MEMORANDUM

RE: Donald Coffey and Phoebe Mitchell's Special Permit Application
DATE: February 3, 2000
Please note for your records that the above referenced application was not filed with the
Office of Planning and Development. Please so note in your records.
1. On February 1, 2000, Mr. Coffey brought copies to your office. Your office date
stamped the application and kept one copy.
2. Mr. Coffey then brought the application to the Office of Planning and Development.
Upon our review, it appeared that this Special Permit by itself would not provide the
applicant with the relief he sought.
3. I advised Mr. Coffey that he would also need to apply for a variance because his is
proposing to create a new zoning violation for his dimensional requirements or he
should better document his claim in the special permit application that his project is
already a pre-existing non-conforming three-family home, and resubmit a revised
Zoning permit application to the Building Commissioner for action.
4. Mr. Coffey requested that I call his attorney, Edward Etheredge, while he was here.
His attorney concurred that the above appears to be a reasonable path for the applicant
to pursue.
5. Mr. Coffey then decided not to submit his application or fee. (See his attached note
on his cover sheet that"I'm not filing today 2/1/00"). As such this application has not
been formally filed and there is no statutory clock ticking on the application.
