In making this decision, the Zoning Board of Appeals found: a. The use is in harmony with the purpose and intent of this by-law and will promote the purposes of the water Supply Protection District because: The property is a large parcel, (17-1/2 acres) , and the requested use for a single-family residence is the least offensive use for the property. b. The use is appropriate to the natural topography, soils and other characteristics of the site to be developed because: In considering of the size of the parcel and the size of the developed portion of it, the applicant is not proposing to make any gross changes in the topography. C. The applicant has shown that the use has suitable soil for on-lot sewerage and water systems for an on-site well as demonstrated by: Evidence presented in the application which indicated that there is suitable soil to handle on-lot sewerage and water systems, adequate for an on-site well. d. The use will not, during construction or thereafter, have an adverse environmental impact on groundwater resources in the district because: Prior to construction, the applicant has proposed to take the necessary precautions to assure that no adverse environmental impact on groundwater resources occurs, and (after construction, and the land has re-vegetated, the disturbances are minimal to the lot. ) e. The use will not adversely affect the existing or the potential quality or quantity of water in the Water Supply Protection District because: The use will not increase the quantity of water consumed, and should cause no adverse affect on the quality of water. -3- As a single-family home, this use will generate a smaller amount of traffic affect than any other use, except for an agricultural use, allowed in the zone. 4. The requested use will not overload any public water, drainage or sewer system, or any other municipal system to such an extent that the requested use or any developed use in the immediate area or in any other area of the City will be unduly subjected to hazards affecting health safety or the general welfare, because: The use will not draw upon the public water or sewer system because there will be a private well and a septic system installed, which meet all applicable criteria for protection of water resources in this zone. 5. The requested use meets. all special regulations set forth in the Zoning Ordinance, specifically Sections 16.7 (C) (1) (a- e) , See "Attachment A", for criteria. 6. The requested use will not unduly impair the integrity of character of the district or adjoining zones, nor not be detrimental to the health, morals, or general welfare, and the use is in harmony with the general purpose and intent of the Ordinance because: The overlying zone is Rural Residential in which single- family dwellings are allowed by right. However, the Water Shed Supply Protection overlay adds conditions that must be met, to that right. The size of this parcel, and the size of the development, are in keeping with the character of the zone and will protect the zone more effectively than if the parcel were developed, in a different manner. In reviewing the Site Plan, submitted with the Special Permit, the Planning Board: 1. Placement shall be directed at the site by the project engineer in order to accomplish maximum control of erosion and ensure than no eroded materials will reach wetland resource areas. Hay bales must be staked. Silt fencing must be placed in a dug trench with sufficient porosity to allow detained water to pass while trapping suspended sediments; 17) The areas of construction shall remain in a stable condition at the close of each construction day. The proposed project involves the dredging of approximately 3 , 700 square feet (548 cubic yards) of an existing man-made pond for the purpose of creating habitat for an introduced population of trout. The pond is currently too shallow to sustain a trout population. it is proposed to deepen the man made pond an average of four feet over the 3 ,700 square feet. This pond borders Broad Brook. There is no surficial outlet from the pond to Broad Brook. A tracked or rubber tired excavator will be used to dredge the pond. The equipment will impact a small amount of wetland and will work from one area to limit impacts to surrounding wetlands. All dredged spoils will be placed within a ring of silt fence located outside of the the wetland boundary for dewatering. The dredged material is classified as Division of Water Pollution Control (DWPC) Type A, Category I Materials. After dewatering, the spoils will be trucked to a field located approximately 500 feet upgradient of the pond and will be graded and seeded. Emergent vegetation within the pond has been located and these areas will be avoided during dredging. There is no emergent vegetation within the central area of the pond. The dredging will be completed during low water conditions. Under this condition, there is no surface connection between the pond and Broad Brook. As a result, sedimentation impacts to the brook are expected to be avoided. The maximum duration of dredging is expected to be approximately 2 days. HOW DOES PROJECT COMPLY WITH SPECIAL PERMIT CRITERIA First, Applicant's lot meets the other minimum requirements of Section 16.9, namely, the lot size is well in excess of 80,000 square feet and the coverage of impervious surfaces is well below fifteen(15) percent. Second, the proposed use meets the specific criteria of Section 16.7 (C) (1). Applicant's proposal meets the goals of Section 16 by providing a system that recharges all drainage run off from impervious surfaces on site, prevents contamination of groundwater by use of gas and oil traps in the driveway area, and by installation of subsurface sewage disposal system meeting Title S requirements, and controls soil erosion and sedimentation by use of a hay bale barrier during construction. A special permit is required because the proposed improvements are partly within 200 feet of a water course in the Water Supply Protection District. The signed, dated and denied Zoning Application is attached as Exhibit "E". The wetlands adjacent to the water course were marked when Applicant applied for and received a permit to dredge the pond and grade around it. A copy of a Water Quality Certification dated July 1, 1992, and the Order of Conditions by the Conservation Commission detailing the dredging project are attached as Exhibit "A". The location of the proposed improvements are shown on the topographical survey plan dated August 3, 1993 by Bruce Saluk & Assoc., Inc., submitted with the Application.
