I have picked up the application form, and a floor plan for that living space is in process. Because the tenants have not been cooperative in permitting access to obtain measurements and get estimates, there will be a delay in completing the application. My preperty manager made several phone calls to the lower level tenants who did not answer. He left several messages on their answering machine which were not returned. Finally at the stage of considering involvement of the court to permit access, a phone message was returned. The earliest access the tenants would agree to is Monday, July 8. I anticipate having the application and floor plan submitted to your office within the next two weeks, as soon as it is complete. I appreciate your granting this additional time due to this delay caused by the lack of cooperation on the part of the tenants. In the meantime temporary arrangements are being made in case of emergency for the downstairs tenants to egress to the outside through the existing door to the main floor. Mahi Swan 471 Coles Meadow Road Northam ton MA 01060 VA Subject: Zoning violations for accessory apartment and Building Code violations lack of proper means of egress Dear Mahi Swan, I received a complaint referral from the Northampton Board of Health from a Sara Davinchi. The complaint was from an tenant in a apartment that lacked the proper number of means of egress. I made a site inspection on May 23, 2002 to 471 Coles Meadow Rd. and met Sara Davinchi who showed me the basement apartment that she is renting from you. My inspection revealed the following: a. The basement apartment had only one means of egress that lead directly to the outside, (violation of 780 CMR 1010.2 for minimum number of exits) b. The second means of exiting the apartment was through a door that lead through your dwelling unit then the to outside, this door was also locked at the time of my inspection. 780 CMR section 10 requires that there must be two means of exiting the apartment that lead directly to outside (780 CMR 1006.3 exit discharge.) c. The stairs leading directly to the outside lacked a handrail (780CMR 3603.14.1 handrails for three or more risers). d. The area is zoned RR-WSP-WP. Northampton Zoning Section 5.2 shows that a two family home is not allowed. You may have an accessory apartment by applying for a Zoning permit from the Building Commissioner as long as the apartment meets the specifications outlined in section 1010 of Northampton Zoning ordinances (copy attached). In response I would like to say that I am at Cooley Dickinson Hospital for the day Wednesday, May 22 attending an inservice for all nurses. I was working as a Registered Nurse at the Childbirth Center 2 1/2 years ago when the Davinchi's baby was born. It was as a result of that friendship that I agreed on a temporary basis in December of 2001 to permit them to stay in my home. There was an open door policy, at least from my side, permitting them access to my living space especially in case of emergency. They visited with me regularly ... at least a few times a week. On occasion we shared food. They helped from time to time caring for my animals. Unfortunately, during February the noise from their living space escalated to a point which I could no longer tolerate ... arguing, shouting, and the little one crying ... on a regular basis. They were interfering with my quiet enjoyment of my home. I was no longer comfortable extending my household as a living space to them. As a result I asked them to leave. The money they had agreed to pay me is now in arrears in excess of $1400. Despite the three notices they have received since the end of February, they have not moved out. I understand you are needing to schedule the visit at the convenience of Mrs. Davinchi. However, if it happens that you will be coming either Thursday morning or Friday afternoon, I would be happy to have you see in full the upper level living space as well.
