Puchalski Municipal Building to consider the requst of Janet K. Maslowski for a Variance from the provisions of Section 6.2, Page 6.2 of the Zoning Ordinance of the City of Northampton for the purpose of subdividing an existing lot to create one conforming lot and one nonconforming lot (in regards to frontage) at property located at 47 High Street,(Florence), Northampton. MA (URB Zone). Present were: Chairman Robert C. Buscher, Peter Laband and Sanford Weil, Jr. The Chairman read the public notice as it appeared in the Daily Hampshire Gazette on November 19 and 26, 1986. He reviewed Section 6.2, and Chapter 40A, M.G.L. regarding the criteria necessary to grant a Variance. He read a memo from L. Smith, Planner, on behalf of the Northampton Planning Board, recommending (by a vote of 5-2) approval of the Variance request. He advised those present of their right to appeal. Janet Maslowski stated that she is experiencing financial difficulty and must sell her present house. In order to purchase another house, she is requesting to be allowed to build on her adjacent lot. The Chairman called on proponents. There were none. The Chairman called on opponents. Att. James Barnett, representing Mary Gagnon, immediate abutter, stated that none of the criteria necessary for a Variance have been addressed. Prior to allowing Att. Barnett to present his arguments, the Board held a discussion regarding options available to Ms. Maslowski in order that she may present a prepared and thorough petition. It was moved, seconded and voted unanimously to continue the public hearing to January 7, 1987 at 7:30 p.m. in order to allow the applicant to prepare her arguments. It was determined that the abutters would be notified by mail. The meeting adjourned at 9:20 p.m. Present, in addition to those mentioned, were J. Parker, Board Secretary and several int sted citizens. Robert C. Maslowski for a Variance from the provisions of Section 6.2, Page 6.2 of the Zoning Ordinance of the City of Northampton for the purpose of subdividing an existing lot to create one conforming lot and one nonconforming lot (in regards to frontage) at property located at 47 High Street_ (Florence), Northampton, MA (URB Zone). Present were: Chairman Robert C. Buscher, Peter Laband and Kathleen M. Sheehan. It was moved, seconded and voted unanimously to approve the minutes of the December 3, 1986 public hearing without a public reading. Chm. Buscher noted receipt of a letter dated January 14, 1987 from Janet K. Maslowski requesting to withdraw her petition without prejudice. It was moved, seconded and voted unanimously to allow the applicant to withdraw her petition without prejudice.
