At a meeting conducted on July 24, 2003, the Northampton Zoning Board of Appeals Zoning
Administrator GRANTED the request of Terrence Lee for a FINDING under the provisions of
Section 9.3 in the Northampton Zoning Ordinance for an expansion of a pre-existing non-
conforming side yard setback to demolish an existing detached garage and build a new detached
garage for property located at 44-46 Elizabeth Street, Northampton.

The Findings of the Board under Section 9.3 for an expansion of a pre-existing non-conforming
side yard setback were as follows:
1. The Board found that the expansion would not be substantially more detrimental to the
neighborhood than the existing nonconforming structure and would not extend any closer
to any front, side, or rear property boundary than the current zoning allows and that the
existing structure already extends. The current non-conforming structure sits 1' from the
side and rear property boundary and the new garage will be located F from the side
boundary and 4' from the rear property boundary.
2. The Administrator also determined that this extension would not create any new violation
of other zoning provisions; and does not involve a sign.
