The requested use protects adjoining premises against seriously detrimental uses because it proposes a residential use of property located in a Rural Residential zoning district. B. The requested use has provided for the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets because the number of additional dwellings proposed is only one, and this residence will generate a minimal amount of traffic. Two house lots will be served by a common driveway. C. The requested use has provided for a harmonious relationship of structures and open spaces to the natural landscape because it meets the lot size requirements for the Rural Residential District. The requested use promotes a harmonious relationship with existing buildings because it is a residential use in a Rural Residential District. D. The project has mitigated adverse impacts to the City's water supply and distribution, the City's sewage collection and treatment systems, the City's fire protection system, and the City's streets. E. The requested use meets all special regulations set forth in the Zoning ordinance under Section 6. 13. F. The project has provided for compliance with the Technical Performance Standards as listed below: 1. The curb cuts have been minimized because no additional curb cut is requested. A driveway opening currently in existence will be closed and a new driveway opening will serve both lots. 2 . Pedestrian, bicycle and vehicular traffic movement has been separated on the site by construction of a driveway. ATTACHMENT C Section 6. 13 Flag Lots. In reviewing the application for a Special Permit to create a flag lot, the Planning Board found the following: 1. The lot met the requirements of the Table of Dimensional and Density Regulations, Section 6.2 . 2 . The access roadway does not have a radius of less than eighty (80) feet. 3 . The lot is laid out such that a circle with a diameter one and one-half (1 1/2) times the required frontage can be placed around the principal structure without any portion of said circle falling outside of the property's line. 4 . Only one flag lot is being created, and only one curb-cut and driveway access is proposed. Deeds to the lots shall contain easements providing for the maintenance of the common driveway. 5. The driveway conforms to all applicable provisions of the Zoning Ordinance and is suitable in construction for access and the turn-around of vehicles. 6. The Plans submitted to the Planning Board include the statement "Parcel 2 is a Flag Lot: Building is Permitted Only in Accordance with the Special Flag Lot Provisions of the Northampton Zoning Ordinance. " 7. The Special Permit application includes a plan showing the location and layout of the proposed driveway and house. Permission to install a driveway has been granted by the Department of Public Works. The use will not be detrimental to the health, morals, or general welfare and shall be in harmony with the general purpose and intent of the Ordinance. G. The requested use will promote City planning objectives to the extent possible and will not adversely affect those objectives, as defined in City master or study plans adopted under M.G.L. Chapter 41, Section 81-C and D. In granting the Special Permit with Site Plan Approval for a flag lot, the Planning Board imposed conditions upon the project as follows: 1. The Special Permit shall be recorded at the Registry of Deeds prior to the issuance of a Certificate of Occupancy. 2 . Revised plans shall be submitted when an ANR Plan (Form A) is submitted for approval. The revised plans must show passing turnouts and provisions for run-off to flow overland away from the driveway and not into the road. 3 . When the applicant applies for a building permit, he must demonstrate that the proposed dwelling has two times the setbacks normally required for the zoning district. In Granting the Special Permit with Site Plan Approval for a flag lot, the Planning Board found: A. The requested use for a flag lot protects adjoining premises against seriously detrimental uses because it is a residential use of a property in a Rural Residential zoning district. B. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets and minimize traffic impacts on the streets and roads in the area because it will generate a minimal amount of additional traffic. Lot "A" and "B" as shown on the plans shall be served by a common driveway with only one driveway opening onto Sylvester Road. C. The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape, existing buildings and other community assets in the area because it will be in keeping with the residential character of the neighborhood. D. The requested use will not overload the City's resources. There is no need to mitigate adverse impacts on the City's resources, including the City's water supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools, because there will not be any adverse impacts on these systems. The requested use calls for the addition of one residential dwelling. E. The requested use meets all special regulations set forth in the Zoning Ordinance under Section 6. 13 and Section 10. 11. (See Attachment C and D) F. The requested use bears a positive relationship to the public convenience or welfare because it provides additional housing. The use will not unduly impair the integrity or character of the district or adjoining zones because the proposed use is residential, and the property is located in a district zoned Rural Residential. The project has mitigated adverse impacts to the City's water supply and distribution, the City's sewage collection and treatment systems, the City's fire protection system, and the City's streets. E. The requested use meets all special regulations set forth in the Zoning ordinance under Section 6. 12 . F. The project has provided for compliance with the Technical Performance Standards as listed below: 1. The curb cuts have been minimized because no additional curb cut is requested. In reviewing the application for a Special Permit with Site Plan Approval to permit a common driveway, the Planning Board found the following: 1. The common driveway does not serve more than three (3) lots, 2 . The common driveway provides the only vehicular egress/access to the lots being serviced by it, and this is stated in the deeds to the subject lots, 3 . The grade, length and location of the common driveway is of suitable construction for the access and turn-around of the vehicles which will be utilizing the common driveway. A. The driveway has a width of at least fifteen (15) feet, B. The driveway has passing turnouts providing a total width of at least 20 feet along a distance of at least 25 feet, with the first such passing turnout being located within ten feet of the driveway connection to the street, and C. The driveway is acceptable to the Department of Public Works and the Fire Department, D. The driveway conforms to all other driveway requirements of the Zoning Ordinance. s In granting the Special Permit with Site Plan Approval for a common driveway, the Planning Board imposed conditions upon the project as follows: 1. House numbers identifying all of the homes utilizing each common driveway shall be placed at the intersection with the city street, and at any subsequent fork/turnoffs in the common driveways for the purpose of identification by emergency vehicles. 2. Easements shall be placed on the deeds to the lots, granting access to and over the subject parcels, and shall be recorded at the Registry of Deeds, prior to the issuance of a curb cut/driveway permit. The applicant shall submit the proposed easement to the Planning Board for its approval prior to recording. 3 . The Special Permit shall be recorded at the Registry of Deeds prior to the issuance of a Certificate of Occupancy. 4 . The common driveway shall remain a private way with maintenance of the drive the responsibility of the lot owners. 5. The common driveway shall be constructed within two years. 6. Revised plans shall be submitted when an ANR Plan (Form A) is submitted for approval.
