Contractors were removing Asbestos from house #153 without taking the proper safety precautions. Health and Building Inspectors have been notified. Refer To Incident: 04-862-OF Northampton Police Department Page: 1 NARRATIVE FOR PATROL JEFFREY A VON DAUBER-4023 04/27/2004 Ref: 04-862-OF Entered: 04/17/2004 0 0845 Entry ID: 168 Modified: 04/17/2004 0 0850 Modified ID: 168 Approved: 04/24/2004 0 1236 Approval ID: 46 On 04/16/2004 at approx 1400 hours, Officer Rodriguez and I (Officer Von Dauber) were dispatched to 153 Bridge Street for a report of a verbal argument between neighbors. Upon arrival, I met with Norman Zalesky and Peter Gross who were contractors hired to remove siding from 153 Bridge Street. The owner of the residence is Michael Shaughnessy. Zalesky stated that he is being prevented from doing his work by a male later identified as Richard Finn. I inquired why Finn did not want Zalesky working on the house and why he was trying to prevent him from doing his work. Zalesky was reluctant to say why. Finally, after asking several time, Zalesky informed me that Finn believed the siding that he was removing to be asbestos. Zalesky stated that it was "cement board" and not asbestos. At that point Finn approached Zalesky as I was speaking to him (Zalesky). Finn was abrasive in his approach. I requested that he speak with Officer Rodriguez while I speak with Zalesky. I wanted to keep the parties separate to avoid having the incident escalate. Zalesky led me to the siding that he had removed. I noticed that it was fibrous on one side. I then requested that the Health and Building Inspector respond. While speaking with Zalesky and Gross, Zalesky claimed that Gross was pushed by Finn and that Finn threatened to hit Zalesky if he did not stop removing the asbestos siding. The Northampton Director of Public Health, Ernest Mathieu, arrived on scene. I informed Mathieu of the situation. He examined the siding and confirmed it to be asbestos siding. I then ordered Zalesky and Gross to immediately stop work. Mathieu also informed them they are to halt all work on the house. Moments later, Stanley Szewczyk (Building Inspector's Office) arrived and revoked the building permit and issued a stop work order. Finn stated that he observed that Zalesky was removing asbestos. He informed Zalesky of the situation but Zalesky would not listen or stop what he was doing. At that point, Zalesky was breaking the asbestos tiles with a hammer to get them into cardboard boxes. He was also loading the broken tiles into the back of his van to bring them to the land fill. Since Zalesky would not stop, Finn told him the he would physically stop him if he had to. At that point, Zalesky phoned the police to keep the peace. According to Finn, he had contacted the EPA and OSHA about the infractions. Finn's son, James Finn was also on scene. Photos were taken and attached to this report. The Building and Health Inspectors contacted the appropriate agencies. Shaughnessy was informed of the situation. Zalesky was advised to seek a complaint at District Court for the Assault Charges.
