Dear Mike,
We have received another complaint about the hours of operation of the car wash at 310 Bridge
Street in Northampton. This is the third complaint; the two others were in March and May of 2007.
One of the conditions of the special permit allowing the car wash in that location requires that it
close at 10:00 pm. Additionally, the City of Northampton zoning ordinance, section 350-12.1 (A) (8)
limits the noise levels allowed in a residential zone to less than 50 dBA between the hours of 10:00 pm
and 7:00 am.
You must ensure that the car wash does not operate after 10:00 pm, and that the noise level
requirements are kept below the allowable limits.
If these violations occur again, we will institute the appropriate action or proceeding at law to
prevent any further unlawful use and to correct such violations. This letter shall serve as notice of
violation and order under Section 350-4.8 of the Zoning Ordinance of the City of Northampton. If
the notice of violation and order is not complied with promptly, the Zoning Enforcement Officer, upon
written request to the City Solicitor, shall have available the services of the City Solicitor in instituting
the appropriate action or proceeding at law or in equity to prevent any unlawful action, use or condition
and to restrain, correct or abate such violation. Penalties for violations may be affixed in an amount not
to exceed one hundred dollars ($100.00) for each offense and or court action. Each day or portion of a
day, that any violation is allowed to continue shall constitute a separate offense.
