This is to notify The City of Northampton, Building Inspector's Office, that the
work has been completed on the above referenced project, and is ready for inspection.
This project had two conditions for approval:
1) To provide a letter certifying that the shed was designed, constructed and
anchored to prevent flotation, collapse, or lateral movement during flooding.
The attached set of photos shows that the shed was set on a gravel base, with
cement columns placed at the corners of the shed to prevent movement &
flotation. These were set in place as directed by Killam Associates, of Hadley,
according to attached plan.
2) To submit a letter documenting the disposal of four cubic yards of material
outside the floodplain.
The original of the letter from Hatfield Equipment stating the removal of four
cubic yards of material was already submitted to the Building Inspectors Office.
A copy is attached to this letter.
The permit for this project is tacked on the inside wall of the shed, in case no one
is home at the time of inspection. Please contact me, if more information is
needed.

At 8:48 p.m., Yacuzzo opened the Public Hearing on a request from Patricia Nowak for a Special Permit with Site Plan Approval to erect a
structure(a pre-fab, 10'x 10'garden storage shed)in a Watershed Protection District under Sections 5.2,10.10, 10.11 and 14.3 of the
Zoning Ordinance, for property located on Old Ferry Road,also known as Assessor's Map 25C,Parcel 265.
Yacuzzo read the legal notice.
Matt Nowak,Patricia Nowak's son,explained that the proposal was to place a ten-by ten-foot garden storage shed on an open lot next to
his mother's house. The area where the shed is to be placed currently stands at an elevation of one hundred and twenty point Five(120.5)
feet,while the flood plain is atone hundred and twenty-five(125)fee4 he noted. Nowak said they had been told they needed to take
steps to prevent flotation or lateral movement of the structure in case of flooding. He explained that they were going to place two
bollards on two separate ends of the shed so that it could not move if flooding occurred. Also,he related that the shed would have two-
inch vent holes along its floor line to allow the shed to fill with water in the event of flooding.
Nowak said he had submitted a letter from Robert Simard of Killam Associates to this effect at the Conservation Commission meeting
Monday night.
Nowak said it was also suggested that they get actual calculations as to how much area the shed and bollards would take up. The
original estimate was a little excessive,he commented. Nowak said he had Simard do some calculations,and Simard determined the
shed and bollards would take up 1.2 cubic yards of Fill. They were talking about taking a total of four cubic yards out one to compensate
for the volume of the shed and bollards and two to compensate for gravel they were bringing in to place underneath the shed,he
advised. In doing the[initial]calculations,Simard took into consideration the entire bollard and not just the portion that was going to be
above-ground in the flood plain,Nowak said.
Feiden informed members that the Conservation Commission had asked the Planning Board to impose the following two conditions,
since it was difficult to enforce conditions attached to a Determination of Applicability,the permit issued by the Commission for this
project: 1)[requiring]some certification that the work was done according to plans,not necessarily an engineer's certification,and 2)
[requiring that]four cubic yards of material be removed.
Crystal moved to close the hearing. Romano seconded. The motion passed unanimously 5:0.
Romano moved to grant the request from Patricia Nowak for a Special Permit with Site Plan Approval to erect a structure on Old Ferry
Road because it meets the requirements of our zoning with the condition that 1)a professional engineer or architect certify that the
structure was"designed, constructed and anchored to prevent flotation,collapse,or lateral movement of the structure during flooding."
Romano also moved to grant any requested waiver. Jodre seconded. The motion passed unanimously 5:0.
Crystal clarified that a letter from the applicant would be sufficient certifying that the work was performed as proposed. Feiden said they
also would need a receipt from the contractor that took out four yards.

FINDINGS:
In Granting the Special Permit with Site Plan Approval,the Planning Board found.
A.The requested use for a garden/storage shed protects adjoining premises against seriously detrimental uses because the shed is a 100
square foot accessory structure which will not create any conceivable adverse impacts to adjacent properties. Since the property is
located in the flood plain of the Connecticut River,the applicant has provided compensatory storage to replace the volume of flood
storage displaced by the proposed structure.
B.The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and minimize traffic
impacts on the streets and roads in the area because the storage shed will have no impact on pedestrian or vehicular traffic patterns or
volume.
C.The requested use promotes a harmonious relationship of structures and open spaces to the natural landscape,existing buildings and
other community assets in the area because the shed is in keeping with adjacent residential uses.
D.The requested use will have no impact on the City's resources,including the City's water supply and distribution system,sanitary and
storm sewage collection and treatment systems,fire protection,streets and schools.
E.The requested use meets all special regulations set forth in the Zoning Ordinance under Section 14.3.
F.The requested use bears a positive relationship to the public convenience or welfare by providing storage for garden equipment,etc.,
which might otherwise be stored outside.
The use will not unduly impair the integrity of character of the district or adjoining zones,nor be detrimental to the health,morals,or
general welfare. The use is in harmony with the general purpose and intent of the Ordinance.
G.The requested use will promote City planning objectives to the extent possible and will not adversely affect those objectives,as
defined in City master or study plans adopted under M.G.L.Chapter 41,Section 81-C and D.
In addition,in reviewing the Site Plan,the Planning Board found the requested use complies with the following technical performance

The current exemption for "homeowners" was extended to include
Owner-occupied Dwellings of one ( 1 )or two (2) families and to allow such .
homeowner to engage an individual for hire who does not possess a `
license, provided that the owner acts as supervisor. CMR780 Section 109. 1 . 1
DEFINITION -OF- HOMEOWNER: Person( s ) who own a parcel of land on
which ..he/she residers or intends to reside , on which there is, or is
intended to be, a one or two family_ dwelling, attached or detached
structures accessory to such use and/or farm structures. A person who
constructs more than *one home in a two-year . period shall not be
considered a homeowner . - Such "homeowner" shall submit to the Building
Official, on a form acceptable to the Building Official, that he/she -
shall. be responsible for all such work performed under: the bui-ldihq
permit*.
As acting Construction Supervisor your presence on the:. job site
will be required from time to time, during and upon cotiipletipn' o'f the
work for which this permit is issued.
Also be advised that with reference to Chapter 152 (Workers '
Compensation) and Chapter 153 (Liability of Employers to Employees for
injuries not resulting in Death) of the Massachusetts General Laws
Annotated, you may be liable for person( s ) you hire to perform work for
you under this permit .
