The Board of Appeals met at 7;50 PM, April 29, 1981, to conduct
a public hearing on the petition of Duffy Tire Service for a special
permit under the provisions of Section 9.3, Page 9-1, of the Zoning
Ordinance to construct an addition to their building at 252 Bridge,_
_Street. Present were Chairman Robert C. Buscher, William Brandt,
and Peter Laband.
The Chairman read the public notice as it appeared in the Daily
Hampshire Gazette on April 15 and April 22.
He noted receipt of" communications relating to the petition, the
most important of which was a letter, dated April 24, 1981 , from Mr.
Duffy requesting that the hearing be postponed to a later date.
Postponement, according to Mr. Duffy, would protect the filing fee
already paid on the current application. An alternative, if the
Board did not agree to the postponement, would be a request to with-
draw.
Atty. Bruce Fogel, speaking on behalf of an interested party
who is an abutter to the Duffy property, told the Board that his
client is interested in purchasing the Bridge Street property in
order to preserve its historical character. He explained that he
had advised Mr. Duffy to seek an extension or to request withdrawal
to protect himself in the event that the sale did not materialize.
Sale of the property would be contingent upon the -applicant Is move
to another location.
After discussion, the Board voted unanimously to grant an exten-
sion to July 31, 1981. If, by that date, the applicant neither
submits a new application nor requests withdrawal , the special permit
shall be denied.
The meeting was adjourned at 8:15 PM. , Present, in addition to
the Board members and Atty. Fogel , wdre Clare Fennessey, Clerk, and
several interested citizens.
