DECISION OF
NORTHAMPTON ZONING BOARD OF APPEALS
At a meeting held on July 23, 1986, the Zoning Board of Appeals of
the City of Northampton, voted unanimously to approve the Special Permit
and Finding request of Richard Carnall and Pamela Duseau, 14 Orchard
Street, Northampton, MA, for the purpose of converting an existing two-family
dwelling into a three-family dwelling at property located at 14-16 Orchard
Street, Northampton (URB 'Lone). Present and voting were: Chairman Robert C.
Buscher, Kathleen M. Sheehan and Sanford Weil, Jr.
The findings were as follows:
K. Sheehan, referring to Section 10.10 of the Northampton Zoning
Ordinance, found that the use is listed in the Table of Use Regulations;
that ;,the requested use will not be substantially more detrimental than
the existing use. She stated that a number of neighbors expressed
concerns with additional vehicles and parking problems on the street
as a ;result of rentals, and found, after a site visit, that there are,
in fact, several units across the street from Mr. Carnall and Ms. Duseau's
property which do not have adequate parking, and it was suggested that
the neighbors contact the Building Inspector regarding this matter. She
stated that Mr. Carnall has assured the Board that he will slope the
proposed driveway so as not to contribute to the existing drainage
problem of the abutting neighbor.
S. Weil concurred that there will be no problem with drainage and
that', the parking space will be adequate, however, expressed concerns
with; the applicants creating a tenement-like effect because of the
small rooms and lack of lighting on the third floor. Ile stated that
because the request meets the technical requirements, lie would
reluctantly vote in favor of the request.
R. Buscher noted that if granted the Special Permit, the applicants
would have to comply with State building codes in regard to size and
lighting. Referring to Section 10.10, he found that the use is listed
in the Table of Use Regulations; that the requested use bears a positive
relationship to the public convenience, as there is a need for affordable
housing in Northampton; that the opponents' central issue of traffic
congestion will not be greatly impacted by one or two more vehicles;
tha� one additional housing unit will not overload public water, sewer
or any other municipal system; and that there are no issues affecting
health, safety and the general welfare, as there will be two means of
of access and egress to each unit and as this is a neighborhood with --°
many 2-, 3- and multi-family dwellings. lie suggested that this is also
a zone where a number of two-family dwellings are amenable to being
converted into three-family dwellings, and despite the fact that a

precedent may be set and the Board may receive an inundation of con-
version requests, he felt it unfair to Mr. Carnall to impose this concern,
and voted in favor of the petition. He also cited the existing drainage )
problem on the abutting property, finding that the major problem is a
result of the land itself which sets 6" lower than the surrounding
property, and that the addition of blacktop to provide for parking
spaces will not severely increase the drainage situation.

j NORTHAMPTON ZONING BOARD OF APPEALS
At a meeting held on July 23, 1986, the Zoning Board of Appeals of
the City of Northampton, voted unanimously to approve the S ecial Permit
and Finding request of Richard Carnall and Pamela Duseau, 14 Orchard
i
Street, Northampton, MA, for the purpose of converting an existing two-family
dwelling into a three-family dwelling at property located at 14-16 Orchard
STreet, Northampton (URB Zone). Present and voting were: Chairman Robert C.
Buscher, Kathleen M. Sheehan and Sanford Weil, Jr.
The findings were as follows:
K. Sheehan, referring to Section 10.10 of the Northampton Zoning j
Ordinance, found that the use is listed in the Table of Use Regulations;
that the requested use will not be substantially more detrimental than
the existing use. She stated that a number of neighbors expressed
concerns with additional vehicles and parking problems on the street
as a result of rentals, and found, after a site visit, that there are,
in fact, several units across the street from Mr. Carnall and Ms. Duseau's
property which do not have adequate parking, and it was suggested that
the neighbors contact the Building Inspector regarding this matter. She
stated that Mr. Carnall has assured the Board that he will slope the
proposed driveway so as not to contribute to the existing drainage
problem of the abutting neighbor.
S. Weil concurred that there will be no problem with drainage and
that the parking space will be adequate, however, expressed concerns
with the applicants creating a tenement-like effect because of the
small rooms and lack of lighting on the third floor. He stated that
because the request meets the technical requirements, he would
reluctantly vote in favor of the request.
R. Buscher noted that if granted the Special Permit, the applicants
would have to comply with State building codes in regard to size and
lighting. Referring to Section 10.10, he found that the use is listed
in the Table of Use Regulations; that the requested use bears a positive
relationship to the public convenience, as there is a need for affordable
housing in Northampton; that the opponents' central issue of traffic
congestion will not be greatly impacted by one or two more vehicles;
that one additional housing unit will not overload public water, sewer
or any other municipal system; and that there are no issues affecting
health, safety and the general welfare, as there will be two means of
it of access and egress to each unit and as this is a neighborhood with
many 2-, 3- and multi-family dwellings. He suggested that this is also
a zone where a number of two-family dwellings are amenable to being
converted into three-family dwellings, and despite the fact that a
