25C-075 (5) tower or similar structure is located closer to a property line than the distance equal to its height, except as provided in§1 1.8,Telecommunications and Personal Wireless Facilities. (Amended 4/3/97) 5. _ At no street intersection in any district shall any obstruction to vision exceeding three(3)feet in height above the plane established by the intersection streets be placed or permitted to grow, on any lot within the triangle formed by the lot lines abutting the intersection and a line connecting points on these lot lines at a distance of twenty-five(25) feet from the point of intersection of the lot lines. Akers Jr. 290 Bridge Street Northampton, MA 01062 RE: Zoning violation Northampton Zoning section 6.8-5&6 hedge obstructing view Dear Mr. Aker, I received an anonymous call from one of your neighbors complaining that the hedge on your property was restricting their view exiting their driveway and was a safety hazard. I made a site inspection today at approx. 1:30pm and found that there are two violations of Northampton Zoning section 6.8 subsections 5&6 (copy of ordinance enclosed) The hedge on the street side abutting Day Ave. cannot be higher than 3feet tall for a distance of twenty-five feet from street intersection. The hedge on the opposite side that abuts a driveway cannot be higher than 3feet for a distance of five feet from front property line. The hedges do cause a clear safety hazard and must be corrected immediately. You have 30 days from receipt of this letter to make the corrections, failure on your part to do this will result in fines of up to $100 per day for each day violation continues and or court action. If you have any questions concerning this please contact me at 587-1240. You may appeal this decision to the Northampton Zoning Board of Appeals.
