The requested use will not unduly impair the integrity or
character of the district or adjoining zones.
The criteria for Site Plan review has been met.
The Conditions are as follows:
1. The apartment be occupied only be members of Mr. Fournier's
family.
2. A limit of three people can occupy the apartment.
3 . Off-street parking will be provided.
4. The Special Permit cannot be transferred to a new owner.
Pursuant to Mass. General Laws, Chap. 40A, §11, no variance,
finding, or special permit, or any extension, modification or
renewal thereof, shall take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed after the decision has been filed with the City Clerk and
that no appeal has been filed, or if such an appeal has been filed
that it has been dismissed or denied, is recorded in the Hampshire
County Registry of Deeds and indexed under the name of the owner of
record or is recorded and noted on the owner's certificate of
title. The fee for such recording or registering shall be paid by
the owner or applicant.
The Northampton Zoning Board of Appeals hereby certifies that a
variance, finding, or special permit has been granted and that
copies of this decision and all plans referred to in it have been
filed with the Planning Board and the City Clerk.

At a meeting held on May 6, 1992 , the Northampton Zoning Board
of Appeals voted unanimously to GRANT the request of Raymond
Fournier for a SPECIAL PERMIT and SITE PLAN REVIEW under the
Provisions of § 11.9 of the Northampton Zoning Ordinance, to allow
for construction of an accessory apartment. Present and voting
were Dr. Peter LaBand, Robert Reckman, and M. Sanford Weil, Jr.
The findings were as follows:
Section 11.9 criteria have been met:
- the apartment will be occupied by applicant's family (Mr.
Fournier's mother and father) and never occupied by more than
three people;
- the apartment will be a complete and separate housekeeping
unit with both a kitchen and bathroom;
- the exterior appearance of the house will remain basically
unchanged;
- the gross floor area of the accessory apartment does not
exceed 30% of the house;
- off-street parking is provided.
Section 10. 10 and 10. 11 have been met as follows:
- the use requested is listed in the Table of Use Regulations
as a special permit in the district for which application is
made.
- The requested use bears a positive relationship to the
public convenience or welfare because it allows low-cost
housing for the elderly.
-The requested use will not create undue traffic congestion or
unduly impair pedestrian safety.
- The requested use will not overload any public water,
drainage, or sewer systems.
