Fallon, City Solicitor SUBJECT: 16 North Maple Street DATE: October 2, 1990 FILE: As you know, the owners of 16 North Maple Street have applied to the License Commission for a Lodging House License. The License Commission always refers such requests to the Building Inspector for an opinion as to whether that use is allowed in a particular area. Lodging houses are not allowed by right at the 16 North Maple Street location and have not been since 1976. The use would only be allowed if the lodging house use predated the 1976 revisions to the zoning ordinance. The current owners of the structure have submitted affidavits from eight residents certifying that the building has been a lodging house for as long as Joseph Vinci has owned the property. He acquired the property on October 30, 1975. However, I have been informed that the building may have been put to other uses since 1975. Mr. Vinci has never held a lodging house license at that location. I realize that you have a potential conflict since your family operates a business adjacent to this property and cannot participate in any matters dealing with this issue. If given the necessary funds, however, you can appoint an assistant inspector who could then render an opinion on the issue for the License Commission. At this point, the only evidence submitted are the affidavits supporting the legitimacy of the use. If asked, I would have to give an opinion that the use is grandfathered. However, if other evidence were submitted contradicting the affidavits, a different conclusion might be reached. If the neighbors denying the lodging house use is grandfathered want a public resolution of the issue, they should file a complaint with your office stating that the use is illegal and requesting that you issue a cease and desist order on the property. If you fail to respond to the complaint or fail to issue the order within fourteen days of the filing of the complaint, the neighbors may then appeal to the Zoning Board of Appeals. The Board will hold a public hearing, receive evidence, and determine if the use is grandfathered. We as a group would like to voice our concerns over these properties . The Florence Mercantile Business Association is concerned as to the type of business establishment proposed for 16 No. Maple Street . It is our belief that this was never officially a rooming house as it lacked sufficient licenses , inspections , or certificates . Past history has shown that this type of business has not been compatible with neighboring businesses . We as a group welcome new business , but feel this property should be used as it is currently zoned. In reference to 28 No . Maple Street , the Florence Mercantile Business Association would like to see new business but feel the inadequate parking and zoning is inappropriate for a bar room/pool hall type business . It is our wish that your committees consider the zoning and parking regulations that apply to this property .
