Lot #1 (house number 575)illegal access is currently being utilized without necessary permit(s). This illegal access is also discharging drainage and associated sediments into Coles Meadow Road. The DPW will consider revocation of the driveway permits unless corrective action is undertaken and completed by June 29, 2001. Corrective action necessary is the cleaning of sediments from the public way, cessation of future sediments into Coles Meadow Road, sediment removal in the stormwater conveyance devices along Coles Meadow Road and stabilization of associated erosion control devices. Further discharges may result in immediate revocation of permits. Internal site review of approved stormwater management devices has not occurred at this time. NORTHAMPTON,MA 01060 25 Sylvia Heights Hadley, MA 01035 RE: Coles Meadow Road SENT CERTFIED MAIL#7099 3400 0003 5606 0055 Dear Mr. Bercume: Over the past week, I had the opportunity to perform site visits to your development along Coles Meadow Road for conformance with the approved drainage plans and driveway permits as issued from the Northampton Department of Public Works (DPW). The below concerns are noted for your immediate attention. 1. The driveway for lot#5 (assigned house number 595)is currently discharging stormwater and sediments into Coles Meadow Road. The haybales that are attempting to control these sediments are nearly breached at this point. Stabilization of the driveway and surrounds are necessary to prevent further discharges. 2. The driveway for lot#4 (assigned house number 587) is currently discharging drainage and sediments into Coles Meadow Road. Stabilization of the driveway and surrounds are necessary to prevent further discharges. Additionally, there is a breach in the silt fence upgradient of the rip-rap swale along Coles Meadow Road that is filling the swale with sediment. 3. The common driveway for lots 2, 6, and 7 (house numbers 579, 599 and 591 respectively)is currently discharging drainage and associated sediments into the Coles Meadow Road. The pavement along Coles Meadow Road in this area is being damaged due to vehicle traffic that is missing the turning radius into the drive. Expansion of the paved turning radius and repair of the street pavement is necessary. 4. The driveway for Lot#3 (house number 583)is currently discharging stormwater and sediments into Coles Meadow Road. Stabilization of the driveway and surrounds are necessary to prevent further discharges. The carrying capacity of the 12 inch driveway culvert has been compromised due to sedimentation in the pipe. Additionally, there are three(3)breaches in the silt fence upgradient of the rip-rap swale along Coles Meadow Road that is filling the swale with sediment. Houses #579 (Lot#2), #591 (Lot#7) and#599 (Lot#6) have not had the driveway location approved. This common driveway has been paved without subgrade inspection. The current grading of this driveway could allow stormwater to discharge onto the city street. No application for driveway permit has been filed for house#595 (Lot#5) although there appears to be an access driveway onto this lot. Due to the above actions that your company has decided to undertake in complete disregard for the rules and regulations of the City of Northampton, you are hereby ordered to immediately cease and desist all activity on the project until these outstanding issues are resolved to the satisfaction of the DPW. During this meeting, engineering plans were shown, discussed and changes agreed to by Mr. Smith and myself. The Trench Permit was issued with conditions that evolved out of this meeting, which you secured in the latter part of the morning. At the time of permit issuance, I discussed with you the changes and the plans that were presented so that you would understand my meeting with Mr. Smith. On December 12, 2000, a field inspection of the project was performed and while on site, a discussion took place with you that I had not received the required additional information(construction details)that was to be provided to this office by December 12, 2000. As of today, the requested details still have not been produced. Furthermore, the installed drainage conveyance system and erosion control checks are not in accordance with the plans presented to the Department of Public Works (DPW). The DPW also notes that the driveway for house#575 (lot#1) is located on house#579 (lot#2) and house#583 (lot #3) properties which is not permitted. The driveway permit on file at the DPW shows a location on Lot#1. Furthermore, this driveway has been paved without subbase inspection as required. The current grading of this driveway will allow stormwater to discharge onto the city street. House 9583 has a driveway permit with an approved location only inspection. This driveway has also been paved without subgrade inspection. Also due to the driveway from house #575 (Lot#1) is on this property which constitutes two (2) driveways which is not permitted. The current grading of this driveway will allow stormwater to discharge onto the city street. House# 587 (Lot#4) has a driveway permit with an approved location only inspection. I observed that you had begun work on the common driveway and retention ponds for the flag lots that required a special permit, site plan approval. The date that the Planning Board decision was submitted to the City Clerk was December 1, 2000. The approval for the special permit site plan was contingent on several issues one of which was for DPW approval for revised plans for the detention ponds and swales. As of today's date that approval has not been given by DPW. You are operating in violation of Northampton Zoning 6.12 and 6.13. The Department of Public Works must receive from you plans of what must be done to stabilize the unauthorized work that you have begun. Once this work has been completed you are to cease any further work until the 20day appeal period has passed and you provide this office with a receipt showing that the decision of the Planning Board has been duly recorded. The issuance of any building permits for the flag lots will not occur until this office has received approval in writing from the Department of Public Works that the information the Planning Board specified you were to provide, in its November 15, 2000 decision granting the flag lots, is acceptable. Any further violation including, un-authorized or un-permitted work will result in fines and or court action. The situation must be corrected as soon as possible. The Department of Public Works (DPW) is concerned that water and/or debris may enter the pavement on Coles Meadow Road during the winter months. As a result of this, you must take all necessary steps to prevent this from happening. If water or debris enters the road and causes a hazardous situation, you shall be held liable. Our records show there are a number of outstanding issues to be addressed and permits to be obtained. These issues were outlined in memos from this office, dated October 21, 2000 and December 5, 2000 and were discussed both on-site and at the DPW office on December 6, 2000. Please be advised that no permits or approvals will be issued by the DPW until all required plans, permit applications and information has been submitted. The plans and written information that must be submitted immediately must include what your engineers believe to be the minimum work that needs to be done to stabilize the site.
