Dear Mr. Korza:
The licensing law does not speak to where you operate from as a broker. To say,
it another ways, yes you can operate out of your home since the relevanto S-a+es mswxr-
licensing law does not prohibit this. However, keep in mind that while your
are licensed to do brokering (and have what you need from this ,state licensing
agency) your local communities may have restrictions against operating a
business out of your home. You should check with your local city= or town
government to see if there are such restrictions and, if so, if you can get a
variance from the local ordinance restricting such practice.
The Board's regulations (including the one you cited on "active association")
are on the Board's web page and you can print them at your local printer.
First go to the Massachusetts Division of Registration, the Board's parent
agency. Just key in
www.state.ma.us/reg
Once in the Division's web page click on "ENTER" and then click on "BOARD'S.
Looking at the alphabet select the letter "R" and then select "Board of Real
Estate Brokers and Salesperson's".
You are now in the Board's web page and on the left you will see a number of
functionality's including "Statutes and Regulations". Click on there and
scroll to the regulation you want. You should be able to print it at your
local printer.

I have a very important question that I need answered. The question is t

the telephone, online, and in person at prospective rental locations. A
post office bozo would be used for a mailing address. From over 5 years
of experience in this field I have realised that actually having a
public office hinders business because so much more can be accomplished
over the telephone and online in a much more thorough, convenient, and
efficient manor. The public and potential clients would be better
served. I have asked this question of several licensed brokers in PiA as
well as a couple of attorneys and real estate educators and they all
said the same thing. That is, that a rental agency can be run from a
home office in MA.. In being thorough, I wanted to get confirmation of
this from the MA Real Estate Board as well. Also, I need to get a copy
of the section of the license law defining active
association(2154CMP.2.05) . Please email a response to my question as well

Home Occupation Proposal:
I am applying for a zoning,permit to operate a real estate rental office from a home office on a
part to full time basis. The business would be exclusively involved in the renting of residential and
possibly commercial property_ No sales or management would be done_ As a preliminary step, I
have received written notification from the Massachusetts Real Estate Board in Boston that the
business in question can legally be operated from a home office. *-5e, 4-a( L
I have been running the leasing,department of an area property management tuna for the past five
and one halt years on a full time basis. My position is involved exclusively in the renting,of
residential and commercial property. With this much experience and the success that I have
enjoyed I. am considering going into business for myself. The reason for wanting to operate this
business out of a home office is to better serve my clients and customers_ My experience assures
me that this would be the case. Well over 95% of the business that I conduct is either on the
telephone, at a property site, online, or per fax. While receiving customers and clients at the
office is an extremely small percentage of my day, it is by far the most unproductive. Eliminating
this unproductive element would allow me to serve my customers and clients in a more thorough,
convenient, and efficient manner. This is why a home office would be optimal.
My use would be clearly incidental and secondary to the use of the property for residential
purposes. All business mould be exclusively conducted by myself The actual space of the unit
would not change at all from the current state. There would be no advertising of any sort on the
property. There would be no goods stored, sold, or manufactured on the property_ The hours of
operation would vary®but would be irrelevant to the property because all business would be done
off-site, on the telephone, or online. There would be no deliveries to or frorn the property. A
mailing service such as"Mailboxes Etc." would be used to send or receive documents. There will
be absolutely no interference to neighbors or the neighborhood in any capacity. There would be
no clients or customers seen on the property. There would be no need for parking.
I realize that permits for home occupation are non-transferable and that I would need to re-apply
if I were to change my residence. I only say this to put emphasis on the fact that this business
could be operated out of any house or apartment because there is absolutely no change to the
property with the sole exception of the addition of a second phone line if one does not already
exist. That is exactly the point as far as I'm concerned. My home will not be changed in any way
with the exception of the aforementioned second phone line. I currently own both a computer
and fax machine so 1 would not need any additional equipment either.
