I would like to stress that I am not a contractor and that this venture
is not for investment or speculation. I would be living in the home and
being owner occupied I would have income from only one apartment and would
be forced to charge a rather high rent. As a two family house, students
would be the only group able to afford the rent. The high rent would
prevent young families , young married couples, single persons or retired
persons from renting. And we would very much prefer to rent to this latter
group.
We feel that because of the size of the lot (over one acre) off-street

parking will cause no problems. The parking area in its present state can
easily accomodate six vehicals. Since the dementions of the house will
not change and in view of the fact that a responsible owner will occupy
the property, there should be no impact on the neighborhood or the imme-
diate abbutors.
We feel that attempting to operate this house as a two family unit
would pose an unusual hardship and could result in devastating consequences
for us. We feel that in order to provide a secure home for ourselves , to
have latitude in who we can rent to and to provide much needed improvements ,
maintenance and up-keep, we will need the additional income a third apart-
ment would generate.

9. Reasons for which application is based: We are in the process of
purchasing the dwelling located at 142 North Street which is presently
a two family house. The house is located in a URB zone. We are respect-
fully requesting your consideration to convert the subject property into
a three family house through the issueance of a special permit. The house
is quite large, totaling approximately 3475 square feet and contains 17
rooms. No addition or physical change in the outside demensions of the
house are required or planned. The third apartment would be added merely
by sub-dividing the existing structure. This action would provide one
apartment with approximately 1595 square feet, a second with 1086 square
feet and a third with 791 square feet.
A house of this size and location is very expensive to maintain and
operate , especially in these times of runaway inflation. As a newly
mortgaged property the monthly payments are high, this in part due to
the high interest rates charged by local lenders (101%) . The taxes on
this property are also expensive. Currently taxes are $1501 .00 per year
or $125.00 per month. Further, the house is heated by a single oil steam
system. As the landlord with a single heating system, all rentals must
include heat. The rooms are large, the ceilings are high and only one
room in the entire house is insulated. The building presently consumes
between 3500 and 4000 gallons of oil per year. The cost of oil continues
to rise at an alarming rate and with President Carter' s proposed de-
regulation of domestic oil prices, costs are expected to rise considerably.
If we consider the added costs of water sewer and home insurance, the
operating expenses of this property are extremely high. As a young fam-
ily starting out in our first home these costs are prohibitive. The house
requires some immediate attention but to become even minimally efficient
in terms of heating , insulation throughout is required. This would be an
impossible expense if the house were only a two family dwelling.

DECISION OF THE
ZONING BOARD OF APPEALS
At its meeting on Wednesday, May 16, 1979, the Zoning Board of
Appeals for the City of Northampton voted to.grant the petition of
LaVerne Kerr and Daniel O'Connor, 14 Columbus Avenue, Northampton,
MA, and Michael O'Brien, 53 Woodmont Road, Northampton, MA, for a
Special Permit to add an apartment to a home at 142 North Street,
Northampton.
Based upon evidence presented to the Board, the Board made the
following findings in regard to the Special Permit:
1. The proposed use is listed in the Table of Use Regulations.
2. The proposed use bears a positive relationship to the pub-
lic convenience by providing housing, which had been lack-
ing, for young married couples.
3. There will be no increase in traffic or undue traffic con-
gestion as a result of the proposed use, and parking space
for six cars is available on the parcel.
• 4. The proposed use will not overload public facilities from
the addition of one apartment.
5. The proposed use will not impair the character or integrity
of the neighborhood, as there is adequate space in this
home to accomodate an additional apartment, there will be
no exterior changes made to the home, and the area now has
several multi—family homes and that, while the present size
of the apartment could attract large families or groups,
the cost of renting such living quarters would probably
eliminate large families. Because of the size of the home,
with only one heating system, and the spiraling costs of
fuel, rent for one apartment' would be prohibitive to most
families and the alternative of renting to students could
impair the °integrity or character of the district.

The Special Permit is granted, however, subject to the follow-
ing conditions:
1. If, at some future time, the applicants are prevented from
using the driveway, which is shared by the adjacent home,
the applicants must provide another access to the parking
space on the property.
2. The applicants shall provide no less than 1800 square feet
of parking space on the property.
