Load Factor. The percentage of the total connected fixture unit flow which is likely to occur
at any point in the drainage system. It varies with the type of occupancy,the total flow unit
above this point being considered, and with the probability factor of simultaneous use.
Loon Vent A loop vent is a branch vent that serves two or more floor-outlet fixtures that
are battery wasted. Said vent extends from the top of the horizontal soil and/or waste branch
in front of the last fixture waste and connects to a vent stack or stack vent, adjacent to the
down-stream end of the horizontal branch.
Main. The principal pipe artery to which branches may be connected.
May. The word "may" is a permissive term.
Master Plumber. A plumber having a regular place of business and who, by himself,
journeyman or apprentices in his employ, performs plumbing work.
Materials (Plumbing). Materials shall mean all piping, tubing and fittings, drains and
receptacles, interceptors and protectors, hangers and supports, covers and coverings,
appliances and other devices and appurtenances used, or referred to, in the definitions of
Plumbing, Plumbing Fixtures and Plumbing Systems.
Non-Potable Water. Water not safe for drinking,personal or culinary use.
Nuisance. Public nuisance as known in common law or in equity jurisprudence; whatever
is dangerous to human life or detrimental to health; whatever building, structure or premise
is not sufficiently ventilated,sewered,drained,cleaned or lighted,in reference to its intended
or actual use; and whatever renders the air or human food or drink or water supply {

unwholesome.
Offset. A combination of elbows or bends which brings one section of the pipe out of line
but into a line parallel with the other section.
pH. The negative logarithm of the hydrogen-ion concentration used in expressing both
acidity and alkalinity on a scale whose values run from zero to 14, with the lower number
less than seven indicating increasing acidity and numbers greater than seven indicating
increasing alkalinity. A reading of seven would indicate a neutral pH condition.
Person. A natural person,his heirs,executors,administrators or assigns;and includes a firm,
partnership, corporation, institution, association or group,its or their successors or assigns;
and includes a city, town,county, or other governmental unit,owning or renting,leasing or
controlling property,or carrying on an activity regulated by M.G.L.c. 142 and/or 248 CMR.
Plan Examiner. A person employed by the Commonwealth of Massachusetts in the Board
of State Examiners of Plumbers and Gas Fitters who shall, under the direction and
supervision of the Executive Secretary to the Board, examine plans and specifications for
compliance with 248 CMR (State Plumbing and Fuel Gas Codes), and perform such duties
as assigned by the Board through the Executive Secretary.
Plumber. Any person duly licensed by the Board of State Examiners of Plumbers as a Master
or Journeyman Plumber, as required by M.G.L. c. 142
Plumbing. Plumbing includes the work and/or practice, materials and fixtures used in the
installation, removal, maintenance, extension and alteration of a plumbing system; of all
piping,fixtures,fixed appliances and appurtenances in connection with any of the following:
sanitary drainage or storm drainage facilities, special wastes, the venting system and the
public or private water-supply systems, within or adjacent to any building, structure, or
conveyance; to their connection with any point of public disposal or other acceptable
terminal within the property line.

It is the interpretation of this Board that that portion of the plumbing system consisting
of all building drains beginning from a point ten feet outside from the inside face of the
foundation wall and running into the building structure shall be installed by a licensed
plumber only. On public or private water supply systems, any pipe beginning on the house
side of the metering device or, if none, the main control valve immediately inside the
foundation wall to the point of actual connection to heating/cooling equipment, appliance,
fixture, etc. shall be installed by a licensed plumber only. When a metering device is
installed as part of the water supply and distribution system for a building or group of
buildings at a location outside the foundation wall(s)of said building(s), the cutting, fitting,
connection and testing of all water supply piping between the metering device and said
building(s)shall be performed by a licensed plumber in accordance with the requirements of
248 CMR -Other work involved in the installation of such piping such as trenching,
tunneling,placement of assembled piping in the trenches,back-filling etc., may be performed
by unlicensed personnel.
All work installed beyond the points listed above in the direction of the street, shall not
be required to be installed by a licensed plumber, insofar as the application of 248 CMR is
concerned.
Plumbine Fixture. Installed receptacles, devices, or appliances either supplied with water
and/or receive and/or discharge liquids, or liquid-borne wastes, or both, with or without
discharge into.the drainage system with which they may be directly or indirectly connected.
Plumbing Inspector. (Sec Administrative Authority.)
Plumbing System. The Plumbing System includes the water supply and distribution pipes;
plumbing fixtures and traps: soil, waste, and vent pipes; building sanitary and storm drains
including their respective connections, devices, and appurtenances to their connection with
any point of public disposal or other acceptable terminal within the property line.
Potable Water. Water free from impurities present in amounts sufficient to cause disease or
harmful physiological effects. Its bacteriological and chemical quality shall conform to the
requirements of the regulations of the Massachusetts Department of Environmental Protection_
Private or Private Use. In the classification of plumbing fixtures, private shall apply to
fixtures in residences, apartments, condominiums and to private guest rooms in hotels and
motels.
Private Sewer. A sewer, serving two or more buildings;privately owned, and not directly
controlled by public authority.
Product Approval. The process by which materials and plumbing fixtures used in any
plumbing or drainage system or pan thereof are determined to meet standards which have
been established by the Board.
Public or Public Use. In the classification of plumbing fixtures,public shall apply to every
fixture not defined under Private or Private Use.
Public Sewer. A common sewer directly controlled by public authority.
Public Water Main. A water supply pipe for public use controlled by public authority.
Purification Waste. A by-product of waste material generated by or from the fermentation
process to produce a pure substance.

(1) Authorization. 248 CMR was authorized, formulated and adopted under of M.G.L.
c. 142, § 13 which now reads:
In all cities and towns, the examiners,subject to the approval of the Massachusetts
Department of Environmental Protection, shall make and from time to time in like manner,
alter, amend, and repeal rules and regulations relative to the construction, alteration, repair
and inspection of plumbing in such cities and towns,-which rules and regulations shall be
reasonable, uniform, and based on generally accepted standards of plumbing practice;
provided, however, that the application of such rules and regulations may be vaned by the
examiners in a particular city or town upon petition of the board of health or health
department thereof. The examiners shall adopt a regulation requiring all cities and towns to
use a uniform application for a permit to perform plumbing work.
(2) Penalty Every person engaged in the business of a master plumber or working as a
journeyman or as an apprentice not lawfully registered or licensed as required by M.G.L.
c. 142,every person engaging in or working at the business of plumbing in a city or town,
when forbidden to do so under M.G.L.c. 142,every master plumber who engages or employs
any person to work as a journeyman or as an apprentice who has not been so registered or
licensed,and anys3r iolating'any provision of 248 CMR shall be punished by a fine not
exceeding$100.
(3) Sections Declared Independent. Each Section of 248 CMR and every pan of each
Section is hereby declared to be an independent Section and part of Section and the holding
of any Section or part of Section to be void-and ineffective for any cause, shall not be
deemed to affect any other Section or part of Sections.
(4) Limit of Jurisdiction. Nothing in 248 CMR shall be construed as applying to
refrigerating,heating,cooling,ventilating or sprinkler fire protection systems beyond the point
where connection is made with the potable water distributing system. Sanitary, storm water,
special wastes drainage systems and dedicated lines shall be subject to 248 CMR, and shall
be made subject to the inspection and approval of the Inspector of Plumbing.

At 8: 30 am I received a phone call from Gerry Goofeld at Coca
Cola. He explained that he thought he didn' t need a permit to do
plumbing and that he and his employees could do plumbing without
licenses . He then went on to say his employees installed 3
eyewash units and began piping in the lab.
I visited the site at 10 : 45am, meeting with Gerry and observed
the installations. I explained to him that I would like to speak
with the person or persons that installed these units. Gerry
said to meet him and Derk in their office . I met with both and
again asked to speak with the installer of the plumbing. Derk
refused to allow me to speak with the installer and said he would
take this up with the mayor. ( " . . because you work for her don ' t
you?" ) I asked what that had to do with anything and why did he
want to be political . He stated again he would be calling the
mayor.
Copies of the definition of plumbing and permits are attached to
this note .
I called Grodsky and spoke with Richard Bardwell informing him
that he has no final inspection and that Grodsky is still
responsible for the water supply system in the plant. I
requested that the shower handles be removed after the valves are
shut off . I also requested that they put signs on the shower
units so they are not used. I expressed my concern that lead
solder may have been used during the installation.

Telephone call to Richard Bardwell , Grodsky Plumbing Corp.
Plumbing Inspector, Charles Mazeski , stated that the company was
operating under a temporary CO and was responsible for existing
piping at the Coca-Cola factory @ 45 Industrial Drive . Mr.
Mazeski questioned whether lead-free solder had been used. He
stated that a licensed plumber:
1 . shut off 3 shower valves
2 . remove the handles
3 . cover the units for non-use
4 . be re-installed by licensed plumber

2.04: Scope and Application
(1) Ste '
(a) The provisions of 248 CMR shall govern the construction,removal,alteration,repair
and inspection of Plumbing.
(b) All plumbing installed under authority of M.G.L. c. 142, § 21 shall conform to
248 CMR and the term "Administrative Authority" shall mean Investigator of Plumbers
or Board of State Examiners of Plumbers and Gas Fitters.
( Licenses and Registration
(a) No person shall engage in the business of a master plumber or work as a
journeyman or as an apprentice, nor solicit, by sign, listing or any other form of
advertisement, work regulated or controlled by 248 CMR 2.00 or by any ordinance,
by-law, rule or regulation made hereunder, unless he is lawfully registered, or has been
licensed by the examiners as provided in 248 CMR 2.00. Any person so licensed as a
master plumber or a journeyman may carry on the work of a gas fitter throughout the
Commonwealth, notwithstanding any local ordinance, by-law, rule or regulation to.the
contrary, and may engage in the work of installing house drainage and connecting with
common sewers without being required to have any local license therefor, but shall be
subject to local regulations relative to permits and bonding requirements.
(b) The license or certificate of a journeyman or an apprentice shall be exhibited
whenever required by an Inspector of Plumbing.
(c) The license or certificate of a master plumber shall at all times be displayed
conspicuously within his place of business. Any sign,listing or advertisement of a master
plumber or a journeyman shall contain his designation and license number.
(d) Each holder of a master or journeyman plumber's certificate or license shall register
his name and business address with the Inspector of Plumbing if he has such control,
otherwise with the Board of Health, in the city or town wherin he desires to engage in
business as a plumber.
(e) A person.duly licensed in the Commonwealth as a master plumber and who wishes
to conduct his plumbing business as a corporation,shall register with the Examiners and --
upon payment of the required fee,shall be issued a certificate authorizing him to conduct
the plumbing business as a corporation.
Permits.
(a) Plum ing shall not be installed,altered,removed,replaced,or repaired until a permit
has been issued therefor by the Inspector of Plumbing. Any application for such permit
shall be made to the Inspector of Plumbing and shall contain a statement of the work to
be performed.the location of the building and the names of the persons for and by whom
the work is to be done. Each permit which is issued by the Inspector of Plumbing shall
be subject to the express conditions set forth therein as to compliance with all provisions
of the statutes,rules and regulations which relate to plumbing. A separate permit shall
be required for each building.
(b) The repair of leaks in a faucet,valve, or other working part of a plumbing fixture,
and the clearance of a stoppage;but not including the alteration,replacement or relocation
of any faucet,valve,or other working pan of a plumbing fixture or device,water supply,
sewer,drainage,leader soil,waste,vent or similar piping or work affecting public health
shall be deemed a minor repair for which no permit shall be required.
(c) Permits to perform plumbing work shall be issued to licensed plumbers on
etmits may be cancelled if in the opinion of the Inspector of Plumbing 248 C ly- has
been violated.
Permits shall be invalid if work is not started within 90 days of the date thereon,
unless the holder of such permit or permits, can satisfactorily prove that failure to start
within the 90 day period was beyond his control.
(d) Notwithstanding any regulation to the contrary permit applications from licensed
plumbers shall be acted upon within two working days upon receipt of application.
