The special permit must be exercised within two years ' of the date that the Planning Board decision granting the special permit is filed with the City Clerk's office. 2. The special permit must be recorded with the Hampshire County Registry of Deeds. 3. This special permit for a cluster residential development supersedes the special permit for a flag lot previously issued for the property. 4. The dwelling units shall be physically connected so as to qualify as one three-family unit. 5. As offered by the applicant, the applicant shall grant a Conservation Restriction to the City of Northampton Conservation Commission preserving land on the property as open space, as shown on plans submitted with the special permit application. u S OMCE ' B. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets and minimize traffic impacts on the streets and roads in the area because the proposed dwelling units will generate minimal traffic and have a minimal impact on Coles Meadow Road. Access to the dwellings will be from a paved driveway already in existence augmented by a newly- constructed portion of driveway. The number of dwelling units proposed falls below the number of units allowable under cluster development zoning regulations. C. The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape, existing buildings and other community assets in the area because the requested use is residential in a district zoned Rural Residential; also because the requested use will maximize the amount of open space preserved in its natural state, and provide access to an adjacent pond. D. The requested use will not overload, and will mitigate adverse impacts on, the City's resources because the proposed dwellings will be served by two private wells and a private septic system. Also, the water run-off will be retained on site. E. The requested use meets all special regulations set forth in the Zoning Ordinance under Section 11.4. F. The requested use bears a positive relationship to the public convenience or welfare because it provides additional housing, preserves open space, and provides access to an adjacent parcel of city-owned land.
