With rtference to the above property, L submit the following opinions
for your approvals
It vrovld appear that this structure is a nonconforming gasoline and
repair garage, protected by Mass. General Laws, 4OA, Section 6.
On September 29, 1976, gas storage was increased by the City Council
with conditions. Paragraph six said the business *hall not includes
ofrepsirs, of notor vehicles." This condition seelps to be overridden
by the Z.P.A. decision of October 6, 19809 which allows automotive
repair with conditions that the applicant abide by the law relative
to craking storage taroks at the site Inoperable. Because the Z.B.A.
In the controlling authority on toning, it would appear that the
repair of automobiles is now legal..
The condition set by the Z.B.A. to remove the tanks, is based on
your Letter of October 60 19800 of which I quote in part,......»..
'°thcs City Council would have the authority to revoke the gasoline
permit." The permit was not revoked, or the tanks removed.
I would interpret this to mean that if Hr. Duffy, the present owner,
wishes to apply for a gasoline storage permit, and it is granted by
the City Council, the gasoline service would then be legal. At that
time, with all required permits, a Certificate of occupancy could be
issued for gas sales and automotive repair.

Dear Mr. Duffy,
At the City Council meeting of February 18, 1982,
I requested a decision, by the Council, whether they will
continue the permit for storing and selling of gasoline at
200 Bridge Street. It was decided to continue the permit for
storage and selling of up to 30,000 gallons of gasoline in
3 - 10,000 gallon tanks, per site plan filed in the City Clerk' s
Office, after payment of any outstanding bill.
If you wish to stop in at the City Clerk' s Office
and pay the outstanding balance, a Certificate of Registration
will be issued to you as the owner of that property.
