R. Buscher concurred with Mr. Brandt and Dr. Laband stating that the Bank is an old institution with a hardship created if they are forced to move all or part of their operation in order to expand; and allowing expansion does not derogate from the intent of the Ordinance. He noted that the special permit request meets all requirements, finding it impractical to accomplish their purpose on site, but still very convenient and well within the area. In regards to the proposed ATM/Drive-Up facility, he found the lot substandard and complying with the setback requirements would create a safety hazard for Bank customers. OF BUII DING INSPECTIONS NORTNAtI fON. ;�A.OlOf1O 3 w r r C, DECISION OF O �V ZONING BOARD OF APPEALS OCT 3 1984 4 4 a meeting held September 19, 1984, the Zoning Board of Appeals of c* City of Northampton voted unanimously to rant the variances and permit requests of the Florence Savings Bank 85 Main Street DEPT.Of BUILDING INSPEC' 1� r---"--_--`�.---- -- ' NORTHAMPTON,MA.SPEC6 ren e to construct an addition to its existing building with an nal parking lot and relocation of the drive-up facility at the corner of Keyes Street and Main Street, Florence. Present and voting were: Chairman Robert C. Buscher, William Brandt and Peter Laband. The findings were as follows: P. Laband, finding for the two variances conjointly and referring to criteria for a variance, found that the structure is an unusual building dating from 130 years ago; that the land is unusual in that the Bank was able to put together one package containing several pieces with no other piece in Florence the same size; that a hardship exists because in order for the Bank to compete with larger banks, they must expand considering that the Bank is a local industry doing well and is a mainstay of the community; that there is no detriment to the public good as they are combining packages, increasing parking and redirecting traffic flow; that the intent of the Ordinance is served by increasing and modernizing the facility making the community more livable. P. Laband, referring to criteria for a special permit, found that the use is listed in the Table of Use Regulations; that it bears a positive relationship to the public convenience as the community can use additional parking; that, whereas there is traffic congestion present, he did not feel that it would worsen considerably; that he held no concerns with overloading municipal systems; that "E" does not apply; that the proposed use does not derogate from the intent of the Ordinance because it will make Northampton a more livable area. W. Brandt, referring to the variance for the building addition and referring to criteria for a variance found that the Bank itself is unique because it is locally owned; that in order to comply with the Ordinance, the addition must be made smaller or back into the parking area, which would cause a hardship because if plans were to comply, there are architectual problems with entranceways and hallways; that it serves the public good by improving traffic flow by separating the drive-up' facility from the main structure; that the proposed addition does not derogate from the intent of the Ordinance because even through the petitioner did not apply under Section 9.3, as an extension of pre-existing conditions, it is not substantially more detrimental than the existing use. Referring to the requested variance for the drive-up/ATM facility, Mr. Brandt found that a hardship exists in that considering traffic flow, security and economics, the Bank is doing the best they can given their location; that the proposed addition will serve to public good by improving the traffic flow; that the intent of the Ordinance is served by citing Section 6.8, Paragraph 7 regarding averaging setbl_" dimensions with existing buildings within one block. Referring to the requested special permit, Mr. Brandt found that the proposed use is listed in the Table of Use Regulations; that additional parking will serve the public good by improving pedestrian safety; that 25.
