Mr. Tewhill will be issuing a new notice to the Descarages informing them that they are in violation of City Ordinance by maintianing a fence in excess of 6 1/2 feet in height. As we explained to you on Monday, the original notice was given on a form used for citing zoning ordinance violations. The ordinance in question is not a zoning ordinance but a city ordinance, specifically Chapter 14 §18. Since this is not a zoning ordinance, there is no appeal process to the Zoning Board of Appeals. Nor may that Board grant any variance in this matter. The Descarages will be given a reasonable amount of time in which to remedy the violation .
