OF THE ZONING BOARD OF APPEALS ASSISTANT CITY SOLICITOR On November 16, 1977, the Zoning Board of Appeals for the City of Northampton decided to deny-the petition of Philip Giers for a variance to convert a single family home to a two family home. Based upon evidence presented to the Board, the Board made the following findings: 1. There exists no special hardship owing to circumstances relating to the soil conditions, shape, or topography of such land or structures, but not affecting generally the zoning district. The evidence presented only--showed that Mr. Giers wanted additional income. 2 . The desirable relief may be granted without substantial detriment to the public good. 3 . The desirable relief may be granted without nullifying or substantiall derogating from the intent of zoning. The desired relief would vary the required lot size and frontage as a result the intent of the zoning code to regulate density of this zone which is currently of a highly dense character would be nullified. On November 16, 1977, the Zoning Board of Appeals for the City of Northampton also decided to deny the petition of Philip Giers for a special permit to convert a single family home to a two family home. The Zoning Board denied the petitioner' s request for a variance from the dimensional regulations for the above reasons; therefore, the Board was not able to grant the special permit to allow the use because the use was otherwise prohibited. The petition was for that reason denied. r B. G vais Acting Chairman J Thomas Brushwdy Raymond Capers CITY OF NORTHAMPTON PLANNING DEPARTMENT MEMORANDUM TO: Planning Board FROM: York Phillips, Planning Director SUBJECT: Applications of Philip Giers for Special Permit and Variance DATE: September 28, 1977 FI LE: r?400-276 The applicant proposes to convert a single family dwelling to a two family dwelling on a lot in a URB zone, as is allowed under the ordinance. However, while the lot meets most dimensional and density regulations for a one family dwelling, it does not meet certain regulations pertaining to a two family dwelling (?particularly the lot size requirement) . A variance must therefore be obtained in addition to the special permit. The staff notes that the proposal is in general keeping with the intent and purpose of the zoning ordinance and that it is in conformance with the comprehensive plan of the City. It is further noted that there was some discussion as to whether a variance would be necessary or not, in as much as the applicant proposed no phy- sical exterior change to the structure. The staff is glad to see that a variance has been found to be necessary. While this addi- tional step may result in extra inconvenience to the individual applicant, it would have established a very undesirable precedent to have allowed the use without the variance. The staff recommends that the applications, both for the special permit and the variance, be granted as requested. cc: Charles W.
