Pursuant to Massachusetts General Laws (MGL) Chapter 40A, Section 11, no Finding or any
extension, modification or renewal thereof, shall take effect until a copy of the decision bearing
the certification of the City Clerk that twenty days have elapsed after the decision has been
filed, or if such an appeal has been filed that it has been dismissed or denied, is recorded in the
Hampshire County Registry of Deeds or Land Court, as applicable, and indexed under the
name of the owner of record or is recorded and noted on the owner's certificate of title. The fee
for such recording or registering shall be paid by the owner or applicant. It is the owner or
applicant's responsibility to pick up the certified decision of the City Clerk and record it at the

At a meetingca ducted on July 26, 2001, the Zoning Board of Appeals authorized Zoning
Administrator g>t`anted the request of Eric Bouley for a FINDING under Section 9.3(1)(D) in
the Northampton Zoning Ordinance to change a pre-existing, non-conforming structure for
property located at 53-55 Chestnut Street, Map 17C, Parcel 184.

The Findings of the Zoning Administrator under Section 9.3(1)(D) for a change of a pre-
existing structure were as follows:
1. The Zoning Administrator found that the change (addition of a second egress with a
landing for the first and second floor apartments)would not be substantially more
detrimental to the neighborhood than the existing nonconforming structure and would not
extend any closer to any front, side, or rear property boundary than the current zoning
allows or existing structure already extends, and would not create any new violation of
other zoning provisions; and does not involve a sign.
The following conditions were imposed with this Finding.
1. The egress shall not extend any farther from the side of the house than the
existing structure (bay window) and shall not extend any longer than 20' from
the existing structure(bay window).

The current exemption for"homeowners"was extended to include Owner-occupied Dwellings of one(1) or two(2)familic
and to allow such homeowner to engage an individual for hire who does not possess a license, provided that the owner acts
as supervisor.CMR 780, Sixth Edition Section 108.3.5.1.
Definition of Homeowner:Person(s)who own a parcel of land on which he/she resides or intends to reside,on which there
is,or is intended to be, a one or two family dwelling,attached or detached structures accessory to such use and/or farm
structures.A person who constructs more than one home in a two-year period shall not be considered a homeowner.
Such"homeowner"shall submit to the Building Official,on a form acceptable to the Building Official,that he/she shall be
responsible for all such work performed under the building permit.
As acting Construction Supervisor your presence on the job site will be required from time to time, during and upon
completion of the work for which this permit is issued.
Also be advised that with reference to Chapter 152(Workers' Compensation) and Chapter 153 (Liability of Employers to
Employees for injuries not resulting in Death)of the Massachusetts General Laws Annotated, you may be liable for person(
