And/Or Use: Jennie Mientka of 34 Lincoln Avenue, and Edwin and Helen Anusiewicz of 49A Grant Avenue, Northampton , MA are each owners of pre-existing non-conforming lots and structures . The Anusiewicz property abuts the Mientka property on its rear and side lot lines. Mientka would like to convey a ten-foot strip of land along her southwest rear lot line to Mr. and Mrs. Anusiewicz as an entry way to the 49A Grant Avenue house is located approximately five feet.fr--o-m -the common Anusiewicz rear lot line and the Mientka rear lot line . As a consequence of this conveyance the 10-foot strip would also continue to extend along a pre-existing non-conforming structure located on the Mientka property . he pre-exi�7ting non-conforming structure is located approximately 1 . 4 -Feet from the side lot line as shown on the plot plan submitted with this application . V. Reasons upon which application is based : Pre-existing non-conforming structures exist on both parcels of property . The building on the Anusiewicz property is located approximately five ( 5) fleet (not including the entrance and walkway ) from its rear lot line. Mientka, the co-applicant, is willing to convey a ten ( 10 ) foot wide parcel of land to Mr. and Mrs . Anusiewicz . In the situation before you, the desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of such ordinance or by-law. Both properties presently have pre-existing non-conforming structures located on them. The increase or decrease of the distance to, or along , lot lines does not create any new legal problems, or issues concerning detriment to the public good or derogation from the intent of the ordinances .
