Puchalski Municipal Building to conduct a Public Hearing on the Application of J. H. Maxymillian, Inc. for a Special Permit under the Provisions of Sections 10 .10( 3 ) and 10 . 11 to allow a vacant lot in the Northampton Industrial Park to be used for the temporary storage of construction materials being used in the reconstruction of King Street. Present and voting were Chairman Dr. Peter Laband, William Brandt, and M. Sanford Weil, Jr. Mr. Steve Warren of Hinsdale, MA appeared for the Applicant, and stated, "We are on the site through an oversight. The pile of loam you see was stripped from the site and will be restored. The ConsComm has given us an Order of Conditions which we will follow. The site will be cleared and stabilized. November 9th will be the completion of the King Street work. We can' t get germination at that time of year--we must wait until Spring to re-seed. " Ch. Laband pointed out that the requested use is allowed by the Table of Use Regulations , [ 5 . 2( 14) ] and added, "If Kollmorgen [owner of the site] is agreeable, we certainly don' t want to stand in your way. " Mr. Warren added, "We want to keep the loam there, but we ' ll take out all the pipe, curbing and hard construction material--we' ll just leave what' s necessary to loam and seed. " There was no one present to speak in favor or in opposition. Mr. Brandt moved the Public Hearing be closed, Mr. Weil seconded, and the motion passed unanimously. Dr. Laband went through the Section 10 . 10 Special Permit criteria and found they are all met. He added as a condition to the Permit that the Applicant observe the Conservation Commission Order of Conditions. Mr. Brandt concurred, as did Mr. Weil. Mr. Brandt moved the Special Permit be granted. Mr. Weil seconded, and the motion passed unanimously. Also present, in addition to those mentioned, was R. J. Pascucci, Board Secretary. H. Maxymillian, Inc. for a Special Permit under the Provisions of Sections 10. 10( 3 ) and 10. 11 of the Northampton Zoning Ordinance to allow a vacant lot owned by Kollmorgen Corporation and located in the Northampton Industrial Park to be used for the temporary storage of construction materials being used in the reconstruction of King Street. Present and voting were Chairman Dr. Peter Laband, William Brandt, and M. Sanford Weil, Jr. The Findings are as follows: The requested use is listed in the Zoning Ordinance as allowed by Special Permit, in Section 5 . 2[ 14] . The requested use bears a positive relationship to the public welfare. The requested use will have no effect on any municipal systems, nor will it have any effect on traffic or pedestrian safety. The requested use will not have any impact on the integrity or character of the district, and is in harmony with the general purpose and intent of the Ordinance. THE FOLLOWING CONDITION SHALL APPLY: 1 . The Applicant must fully comply with the Order of Conditions issued by the Northampton Conservation Commission, a copy of which is attached and made a part of this decision.
