Northampton Zoning Board of Appeals
August 16 , 1989 Meeting
The Northampton Zoning Board of Appeals met at 7 : 35 p. m. on
Wednesday, August 16 , 1989 in Council Chambers, Wallace J.
Puchalski Municipal Building, to conduct a Public Hearing on the '
Application of Cottage Kitchen, Inc. for a Special Permit under the
Provisions of Section 7 . 4( 2) (b) to allow changing the logo and
information on a pre-existing, nonconforming ground sign. Present
and voting were Chairman Robert C. Buscher, Dr. Peter Laband, and
M. Sanford Weil, Jr.
Ch. Buscher opened the Public Hearing by reading the Application,
the Legal Notice, Section 7. 4( 2) (b) of the Zoning Ordinance, and
a memorandum from the Planning Board.
Mr. Joseph Tuit appeared, saying the existing sign still advertises
the Florence Inn, which no longer exists, having been replaced by
the Cottage Kitchen. He showed a rendering of the proposed sign,
which will have Plexiglas panels showing the name of the new
business. There was no one present in favor or in opposition. Dr.
Laband moved the Public Hearing be closed, Mr. Weil seconded, and
the motion passed unanimously.
Dr. Laband found that the requested use is listed in the Zoning
Ordinance as allowed by Special Permit, bears a positive
relationship to the public good in that is important to have an
establishment correctly identified, there will be no change in
traffic or pedestrian safety, no municipal systems are involved,
and the sign will not impair the integrity of the zone. He moved
the Special Permit be granted. Ch. Buscher agreed, saying that it
meets all the criteria, and there is no alteration of the use of
the premises. Mr. Weil seconded, and the motion passed
unanimously.
Also present, in addition to those mentioned, was R. J. Pascucci,
Board Secretary.

that a decision of the Zoning Board of Appeals of the City of
Northampton was filed in the Office of the City Clerk on August 31,
1989, GRANTING the requested Special Permit.
If you wish to appeal this action, your appeal must be filed in
Superior Court within 20 days of the date this decision was filed
in the Office of the Northampton City Clerk.

And the said Zoning Board of Appeals further certifies that the
decision attached hereto is a true and correct copy of its decision
granting said variance/Special Permit, and that copies of said
decision, and all plans referred to in the decision, have been
filed with the City Clerk.
The Zoning Board of Appeals also calls to the attention of the
owner or applicant that General Laws, Chapter 40A, Section 11 ( last
paragraph) provides that no variance or special permit, or any
extension, modification or renewal thereof, shall take effect until
a copy of the decision bearing the certification of the City Clerk
that twenty days have elapsed after the decision has been filed in
the Office of the City Clerk and no appeal has been filed or that,
if such appeal has been filed, that it has been dismissed or
denied, is recorded in the Registry of Deeds for the county and
district in which the land is located and indexed in the grantor
index under the name of the owner of record or is recorded and
noted on the owner' s certificate of title. The fee for such
recording or registering shall be paid by the owner or applicant.

At a meeting held on August 16, 1989, the Zoning Board of
Appeals of the City of Northampton voted unanimously to GRANT
the amended Application of Cottage Kitchen, Inc. for a
Special Permit under the Provisions of Section 7.4( 2) (b) of
the Northampton Zoning Ordinance to change the information
on a pre-existing, nonconforming ground sign in a General
Business District, at 17 North Maple Street, Florence.
Present and voting were Chairman Robert C. Buscher, Dr. Peter
Laband, and M. Sanford Weil, Jr.
The Findings are as follows:
The requested use is listed in the Zoning Ordinance as
allowed by Special Permit.
The requested use bears a positive relationship to the public
good in that it is important to have structures in the city
properly identified.
The change will have no 4affect on any municipal systems, nor
will it have any effect on traffic or pedestrian safety.
Changing the appearance and lettering of the sign will not
have any impact on the integrity or character of the
district, and is in harmony with the general purpose and
intent of the Ordinance.
