relationship to the public welfare, by insuring that potentially
harmful materials will be kept out of our water supply and streams.
There are no issues of traffic, pedestrian safety or overload of
municipal systems. Section 11 needs ConsCom documentation. The
use will not unduly impair, and I would move that the Special
Permit be granted and the Site Plan be approved. "
Mr. Weil said, "I concur. " Ch. Buscher said, "I agree with my
colleagues. Clearly, a building exists--the fluids are necessary
for the manufacturing process and are currently stored in
underground tanks, which is a bad condition. By enclosing the
system within a building, we get better protection, there will be
no unnoticed leakage. The Sepcial Permit is particularly
appropriate, and clearly a benefit to the public. There's less
chance of a spill. "
Dr. Laband moved the Special Permit be granted, assuming a copy of
the ConsCom approval is received. Mr. Weil seconded, and the
motion passed unanimously. Dr. Laband also moved that the Site
Plan be approved, Mr. Weil seconded, and the motion passed
unanimously.

The Northampton Zoning Board of Appeals met at 7: 55 p. m. on
Wednesday, November 15, 1989 in Council Chambers, Wallace J.
Puchalski Municipal Building, 212 Main Street, Northampton, to
conduct a Public Hearing on the Application of Berkshire Electric
Cable Company for a Special Permit under the Provisions of Section
14 . 3 , and Site Plan Approval under the Provisions of Section 10. 11,
both relative to theconstruction of a 38 ' x 74 ' addition to an
existing building owned by the Applicant on River Road, Leeds.
Present and voting were Chairman Robert C. Buscher, Dr. Peter
Laband, and M. Sanford Weil, Jr.
Ch. Buscher opened the Public Hearing by reading the Application,
the Legal Notice, and a memorandum from the Northampton Planning
Board. Atty. John B. Howard appeared for the Applicant. With him
were Garson and Robin Fields, executives of Applicant corporation,
Scott Weyant of Huntley Associates, and Peter Wood, Applicant' s
engineer. Mr. Howard pointed out that "The Planning Board had some
questions on Huntley' s site plan data, so we have made some minor
revisions to the plan, which now shows existing characteristics. "
He presents a marked-up drawing dated November 15, 1989 , and places
it on the Board. He described the locus as "A GI Zone with a
77 , 000SF existing building, where we want to add a 31, 000SF
structure. The main building is in the Watershed Protection
District. The ConsCom found the location of the addition to be
outside the 100-year flood elevation. We are well beyond 100 ' from
the high water mark of the Mill River. The site plan is
comprehensive and complete. " Mr. Howard went through all of the
Section 10. 11 criteria, and remarked, "The addition is to modernize
an existing filtration system. "
Dr. Laband asked, "Do we have the ConsCom Certificate of
Nonapplicability?" Atty. Howard replied, "No. " Ch. Buscher
opined, "This all begs the question. You are asking for a Special
Permit. You didn't know when you filed that you were not in the
flood plain. " He asked what the filtration system does, and Garson
Fields rose to explain. He said, "We draw 5/8" copper rod to wire.
The cooling solution has been stored in underground tanks. The new
filtration system prolongs the life of the fluid, and stores it
above ground in an enclosed structure. "
There being no one present to speak in favor or in opposition, Dr.
Laband moved the Public Hearing be closed. Mr. Weil seconded.
Atty. Howard asked for a decision tonight so building could get
underway. Dr. Laband asked if the Board could get a copy of the
ConsCom order. The motion to close the hearing passed unanimously.
Ch. Buscher said, "We can grant the Special Permit without
documentation from the ConsCom. " Dr. Laband commented, "Section
14 . 3 (1) requires a Special Permit. I look to Section Northampton

the Provisions of Section 10. 11 of the Ordinance, all
relative to the proposed construction of a 38 ' x 74 ' addition

Dear Mr. Palmer:
This office represents Berkshire Electric Cable Company in the
above matter. As you know, this project requires site plan
approval from the Northampton Planning Board and a special
permit from the Zoning Board of Appeals, the application for
both of which was filed with your office on 25 September 1989.
On the same date, this office filed with the Northampton
Conservation Commission a Request for Determination of
Applicability, the hearing for which is scheduled for Monday, 16
October 1989 . Notice of this application has also been
furnished to you.
It is my opinion that the Northampton Conservation Commission
will rule favorably on our Request for Determination, the
Planning Board will approve the site plan and the Zoning Board
of Appeals will grant the special permit for construction.
I am informed that the public hearing for the special permit
application will not be held until 15 November 1989 at the
earliest. Taking into account such additional time it may take
the Board to make the decision and to allow the appeal period to
run, it appears certain that adverse weather will have set in
before all of the final permits are granted. It would be most
advantageous to my client if construction could begin on or
about 1 November 1989, but in any event, before the freezing
weather sets in.
In order for my client to begin construction this fall, and in
light of the likelihood of a favorable conservation and zoning
findings, I hereby request that Berkshire Cable be granted a
conditional building permit to begin construction on 1 November
1989 . My client acknowledges that such permission would be
conditioned upon receiving all final conservation and zoning
permits. If any such permits were denied, we acknowledge that

For Site Plan Approval, we respectfully request the following submmission
requirements be waived from Section 10.11.4 of the City of Northampton Zoning
Ordinance:
(1) 10.11.4.b.2: Location and use of structures within 100 feet of the pro-
perty line. Use of all existing buildings has not been shown.
(2) 10.11.4.b.3: Existing and proposed building(s) showing setback(s) from
property lines. Setbacks are not shown for existing buildings.
(3) 10.11.4.b.5: Wetlands, ponds and surface water bodies, as defined under
the Wetlands Protection Act, M.G.L. Chapter 131, Section 40 and rules
promulgated therein, 310 CMR 10:00. A small pond area (100+ ft. diam-
eter) is shown on the plans which has not been evaluated to determine
the extent of the resource area. The proposed building addition is
approximately 750 feet from the pond area and is well outside the juris-
diction of M.G.L. Chapter 131, Section 40 - the Wetlands Protection Act.
(4) 10.11.4.b.11, 12, 13, 14, 15 and 17: There are no proposed new drainage
structures, utilities, sewage disposal facilities, sources of drinking
water, landscaping, signs, loading and unloading facilities, or proposed
screening associated with the building addition. The site plan shows
details for existing facilities as defined under 10.11.4.b.11, 12, 13,
14, 15 and 17 for the entire parcel as recorded by a general topographic
survey, but this information is not a complete representation of all the
above-defined facilities except in the area of the proposed addition,
where detailed topographic survey has been performed. Detailed loca-
tions of underground utilities for the site have not been determined.
(5) 10.11.4.c: No traffic volumes have been calculated since the proposed
addition is to upgrade an existing use and not to expand that use. No
impact to existing parking or traffic flow conditions is anticipated.
For Special Permit/Zoning Permit Application, we respectfully request the
following submission requirements be waived from Section 14.5 of the City of
Northampton Zoning Ordinance:
(1) 14.5.2: Site Plan at a scale of 1" = 40' for clarity.
(2) 14.5.2.a: Location plan at a scale of 1" = 2,083 (USGS) .
(3) 14.5 .2 .c: Contours at one (1) foot intervals for the proposed addition
and surrounding areas, but not the entire parcel.
(4) 14 .5.2.d: Specific uses, except for the proposed addition, will not be
altered and are not shown.

On behalf of Berkshire Electric Cable Company, we are pleased to submit herewith
site plans for an addition to the north end of the existing Berkshire Cable Co.
building on River Road in Leeds, MA.
The site is located within the Watershed Protection District. Both a Special
Permit from the Northampton Zoning Board of Appeals and site plan approval by
the Northampton Planning Board will be required. Both required applications
have been consolidated on one form and submitted to the ZBA for distribution.
In addition, although all proposed disturbed areas lie a minimum of 1.4+ feet
above the F.E.M.A. 100-year flood elevation, a Notice of Determination will be
filed with the local Conservation Commission to establish their jurisdiction on
the site according to Section 24.2.e of the Code of Ordinances of the City of
Northampton, MA.
The filing consists of the following:
A. Twelve (12) blueline prints of the site plan; scale 1" = 40' .
B. Twelve (12) blueline prints showing elevation views of the proposed addi-
tion.
C. The original plus eleven (11) copies of the completed Site Plan Approval/
Special Permit/Zoning Permit Application.
D. Eleven (11) copies of this submittal letter.
E. Filing fee for Special Permit Application and Site Plan Approval.
