Corbett, if she becomes the owner as aforesaid, the right to mow
the existing lawn area within said portion of the granted premises.
Access to the parcel herein conveyed is pursuant to a shared
Driveway Agreement over the above conveyed right of way as more
particularly bounded and described on the driveway agreement
recorded in the Hampshire County Registry of Deeds as Document No.
IL 9 9 0 and the aforementioned plan, and not over the front lot
line on North Farms Road.
Also granting herewith to the grantee, her heirs, successors
and assigns, a sanitary easement granting the right to come upon
the land of these grantors for the purposes of laying, repairing
and maintaining a sanitary sewer pipe and leach field as more
particularly shown on the above mentioned plan. The pipe is to be
laid along the lime of the sanitary easement. The leach field is
to be of customary size and conventional underground design and
located at the southerly end of the sanitary easement on the land
of the grantors. The parcel burdened at said locations is parcel
1-Bas shown on the aforementioned plan. In connection with said
easement, Grantee, her heirs, successors and assigns, shall have
the responsibility, without expense to Grantors, their heirs,
successors and assigns, to restore the land to its conformity
prior to the installation of said septic system and to restore the
land in such manner after each repair or maintenance of same. As
further consideration for said easement, Grantee, her heirs,
successors and assigns, release Grantors, their heirs, successors
and assigns, indemnify them against and hold them harmless from any
liabilities and damages whatsoever occasioned by the said system.

road. The requested use will not create undue traffic congestion
or unduly impair pedestrian safety because of the shared driveway.
The requested use will not overload any public water or sewer
systems because the residence will have its own water and will not
be dependent on city storm sewer or sewer systems. The requested
use is in harmony with the general purpose and intent of the
ordinance and is consistent with the integrity and character of the
existing Rural-Residential zone.
The Planning Board voted to approve the Special Permit for a common
driveway under $6.12 of the Zoning Ordinance, Page 6-14. The
common driveway shall service only two lots. The common driveway i
shall provide the only vehicle access to the lot being serviced by }
it and shall be so stated in the deed to the subject lot. The deed
from Corbett to Sullivan will state that the only access is across
the right-of-way as reserved to Corbett in the Hampshire County
Registry of Deeds, Book 2376, Page 2. The common driveway, as j
shown on the site plan, shall have 12-foot bituminous concrete i
surface with four-foot, plus or minus, grass shoulders on each side
as required by the ordinance. The driveway is less than 300 feet
in length, and meets the approval of the DPW and the Fire
Department, and complies with all other driveway requirements.
The Planning Beard also reviewed the criteria for site plan
approval under. §10.11 and voted unanimously to approve the s-te
plan. review wth the requested waivers because there _- be
minimum impact on pedestrian and vehicular traffic; provisions for i
drainage and water problems have been addressed with the proposed
2' wide scale along the driveway to carry surface water away from
the site; there will be no adverse impact on the City's resources.
Pursuant to Mass. General Laws, Chap. 40A, §11, no variance,
finding, or special permit, or any extension, modification or
renewal thereof, shall take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed after the decision has been filed with the City Clerk and
that no appeal has been filed, or if such an appeal has been filed
that it has been dismissed or denied, is recorded in the Hampshire k
County Registry of Deeds and indexed under the name of the owner of
record or is recorded and noted on the owner's certificate of
title. The fee for such recording or registering shall be paid by
the owner or applicant.
The Northampton Planning Board certifies that a variance, finding,
or special permit has been granted and that copies of this decision
and all plans referred to in it have been filed with the Planning
Board and the City Clerk.
