effect until a copy of the decision bearing the certification of
the City Clerk that twenty days have elapsed after the decision has
been filed with the City Clerk and that no appeal has been filed,
or if such an appeal has been filed that it has been dismissed or
denied, is recorded in the "Hampshire County Registry of Deeds or
Land Court, as applicable" and indexed under the name of the owner
of record or is recorded and noted on the owner's certificate of
title. The fee for such recording or registering shall be paid by
the owner or applicant. It is the owner or applicant's
responsibility to pick up the certified decision from the City

Water Supply Protection District
SPECIAL PERMIT for:
478 Coles Meadow Road
In Granting the Special Permit, the Zoning Board of Appeals found
that the requested use meets all special regulations set forth in
the Zoning Ordinance, specifically Section 16.7 (C) (1) (a-e) -
Uses by Special Permit.
In making this decision, the Zoning Board of Appeals found:
a. The use is in harmony with the purpose and intent of this
by-law and will promote the purposes of the water Supply
Protection District because:
The property is a large parcel, (17-1/2 acres) , and the
requested use for a single-family residence is the least
offensive use for the property.
b. The use is appropriate to the natural topography, soils and
other characteristics of the site to be developed because:
In considering of the size of the parcel and the size of the
developed portion of it, the applicant is not proposing to
make any gross changes in the topography.
C. The applicant has shown that the use has suitable soil for
on-lot sewerage and water systems for an on-site well as
demonstrated by:
Evidence presented in the application which indicated that
there is suitable soil to handle on-lot sewerage and water
systems, adequate for an on-site well.
d. The use will not, during construction or thereafter, have an
adverse environmental impact on groundwater resources in the
district because:
Prior to construction, the applicant has proposed to take
the necessary precautions to assure that no adverse
environmental impact on groundwater resources occurs, and
(after construction, and the land has re-vegetated, the
disturbances are minimal to the lot. )
e. The use will not adversely affect the existing or the
potential quality or quantity of water in the Water Supply
Protection District because:
The use will not increase the quantity of water consumed,
and should cause no adverse affect on the quality of water.

As a single-family home, this use will generate a smaller
amount of traffic affect than any other use, except for an
agricultural use, allowed in the zone.
4. The requested use will not overload any public water,
drainage or sewer system, or any other municipal system to
such an extent that the requested use or any developed use
in the immediate area or in any other area of the City will
be unduly subjected to hazards affecting health safety or
the general welfare, because:
The use will not draw upon the public water or sewer system
because there will be a private well and a septic system
installed, which meet all applicable criteria for protection
of water resources in this zone.
5. The requested use meets. all special regulations set forth in
the Zoning Ordinance, specifically Sections 16.7 (C) (1) (a-
e) , See "Attachment A", for criteria.
6. The requested use will not unduly impair the integrity of
character of the district or adjoining zones, nor not be
detrimental to the health, morals, or general welfare, and
the use is in harmony with the general purpose and intent of
the Ordinance because:
The overlying zone is Rural Residential in which single-
family dwellings are allowed by right. However, the Water
Shed Supply Protection overlay adds conditions that must be
met, to that right. The size of this parcel, and the size
of the development, are in keeping with the character of the
zone and will protect the zone more effectively than if the
parcel were developed, in a different manner.
In reviewing the Site Plan, submitted with the Special Permit,
the Planning Board:
1. Voted 8-0 to Grant the waivers as listed below because the
applicant has met the criteria under Sections 10. 10, 14 .5
and 16.7 of the Zoning Ordinance, and noted that the
applicant had been very thorough in addressing all of the
criteria.
Requested Site Plan waivers granted: B, B-2, B-3, B-8, B-9,
B-10, and C.
Conditions imposed on the Special Permit Application:
1. Development shall be done according to the plans submitted
with the Special Permit application, Topographic survey,
Coles Meadow Road, Northampton, MA, prepared by: Bruce
Saluk & Associates, Inc. , Marlborough, MA 01752, and
stamped received by the City Clerk's Office on 10-28-93.

2 . The requested use bears a positive relationship to public
convenience or welfare because:
The use encourages a low impact use of the property, as a
residential use, and includes protection to avoid the
concerns of Chapter 16. A 17-1/2 acre parcel for a single-
family residence is the most restrictive use to which a
parcel can be developed and one that has the least affect on
the parcel and zone in general. It is to the benefit of the
public to will allow this parcel to be used and with
relatively no effect on the Water Supply Protection
District.
3 . The requested use will not create undue traffic congestion
or unduly impair pedestrian safety because:

to the Northampton Wetlands Protection Ordinance, the Wetlands Protection Act, an Order
of Conditions, and/or a Determination of applicability from the Northampton
Conservation Commission";
22) Any fill used in this project shall be clean fill, including soil, gravel, rock, and
loam. The applicant is prohibited from using demolition materials, asphalt, large
chunks of concrete, tree stumps and limbs, and general refuse;
23) The contractor is responsible with the applicant and property owner for any violation
and the penalties under the law for such violation. While all activities regulated by
this Order are being performed and during the construction phase for this project, an
on-site foreman, or project engineer, shall have a copy of this permit at the site, be
familiar with the conditions of this permit, and adhere to such conditions. A copy of
the plans and Order must always be on-site and in all excavating machinery when work
is being performed;
24) All required permits must be obtained from the Planning Board, Zoning Board, Department
of Public Works, & Building Inspector prior to the start of this project and all
permits must be complied with. Army Corps of Engineers 404 permits and Water Quality
Certifications must be obtained prior to the start of projects involving fill within
wetlands;
25) Upon completion of the project, the Applicant shall submit a statement that all worts
has been done in conformance with the provisions of the approved Order of Conditions
and request a Certificate of Compliance. (if checked) Statement shall be by a

13) All construction areas shall be restored to original condition or better upon
completion of the project, including vegetation;
14) No area within the 100 year floodplain, any wetland, or area within 100 feet of a
wetland or 40 feet of a 100 year floodplain, as defined in 310 CMR 10, and Chapter 24,
shall be permissible disposal sites, unless such areas are specifically approved by the
Commission;

suspended sediments;
17) The areas of construction shall remain in a stable condition at the close of each
construction day. Erosion controls shall be inspected at this time, and maintained or
reinforced to meet specifications in the plans and this order;
18) This Order of Conditions shall apply to any successor in interest or successor in
control;
19) Members and agents of the Conservation Commission shall have the right to enter and
inspect the premises to evaluate compliance with the Conditions and to require the
submittal of any data deemed necessary for that evaluation;

In accordance with the provisions of MGL Ch. 21, s. 43, 314 CMR 9. 00
and Section 401 of the Federal Water Pollution Control Act as amended
(Public Law 95-217) , this Division has determined that the project has
been designed to minimize impacts to waters and wetlands and that there
is reasonable assurance that the project can be conducted in a manner
which will not violate applicable water quality standards, as required
by 314 CMR 9. 04. The Division issues this Water Quality Certification
relative to this project, subject to the following conditions:
1. This project could result in a violation of water quality standards
adopted by this Division. Inland waters and wetlands not classified
by name in MA Water Quality Standards (314 CMR 4 . 00) are classified
as Class B, High Quality Waters, and are protected by anti-
degradation provisions of these standards. Therefore, reasonable
care and diligence shall be taken by the contractor to assure that
the proposed activity will be conducted in a manner which will
minimize violations of said standards.
2 . Prior to construction, erosion and sedimentation controls shall be
installed, to prevent the flow of silt and sediment into any
wetlands or waterways. The controls, such as silt fencing and hay
bales, shall be inspected and maintained throughout construction
and shall remain in place until all disturbed areas have
stabilized. ;
3 . A copy of this certification shall be provided to the contractor
and a copy shall be kept at the work site.
4. Dewatering discharges from the work area shall be effectively
filtered or settled to remove, silt prior to being discharged to
waters or wetlands.
5. Discharges from any dewatering shall not cause scouring of stream
bed, wetlands, or erosion of,_adjacent upland areas.
6. Emergent vegetation shall not be dredged.
7. Approval for the disposal of the ,dredged material shall be obtained
from the Division of Solid Waste Management in the DEP Western
Regional Office located in Springfield.
8 . Dredging shall be done during low water conditions while there is
no surficial connection between the pond and Broad Brook normally
July, August, and early September.
9. This division shall be notified of any changes in plans affecting
waters or wetlands. The Division will determine whether the
changes require a revision to this certification.

Dear Mr. Gracia:
The Department of Environmental Protection, Division of Water
Pollution Control has reviewed your application for Water Quality
Certification filed on behalf of George Page for work located at Coles
Meadow Road, Northampton.
The proposed project involves the dredging of approximately 3 , 700
square feet (548 cubic yards) of an existing man-made pond for the
purpose of creating habitat for an introduced population of trout. The
pond is currently too shallow to sustain a trout population. it is
proposed to deepen the man made pond an average of four feet over the
3 ,700 square feet. This pond borders Broad Brook. There is no
surficial outlet from the pond to Broad Brook.
A tracked or rubber tired excavator will be used to dredge the
pond. The equipment will impact a small amount of wetland and will work
from one area to limit impacts to surrounding wetlands. All dredged
spoils will be placed within a ring of silt fence located outside of the
the
wetland boundary for dewatering. The dredged material is classified as
Division of Water Pollution Control (DWPC) Type A, Category I Materials.
After dewatering, the spoils will be trucked to a field located
approximately 500 feet upgradient of the pond and will be graded and
seeded. Emergent vegetation within the pond has been located and these
areas will be avoided during dredging. There is no emergent vegetation
within the central area of the pond.
The dredging will be completed during low water conditions. Under
this condition, there is no surface connection between the pond and
Broad Brook. As a result, sedimentation impacts to the brook are
expected to be avoided. The maximum duration of dredging is expected to
be approximately 2 days.

9. HOW DOES PROJECT COMPLY WITH SPECIAL PERMIT CRITERIA
First, Applicant's lot meets the other minimum requirements of Section
16.9, namely, the lot size is well in excess of 80,000 square feet and the coverage
of impervious surfaces is well below fifteen(15) percent.
Second, the proposed use meets the specific criteria of Section 16.7 (C) (1).
Applicant's proposal meets the goals of Section 16 by providing a system that
recharges all drainage run off from impervious surfaces on site, prevents
contamination of groundwater by use of gas and oil traps in the driveway area, and
by installation of subsurface sewage disposal system meeting Title S requirements,
and controls soil erosion and sedimentation by use of a hay bale barrier during
construction.
Specifically, the proposal:
(a) "is in harmony with the purpose and intent of the By-Law and will
promote the purposes of the Water Supply Protection District" by providing a low
impact (residential) use that is designed to avoid any reduction of the quality or
quantity of the public drinking water resources;
(b) "is appropriate to the natural topography, soils, and other
characteristics of the site to be developed";
(c) "has suitable soil for on-lot sewerage and water systems";
(d) "will not, during construction or thereafter, have an adverse
environmental impact on groundwater resources in the district"; and
(e) "will not adversely affect the existing or potential quality and
quantity of water in the Water Supply Protection District".

E. Catch basin four shall discharge by outlet pipe under the cart path
shown on the plan to a stone masonry endwall. At the endwall will be a
nprap apron twelve feet long and eight feet wide. The total depth of the
apron shall be at least twenty-four inches, with twelve inches or more of
angular stone on top of a twelve inch gravel base.
F. All work shall take place outside the 100 foot wetland buffer zone.
Staked hay bales, as shown on Exhibit "D" shall be placed immediately
outside the 100 foot buffer zone during construction to prevent soil erosion
and sedimentation into the buffer area.

8. NARRATIVE DESCRIPTION OF THE PROPOSED PROJECT
The Applicant wishes to build a single family residence with garage and
pool. A special permit is required because the proposed improvements are partly
within 200 feet of a water course in the Water Supply Protection District. The
signed, dated and denied Zoning Application is attached as Exhibit "E".
The wetlands adjacent to the water course were marked when Applicant
applied for and received a permit to dredge the pond and grade around it. A copy
of a Water Quality Certification dated July 1, 1992, and the Order of Conditions
by the Conservation Commission detailing the dredging project are attached as
Exhibit "A".
The location of the proposed improvements are shown on the topographical
survey plan dated August 3, 1993 by Bruce Saluk & Assoc., Inc., submitted with
the Application. Some of the features include:
A. A proposed subsurface sewage disposal system located as shown on
the plan. The application for a disposal works construction permit was
approved June 3, 1991, and a Disposal Works Construction Permit issued
that same day. See Exhibit "B". The approved design is attached as
Exhibit "C".
B. The two catch basins to be located at the northwesterly end of the
driveway adjacent to the house (hereinafter referred to as "catch basin one"
and "catch basin two") shall be constructed pursuant to the detail attached
as Exhibit "D", which includes a gas and oil trap.
C. Catch basins one and two shall discharge through an outlet pipe into
the catch basin three. Water shall then discharge through an outlet pipe to
the catch basin four located on the northerly side of the property, all as
shown on the plan.
D. There shall be a foundation drain around the house which shall
discharge into either catch basin three or into catch basin four. The roof
gutters and down spouts shall also discharge into a pipe leading to catch
basin three or catch basin four, as shown on the plan.
