City Clerk City of Northampt i 4 i i I i r • I DECISION OF ZONING BOARD OF APPEALS At a meeting held on December 17, 1986, the Zoning Board of Appeals of the City of Northampton voted unanimously to grant the Variance and Special Permit request of Christopher Kennedy, Stuart F. Solomon and Stephen G. Whitlock, P.O. Box 371, Northampton, MA, for the purpose of converting an existing single-family dwelling into a two-family dwelling on a nonconforming lot at property located at 222 Bridge Street, Northampton, MA. Present and voting were: Chairman Robert C. Buscher, Peter Laband and Sanford Weil, Jr. The findings were as follows: S. Weil found, after a site view, that the request complies with the requirements necessary for a Special Permit and a Variance and voted in favor of the request provided the garage is removed in order to increase the turning radius so that vehicles can enter onto Bridge Street in a forward direction. r P. Laband, referring to the criteria necessary to grant a Variance from Chapter 40A, M.G.L. , found that there is a peculiar shape to this parcel of land with a Victorian house set on it, which affects this parcel and none other; that literal enforcement of the Ordinance would create a hardship to the petitioners, as in the present times, it is impractical for one family to occupy a 10-12 room house; that relief can be granted without detriment to the public good, as there are many two-family homes in the area on small lots; and the request is in harmony with the general intent of the Ordinance. Referring to the requirements for a Special Permit, P. Laband found that the use is listed in the Table of Use Regulations; that the requested use bears a positive relationship to the public convenience, as the house will be used for two families; that traffic and pedestrian safety would be impaired if the applicants do not provide adequate parking (see provision below attached to this permit); that the requested use will not overload municipal systems; that Article XI does not apply; that the requested use will not unduly impair the integrity or char- acter of the district, as this area is primarily multifamily; and that ' I the requested use is in harmony with the general intent of the Ordinance.; I R. Buscher concurred, finding the lot small and peculiarly shaped in j an area which is predominantly multifamily; that unless the house is converted, it will probably remain neglected; that the public good will be served by repairing this dilapidated structure. I Referring to the requirements for a Special Permit, Mr. Buscher found that the use is listed in the Table of Use Regulations; that the requested use bears a positive relationship to the public convenience, as it will add a housing unit and will restore a very dilapidated building; that the requested use will not create undue traffic conges- tion (although Bridge Street is a heavily travelled road, if the vehicles, are placed front to forward, there should be no significant increase in the problem); that the location is served by municipal water and sewer; that the area is predominantly multifamily and the requested use will not derogate from the character of the district. i The following provision shall apply: 1.
