismissed or denied, is recorded in the Hampshire
County Registry of Deeds and indexed under the name of the owner of
record or is recorded and noted on the owner's certificate of
title. The fee for such recording or registering shall be paid by
the owner or applicant.
The Northampton Zoning Board of Appeals hereby certifies that a
variance, finding, or special permit has been granted and that
copies of this decision and all plans referred to in it have been
filed with the Planning Board and the City Clerk.
Pursuant to Mass. General Laws, Chapter 40A, section 15, notice is
hereby given that this decision is filed with the Northampton City
Clerk on the date below.
If you wish to appeal this action, your appeal must be filed
pursuant to M.G.L. Chapter 40A, Section 17, with the Hampshire
Superior Court and notice of said appeal filed with the City Clerk
within twenty (20) days of the date this Decision was filed with
the City Clerk.

At a meeting held on March 4, 1992 , the Northampton Zoning
Board of Appeals voted unanimously to GRANT the request of Ronald
G. White for a SPECIAL PERMIT AND SITE PLAN APPROVAL under the
Provisions of Section 10. 10, 10. 11, and 11. 11 of the Northampton
Zoning Ordinance governing home occupations for the purpose of
renewing a special per:iit to allow the operation of a printing and
diemaking business as a home occupation. Present and voting were
Chairman Robert C. Buscher, William R. Brandt, and Dr. Peter
Laband.
The findings were as follows:
1 . The Special Permit criteria under Section 11. 11 for a Home
Occupation which apply to this application were all met. The
occupation will be that of the applicant alone; he resides at
that address. Most of the client contact will be conducted
off-premises. Only occasional deliveries from U.P.S. are
required for the business. No signage will be necessary.
2 . All of the Special Permit criteria under Section 10. 10 for a
Special Permit were met. The use is allowed with a Special
Permit and will not create any traffic problems since the
applicant installed a service gate at the back of his property
and client contact at place of business will be minimal. The
applicant enjoys a good rapport with his neighbors, Further,
the use will not impair the integrity of the residential
neighborhood.
3 . All of the Site Plan Approval/Special Permit requirements
under Section 10. 11 for an intermediate project were met.
