Section 11, no Special Permit, or any extension, modification or
renewal thereof, shall take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed after the decision has been filed, or if such an appeal
has been filed that it has been dismissed or denied, is recorded
in the Hampshire County Registry of Deeds or Land Court, as
applicable and indexed under the name of the owner of record or
is recorded and noted on the owner's certificate of title. The
fee for such recording or registering shall be paid by the owner
or applicant. It is the owner or applicant's responsibility to
pick up the certified decision from the City Clerk and record it
at the Registry of Deeds.
The Northampton Planning Board hereby certifies that a Special

In reviewing the application for this special permit, the
Planning Board found the following:
A. The project protects adjoining premises against seriously
detrimental uses by providing:
for surface water drainage on site in a water recharge area,
and for preservation of views by keeping 50.2% of the
property in an open and wooded state.
B. The project has provided for the convenience and safety of
vehicular and pedestrian movement within the site and on
adjacent streets by creating minimal additional traffic on
Coles Meadow Road and utilizing an existing driveway and
curb cut.
Traffic impacts on area streets, roads and highways in the
area are minimized because little additional traffic will be
generated.
The location of the driveway opening provides for access of
emergency vehicles.
The project has provided for adequate arrangement of parking
and loading spaces in relation to the proposed uses by
providing two parking spaces for each proposed dwelling
unit.
C. The project has provided for a harmonious relationship of
structures and open spaces to:
the natural landscape by preserving 50. 2% of the property as
"open space" and maximizing the amount of land preserved in
its natural state.

Conditions imposed upon the project are as follows:
1. The special permit must be exercised within two years ' of
the date that the Planning Board decision granting the
special permit is filed with the City Clerk's office.
2. The special permit must be recorded with the Hampshire
County Registry of Deeds.
3. This special permit for a cluster residential
development supersedes the special permit for a flag lot
previously issued for the property.
4. The dwelling units shall be physically connected so as
to qualify as one three-family unit.
5. As offered by the applicant, the applicant shall grant a
Conservation Restriction to the City of Northampton
Conservation Commission preserving land on the property as
open space, as shown on plans submitted with the special
permit application.

B. The requested use will promote the convenience and safety of
vehicular and pedestrian movement within the site and on
adjacent streets and minimize traffic impacts on the streets
and roads in the area because the proposed dwelling units
will generate minimal traffic and have a minimal impact on
Coles Meadow Road. Access to the dwellings will be from a
paved driveway already in existence augmented by a newly-
constructed portion of driveway. The number of dwelling
units proposed falls below the number of units allowable
under cluster development zoning regulations.
C. The requested use will promote a harmonious relationship of
structures and open spaces to the natural landscape,
existing buildings and other community assets in the area
because the requested use is residential in a district zoned
Rural Residential; also because the requested use will
maximize the amount of open space preserved in its natural
state, and provide access to an adjacent pond.
D. The requested use will not overload, and will mitigate
adverse impacts on, the City's resources because the
proposed dwellings will be served by two private wells and a
private septic system. Also, the water run-off will be
retained on site.
E. The requested use meets all special regulations set forth in
the Zoning Ordinance under Section 11.4.
F. The requested use bears a positive relationship to the
public convenience or welfare because it provides additional
housing, preserves open space, and provides access to an
adjacent parcel of city-owned land.
The use will not unduly impair the integrity or character of
the district or adjoining zones because it is a residential
use in a Rural Residential district, and it conforms to the
density requirements of the Watershed Protection District.
The use will not be detrimental to the health, morals, or
general welfare and will be in harmony with the general
purpose and intent of the Ordinance.
G. The requested use will promote City planning objectives
found in the Open Space and Recreation Plan by providing
