Upon completion of the project,the Applicant shall submit a certification that all work has been done in conformance with the provisions of the Order of Conditions and request a Certificate of Compliance. Permanent concrete markers spaced no more than 25 feet apart shall be installed along the Limit of Work Line or the 50' wetland buffer, whichever is closest to North Farms Road, as shown on the revised plans. 25. Prior to commencement of any site work, applicant shall submit revised plans to the Conservation Commission or their agent for approval. Plans shall show no structures encroaching in the 50' wetland buffer or the 200' Riverfront Protection area, and all grading and lawn around the house minimized and out of the 200' Riverfront Protection area. 26. Regraded/filled area on lot 2 within the 50' wetland buffer shall be replanted with native trees comparable to those removed, 12 feet on center. This shall be shown on the revised plans. The remainder of the disturbed area shall be seeded with native grasses and wildflowers, to be mowed one time per year, after August 1St 27. Regraded slopes around the house and within the 50' wetland buffer shall be replanted with native trees comparable to those removed, 15 feet on center. This shall be shown on the revised plans. PRE-CONSTRUCTION REQUIREMENTS: 28. The applicant shall notify the Commission, in writing, as to the date that the work will commence on the project. Said notification must be received by the Commission no sooner than(10) days and no later than five (5) days prior to the commencement of the approved activity. 29. Prior to the pre-construction meeting, the boundaries of all wetland resource areas, limits of work, and grading boundaries, shall be identified by clearly marked flagging and/or stakes, spaced at intervals not greater than 25 feet apart. Flagging used to identify wetland resource areas shall be a color different from any other flagging used on the site. 30. A member of the Conservation Commission and/or staff shall inspect the site to confirm that the house is staked out no closer than 50 feet from the edge of any wetland/resource area. NO WORK SHALL COMMENCE PRIOR TO SUCH APPROVAL BY THE CONSERVATION COMMISSION OR STAFF. 31. Prior to construction, the applicant shall provide to the Conservation Commission one full size set and one reduced size set of revised and approved construction plans. "Attachment A" 18. The owner of the property described in this Order must advise any potential buyer of the property that any construction or alteration to said property, including brush cutting or clearance, may require approval by the Northampton Conservation Commission. Any instrument conveying any or all of the owners' interest in said property or any portion thereof, shall contain language similar to the following: "This property is subject to the Northampton Wetlands Protection Ordinance and/or Wetlands Protection Act. Any construction or maintenance work performed on this property requires an Order of Conditions, and/or a Determination of Applicability from the Northampton Conservation Commission." 19. A copy of this Order and associated plans shall remain on site during all construction and/or building activities. The project manager and all equipment operators shall be familiar with the approved plans, and shall be informed of their location on the site. This location shall be accessible to all contractors whenever work is occurring on site. 20. All required permits must be obtained from the Army Corp of Engineers (Section 404, Water Quality Certification), Planning Board, Zoning Board, Department of Public Works, or Building Inspector prior to the start of projects involving fill within any wetland resource area; 21. No disposal of soils or other materials shall be allowed within: a 100-year floodplain; 40 feet of the 100-year floodplain elevation; any wetland; or any area within 100-feet of a wetland, unless such areas are specifically approved by the Commission, in accordance with 310 CMR 10.00, and City of Northampton Ordinances - Chapter 24; 22. Appeals The applicant, the owner, any person aggrieved by this Order, any owner of land abutting the land subject to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of their right to request the appropriate DEP Regional Office to issue a Superseding Order of Conditions. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. If this Order is intended to be valid for more than three years, the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill. The percolation testing and deep observation hole logging (Test Pit A-4 & B-4) were performed on April 25, 2002 and witnessed by Peter McErlain of the Northampton Board of Health. Two additional deep observation holes were dug in the location of the proposed house to determine groundwater elevatio-n in this area. It was determined that there was no weeping or standing water at/or above the 104 contour elevation, as shown on your plans. Large rocks were encountered at this elevation. The house foot print and paved driveway will create 4.5%of impervious lot coverage significantly below the allowed building coverage which is 15% for zone district. To minimize the impact of impervious coverage runoff each roof drain down spout of the house will be connected to a subsurface infiltration system. The infiltration system, in accordance with Section 16.6 will enhance ground water recharge. The subsurface infiltration structures will be located as shown on the site plan(see figure 3). Under the special permit application and as shown on the site plans,provisions have been to minimize the impact of the development on the WP and WSP overlay districts. -Runoff from ground surfaces will flow onto undisturbed adjacent vegetated wooded areas for ground water recharge. - Silt fence, erected prior to construction,will protect adjacent wetlands and undisturbed vegetated areas from sedimentation. - Soils compaction will be limited to the area of the house and septic system construction contained with in the silt fence barrier and with limited utility work to utility poles along Old Farms Road. - The septic tank for the residence will be constructed water tight and in accordance with the City of Northampton Board of Health requirements. - The single family residential use will not utilize any hazardous material which may be detrimental to the ground water supply. - In accordance with section 16.7 the basement finish floor elevation of the house will be three feet above the seasonal ground water table. The construction activity use of the land area for a single family house is anticipated not to have any negative impact on the ground water quality. The additional single family residential lot is anticipated not to have an adverse impact on the environment or water quality based on the following: - The residential use and low density. -Minimal site disturbance of the lot area. -Adjacent isolated wetland areas will be protected and significant undisturbed existing wooded open spaces will remain undisturbed for buffers to the wetlands. - The low density of the overall project at an average of 7 acres per unit preserves a significant amount of the 28 acre parcel as open space. Northern Woods -Lot 4 Northampton, MA Re: Project Development within a WP (Water Protection)and WSP(Water Supply Protection) Overlay Zone Districts. General Project Narrative The Northern Woods project site, located on Old Farms Road is within the Rural Residential (RR)Zone District.Northern Woods consists of three single family lots originally subdivided from a 28 Acre parcel. The lots are accessible from Old Farms Road via a common driveway. The application submitted to the Planning Board requests approval for an additional single family residential lot,Lot 4. Lot 4 will meet the minimum lot area requirements of the overlay zone district and a separate driveway will provide access from Old Farms Road. A potable water supply will be provided by an on-site well. A septic system will be constructed in accordance with Title V regulations on Lot 2 with an easement for access and maintenance. Project in Watershed Protection (WP) District The project site is in the WP overlay zone district and subject to Section 14 of the Zoning Ordinance. Based on the available Federal Flood Insurance Rate Maps, see figure 1,the project site indicates that the site is in a Zone C, subject to minimal flooding and is not in the 100 year floodplain. No development or disturbance with in a 100 year floodplain is planned and is not subject to the conditions set forth in Section 14.6 of the Zoning Ordinance. Project in Water Supply Protection (WSP) District In accordance with Section 16.3 the location of the high ground water table has been determined based on the Deep Hole observation data performed and provided by Heritage Surveys,Inc. for the septic system design, see figure 2. The location of the deep holes are shown on the attached site plan. Based on the Heritage Surveys, Inc. letter dated 6/28/02 the seasonal high ground watertable is at elevation 104.0. Gently sloping areas often produce large transitional zones where the vegetational boundary is difficult to delineate.Hydrology can supplement vegetative criteria to enhance the technical accuracy,consistency,and credibility of wetland boundary delineations,and are especially useful for analyzing disturbed sites. Bordering Vegetated Wetlands are likely to be significant to public or private water supply, to ground water supply,to flood control,to storm damage prevention,to prevention of pollution,to the protection of fisheries and to wildlife habitat. The plants and soils of Bordering Vegetated Wetlands remove or detain sediments,nutrients(such as nitrogen and phosphorous)and toxic substances(such as heavy metal compounds)that occur in run-off and flood waters. Some nutrients and toxic substances are detained for years in plant root systems or in the soils. Others are held by plants during the growing season and released as the plants decay in the fall and winter. This latter phenomenon delays the impacts of nutrients and toxins until the cold weather period, when such impacts are less likely to reduce water quality. Bordering Vegetated Wetlands are areas where ground water discharges to the surface and where, under some circumstances,surface water discharges to the ground water. The profusion of vegetation in Bordering Vegetated Wetlands acts to slow down and reduce the passage of flood waters during periods of peak flows by providing temporary flood water storage and by facilitating water removal through evaporation and transpiration. This process reduces downstream flood crests and resulting damage to private and public property. During dry periods the water retained in Bordering Vegetated Wetlands is essential to the maintenance of base flow levels in rivers and streams,which in turn is important to the protection of water quality and water supplies. The Act defines freshwater wetlands by hydrology and vegetation. Hydrology is the driving force which creates wetlands, but it is a transient, temporal parameter. The presence of water at or near the ground surface during a significant portion of the year supports,and in fact promotes,the growth of wetland indicator plants. Prolonged or frequent saturation or inundation also produces hydric soils, and creates anaerobic conditions that favor the growth of wetland indicator plants. Hydric soils are direct indicators of long-tern hydrologic conditions and are present throughout the year. Wetland vegetation supports a wide variety of insects,reptiles,amphibians,small mammals and birds which are a source of food for important game fish. Bluegills (Lepomis macrochirus), pumpkinseeds (Lepomis gibbosus),yellow perch(Perca flavescens),rock bass(Ambloplites rupest«s)and all trout species feed upon nonaquatic insects.
