Upon completion of the work covered by this Order, the applicant shall submit an as-built
plan to verify compensatory storage, signed and stamped by a registered professional
engineer or land surveyor, together with a written request for a Certificate of Compliance.
The plan and written request shall specify any ways that the completed project differs
from the plans referenced in the Order. The as-built plan shall include, at a minimum, and
as applicable to the project: elevations of all pipe inverts and outlets,pipe sizes,
materials, and slopes; all other drainage structures; limits of clearing, grading, and fill; all
structures,pavement, and contours within 100 feet of wetland boundaries; all alterations
within the wetland resource areas; all wetland replication areas; and all dates of
fieldwork. The as-built must also indicate that all flood-storage created meets or exceeds
the amount planned.
26. Permanent markers (either boulders greater than 3' in diameter or cement markers
showing at least 1 foot above ground) a maximum of 20 feet apart shall be installed along
the 50' wetland buffer. This shall be a permanent no disturbance zone.
27. Erosion control devices shall remain in place until all disturbed surfaces have been
stabilized with a vegetative cover or until the Commission has authorized their removal.
Areas that cannot be permanently stabilized within 30 days of disturbance, shall be
stabilized by temporary measures acceptable to the Conservation Commission.

"ATTACHMENT A"
IS. The owner of the property described in this Order must advise any potential buyer of the
property that any construction or alteration to said property, including brush cutting or
clearance, may require approval by the Northampton Conservation Commission.
Any instrument conveying any or all of the owners' interest in said property or any
portion thereof, shall contain language similar to the following:
"This property is subject to the Northampton Wetlands Protection
Ordinance and/or Wetlands Protection Act. Any construction or
maintenance work performed on this property requires an Order of
Conditions, and/or a Determination of Applicability from the Northampton
Conservation Commission.
19. A copy of this Order and associated plans shall remain on site during all construction
and/or building activities. The project manager and all equipment operators shall be
familiar with the approved plans, and shall be informed of their location on the site.
This location shall be accessible to all contractors whenever work is occurring on
site.
20. All required permits must be obtained from the Army Corp of Engineers (Section 404,
Water Quality Certification), Planning Board, Zoning Board, Department of Public
Works, or Building Inspector prior to the start of projects involving fill within any
wetland resource area;
21. No disposal of soils or other materials shall be allowed within: a 100-year floodplain; 40
feet of the 100-year floodplain elevation; any wetland; or any area within 100-feet of a
wetland, unless such areas are specifically approved by the Commission, in accordance
with 310 CMR 10.00, and City of Northampton Ordinances - Chapter 24;
22. All revised plans,referenced within this Order of Conditions, shall be approved by the
Conservation Commission and incorporated into this Order by reference and shall be
followed during the course of construction.
23. Ongoing conditions that shall not expire with the issuance of a Certificate of Compliance
are as follows: N/A
24. Prior to the start of any site work, excavation or construction, a pre-construction
conference shall be held on the site, between the contractor conducting the work, the
site/project engineer, the applicant, and a member or agent of the Conservation
Commission, in order to ensure that the requirements of this Order are understood by all
parties. Prior to the pre-construction meeting, all erosion control devices must be
installed.

F. Appeals
The applicant, the owner, any person aggrieved by this Order, any owner of land abutting the land subject
to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of
their right to request the appropriate DEP Regional Office to issue a Superseding Order of Conditions.
The request must be made by certified mail or hand delivery to the Department, with the appropriate filing
fee and a completed Request of Departmental Action Fee Transmittal Form, as provided in 310 CMR
10.03(7)within ten business days from the date of issuance of this Order. A copy of the request shall at
the same time be sent by certified mail or hand delivery to the Conservation Commission and to the
applicant, if he/she is not the appellant.Any appellants seeking to appeal the Department's Superseding
Order associated with this appeal will be required to demonstrate prior participation in the review of this project.
Previous participation in the permit proceeding means the submission of written information to the
Conservation Commission prior to the close of the public hearing, requesting a Superseding Order or
Determination, or providing written information to the Department prior to issuance of a Superseding Order
or Determination.
The request shall state clearly and concisely the objections to the Order which is being appealed and how
the Order does not contribute to the protection of the interests identified in the Massachusetts Wetlands
Protection Act, (M.G.L. c. 131, §40) and is inconsistent with the wetlands regulations (310 CMR 10.00).
To the extent that the Order is based on a municipal ordinance or bylaw, and not on the Massachusetts
Wetlands Protection Act or regulations, the Department has no appellate jurisdiction.

C. General Conditions Under Massachusetts Wetlan Is Protection Act
10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the
Conservation Commission shall be a party to all agency proceedings and hearings before DEP.
11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of
Compliance (WPA Form 8A) to the Conservation Commission.
12. The work shall conform to the plans and special conditions referenced in this order.
13. Any change to the plans identified in Condition#12 above shall require the applicant to inquire of the
Conservation Commission in writing whether the change is significant enough to require the filing of a
new Notice of Intent.
14. The Agent or members of the Conservation Commission and the Department of Environmental
Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours
to evaluate compliance with the conditions stated in this Order, and may require the submittal of any
data deemed necessary by the Conservation Commission or Department for that evaluation.
15. This Order of Conditions shall apply to any successor in interest or successor in control of the
property subject to this Order and to any contractor or other person performing work conditioned by
this Order.
16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland,
the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden
stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate
of Compliance has been issued by the Conservation Commission.
17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully
stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or
water body. During construction, the applicant or his/her designee shall inspect the erosion controls
on a daily basis and shall remove accumulated sediments as needed.The applicant shall immediately
control any erosion problems that occur at the site and shall also immediately notify the Conservation
Commission, which reserves the right to require additional erosion and/or damage prevention controls
it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.
18. All work associated with this Order is required to comply with the Massachusetts Stormwater Policy
Standards.

C. General Conditions Under Massachusetts Wetlands Protection Act
(only applicable to approved projects)
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory
measures, shall be deemed cause to revoke or modify this Order.
2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any
injury to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order
unless either of the following apply:
a, the work is a maintenance dredging project as provided for in the Act; or
b. the time for completion has been extended to a specified date more than three years, but less
than five years, from the date of issuance. If this Order is intended to be valid for more than three
years, the extension date and the special circumstances warranting the extended time period are
set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse,
rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard,
pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing.
7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such
an appeal has been taken, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Order has become final and then has been recorded in the
Registry of Deeds or the Land Court for the district in which the land is located,within the chain of title
of the affected property. In the case of recorded land, the Final Order shall also be noted in the
Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to
be done. In the case of the registered land, the Final Order shall also be noted on the Land Court
Certificate of Title of the owner of the land upon which the proposed work is done. The recording
information shall be submitted to this Conservation Commission on the form at the end of this Order,
which form must be stamped by the Registry of Deeds, prior to the commencement of work.
9. A sign shall be displayed at the site not less then two square feet or more than three square feet in
size bearing the words,

cut with concrete rumble strips was approved based on the need for tractor trailer turning movements along Industrial Drive East and
should improve safety of vehiclular entry at that location.
F. Compliance with the following technical performance standards:(1)Curb cuts onto streets shall be minimized. One of the curb cuts
along Industrial Drive will be closed and a new curb cut on the less traveled Industrial Drive East will be created to separate truck traffic
from other vehicular and pedestrian traffic on site. (2)Pedestrian, bicycle and vehicular traffic movement on site must be separated, to
the extent possible,and sidewalks will be provided between businesses within a development. (3)No increase in peak flows from the
one-or two-and ten-year Soil Conservation Service design storm from predevelopment conditions and must obtain a permit stating as
such by the Department of Public Works.

CONDITION OF APPROVAL:
1) Prior to certificate of occupancy, the applicant shall provide an as-built of the lighting plan indicating
conformance with the submitted plan.
2) As offered by the applicant,and prior to issuance of a CERTIFICATE OF OCCUPANCY, the applicant
shall show proof of the agreement,in the form of change order with Microcal's contractor, that traffic
mitigation payment of$4,000 has been made to Microcal's contractor. This payment change order is
for the purpose of continuing the construction of a sidewalk extension along Industrial Drive from the
point at which Microcal's obligation terminates at Bradford Street as part of its project.
FINDINGS:
The Planning Board approved the request for site plan for the 12,800 sf additions with 42'wide curb cut relocation based on the following
plans submitted with the application:

In approving the Plan, the Board found that--(lighting)
A. The requested use protects adjoining premises against seriously detrimental uses, which could include surface water drainage, and
other quality of life impacts;Industrial uses are allowed and this expansion is consistent with the goal of allowing growth of businesses
on existing infrastructure.
B. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent
streets, minimize traffic impacts on the streets and roads in the area. The project will not decrease the level of service(LOS)of all area
roads or intersections affected by the project below the existing conditions. As offered by the applicant, sidewalk improvements along

6. The proposed pavement in the southeast portion of the site adjacent to the loading dock
must be graded so that the majority of the pavement drains toward the paved waterway
and only a small area drains to CB#1 according to the approved drainage calculations.

the City Engineer,submission of"As-built"plans, and certification of completion by the
Department of Public Works of the stormwater management facilities being in
compliance with the approved plan and the provisions of this Ordinance.
Specific Permit Conditions:
1. Prior to issuance of a Building Permit, the applicant shall record an executed Stormwater
Operation,Maintenance, and Inspection Agreement that.is binding on all subsequent
owners of land served by the private stormwater management facility by recording it in
the land records of the Registry of Deeds.This agreement shall be approved by the
Northampton DPW,signed by the owner,and signed by the Mayor of Northampton.
Section 22-85 of the Northampton Stormwater Management Ordinance provides
additional guidance for the requirements of this agreement.The applicant shall amend the
submitted Annual Maintenance and Inspection schedule to the satisfaction of the DPW
and submit 3 original signature copies of the Agreement to the DPW.
2. This project will be required to submit one or more Notice of Intent(NOI)to the U.S.
EPA for coverage under the NPDES Stormwater Construction General Permit.A
Stormwater Pollution Prevention Plan(SWPPP)must be finalized and implemented.
Prior to issuance of a building permit,copies of both the NOI and the final SWPPP shall
be submitted to the Northampton DPW for review and may need to be amended to the
satisfaction of the Northampton DPW prior to the start of construction.
3. The applicant shall be required to apply for separate permits from the DPW for all
proposed connections to the municipal storm drain system.
4. The elevation of the rim of the proposed Catch Basin#1 (CB#1)is approximately the
same elevation as the top of the existing 36"storm drain main located in Industrial Drive
East,which will connect the proposed drain system via the proposed Manhole#2. If
during a storm event,the 36"storm drain line in Industrial Drive East reaches capacity,
the proposed CB#1,proposed MR#1,and the outlet of the detention pond(AD#1)may
not drain effectively and may surcharge stormwater into the proposed drainage structures
on the site due to the elevation of these proposed structures.The city is not responsible
for problems and/or damage to private or public property resulting from the inadequate
functioning of the proposed drain system or surcharge of drainage flows onto the site.
The DPW recommends that the applicant review other possible drainage designs that will
not surcharge during certain rain events.
5. The drainage calculations specify Area 2 of the roof draining to existing DMH#1 located
in Industrial Drive. Sheet 7 of the Site Plans specifies a drain line connecting to DMH 41
in Industrial Drive and heading in the direction of the existing building, but no
connection to roof leaders is indicated.Prior to a certificate of occupancy, the applicant
must confirm with written documentation that this portion of the roof is connected to the
municipal drain system and not to the sanitary sewer system. If any portion of the
existing stormwater system for the site is found to be connected to the sanitary sewer
system,the applicant must reconstruct the system so that all offsite stormwater flows
discharge to waterways or to the municipal drainage system in the roadways.

2. The Northampton Department of Public Works(DPW)or its authorized representative
shall be provided access to the property to conduct inspections before,during, and after
construction activities as necessary.The applicant shall arrange with the DPW to
schedule the following inspections:Initial Inspection,Erosion Control Inspection,Bury
Inspection,and Final Inspection.The DPW may also conduct random inspections to
ensure effective control of erosion and sedimentation during all phases of construction.
3. At the completion of the work,including construction of stormwater management
facilities and landscaping,the applicant shall submit a statement to the DPW from a
professional engineer of record in the Commonwealth of Massachusetts certifying that
the materials and construction of the stormwater management system was constructed in
accordance with the approved plans and will function as designed.All changes to the
approved stormwater facilities shall be documented by a professional engineer of record
in the Commonwealth of Massachusetts and approved by the DPW prior to submission of
the certification statement described above. It is recommended that the applicant retain
the engineer during construction of stormwater facilities to ensure that they are
constructed in accordance with the approved plans and specifications.
4. Annual Reports that are stamped by a Registered Professional Engineer documenting the
actions completed as required by the Operation,Maintenance and Inspection Agreement
shall be submitted to the Northampton Department of Public Works by October 1"of
each year.
5. If construction of the proposed stormwater system has not started within five years of the
issue date of this permit,then the permit will expire and a new permit will be required.
Construction is defined as clearing,grading, excavation,filling, and installation of
drainage structures on the lots specified in this permit.
6. The DPW shall require from the developer a cash escrow, irrevocable letter of credit,or
other means of security acceptable to the DPW prior to the issuance of any building
permit for the construction of a development requiring a stormwater management facility.
The amount of the security shall not be less than the total estimated construction cost of
the stormwater management facility.The guarantee so required in this section shall
include provisions relative to forfeiture for failure to complete work specified in the
approved stormwater management plan,compliance with all of the provisions of this
Ordinance and other applicable laws and regulations, and any time limitations.The
guarantee shall not be fully released without a final inspection of the completed work by

Stating that the fire protection sprinkler system has been installed in accordance
with the approved fire protection construction documents and that he has
reviewed the shop drawings for conformance to 780 CMR 903.3 and has
identified deviations if any, from the approved fire protection construction
documents.
b. Confirmation by the building owner/developer or authorized representative that
they-have received the as-built sprinkler system shop drawings from the installing
contractor and that the legally recognized professional has certified their
Accuracy.
c. Material, Test,performance and Completion Certificates,properly executed by
the installing contractor and that the legally recognized professional has certified
their Accuracy.
d. Satisfactory functional test of all fire protection systems witnessed by the
Building official and the head of the fire department or their deignees.
a. Water supply existing six-inch fire main supplied from circulating main in
industrial drive.
b. Automatic sprinkler systems and components.
c. Fire alarm systems and components-audio and visual appliances installed
throughout in accordance with NFPA 72.
d. Manual suppression systems-small hose stations aren't required(storage under
12-0) in accordance with NFPA 13 standpipe isn't required.
e. Seismic provided in accordance with NFPA 13, 9.3.
f. Fire Department Siamese (existing) connection is being replaced with a new storz
connection.
All of the above items are required by regulations. (780 CMR) all systems are new.

Section 1
Wet sprinkler system
System operates automatically upon the fusing of a single fire sprinkler.
Operational Sequence:
1. Wet system on fusing of a single sprinkler head water flow will close contacts of a
flow switch. Closed contact on the flow switch will activate local audible visual
panel and provide alarm contact for the fire control panel.
