Applicant currently has a retail gasoline station and 2-bay garage used for automotive
service as well as a small retail area for retail sale of snack items. The existing 1,597 sq.
ft. 2-bay garage building is currently a pre-existing nonconforming structure as it is located
within the rear setback line, 1'-6" from the west property line. The existing gasoline pump
island and canopy currently encroaches within the front setback and is also considered a
pre-existing nonconforming structure.
The property currently maintains three separate pre-existing nonconforming uses: (1) retail
gasoline sales, (2) auto service repair function, and (3) retail sales, all within this
aforementioned pre-existing nonconforming structure.
Proposed
The applicant proposes to demolish the existing non-conforming structure and construct in
its place a new 2-bay car wash building conforming within the prescribed setbacks. The
applicant further proposes to eliminate two pre-existing nonconforming uses, more
specifically the retail gasoline sales as well as the retail convenience sales and retain the
pre-existing nonconforming auto service function. The auto service function would be
altered and reduced in scope from the automobile repair and lubricating services and be
relegated only to automobile car wash.
The City of Northampton Zoning Code under Section 2, page 2-2 indicates by definition
the following: AUTOMOTIVE SERVICE STATION: Establishment in which the principal
use is the retail sale of gasoline, oil, or other motor vehicle fuel, and may contain retail
convenience and variety goods for retail. The premises may include, facilities for
polishing, greasing, washing, or otherwise cleaning, servicing, or repairing motor vehicles.
Section 9.3 allows pre-existing non-conforming structures or uses to be changed,
extended or altered under certain circumstances by a Finding applied for thru the Zoning
Board of Appeals.
