These items will need to be addressed before a permit is issued;
1. Braced wall detailing at the garage door is required per R602 Non-prescriptive solutions require
stamped engineering.
2. All non prescriptive materials and or systems require engineering I.E.- roof truss.
3. Exterior wall require R-20 insulation, in general the energy requirements must meet the 2009 IECC.
4. Adding a bedroom to a structure requires that the entire house's smoke, heat, and CO detectors
must be brought up to current code requirements.
5. The original application and fee was for a 26x30 detached and the fee was calculated to be$156,
however the current project is a 8x26 mud entry/laundry, 22x26 two car garage,30x26 master
bedroom and master bath and stair enclosure.The recalculated fee is 452.40—156=$296.40 due.
Note:July 1 begins enforcement of the 2012 IECC with MA amendments and fire protection for non-
dimensional lumber floor system frames,the new Stretch Code is pending.
As of August 4th 2011 the 8th Edition MA code is the 2009 IRC with MA amendments.

It took a while to get through the zoning aspects of your proposal for the addition at 194 North Street. It turns out
to be a complicated situation. The reason I can't simply approve it has to do with the new zoning regulations for
the URB district. The design standards require that an attached garage be set back 20'from the front lot line and
because you have a comer lot, there are 2 front lot lines. If I'm reading the plot plan correctly, the setback is only
12'. A 12'setback would ordinarily work for living space but the garage changes that. I've attached a copy of the
zoning table and circled the relevant section. 1 haven't seen a front elevation of the whole house, but I am nearly
certain that you will meet the cther requirement that the garage only take up 30% of the facade.
It seems like you have 2 options. You could set the addition back another 8 feet, but it looks like that would likely
ruin the plan. There is a provision in the zoning ordinance (based on a recent court decision)that would allow the
Zoning Board of Appeals to issue a special permit for the non-nonconforming setback because the existing house
is non-conforming:

(10)With a special permit for a single-or two-family home when the Zoning Board makes a finding that the
change which includes new zoning violations (such as reduction of open space, new setback encroachments or
further encroachments into the setback, etc.)will not be substantially more detrimental to the neighborhood than
the existing nonconforming single-or two-family structure.
I think they would issue the permit because I don't think the addition could be seen as "substantially more
detrimental to the neighborhood".

In approving the Special Permit,the Board found that the expansion along the side of the house was not substantially more detrimental to
the neighborhood than the existing non-conforming setback of the detached garage. The Board determined that a drywell would offset
runoff from the new addition to counter any runoff that may be coming of the existing detached garage that will remain on site.
