HARDSHIP: CONDITION OF APPROVAL: - 1) The Catch Basins must be maintained/cleaned once annually by May 30-with reports going to FINDINGS: Department of Public Works. The Planning Board Approved the Site Plan for a wider curb cut than allowed based on the following plans submitted with the application: 1. "Lot 3 Site Plan",prepared for Sovereign Builders by William A. Canon, undated. In Granting the Site Plan Approval, the Planning Board determined that: A. The requested use, for a 45'wide curb cut, protects adjoining premises against seriously detrimental uses because the curb cut will be move slightly so that it is contained entirely on the applicant's property and paving will reduce erosion impacts and sediments from flowing onto Industrial Drive. The new alignment will be directly opposite the Coca Cola driveway. B. The requested use will not detract from the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets, and it will have no effect on traffic impacts on the streets and roads in the area,since it is an industrial street. C. The requested use will not detract from the harmonious relationship of structures and open spaces to the natural landscape, existing buildings and other community assets in the area. A gravel driveway exists in this vicinity. Changes will improve its condition. D. The requested use will not overload,and will mitigate adverse impacts on, the City's resources including the effect on the City's water supply and distribution system,sanitary and storm sewage collection and treatment systems,fire protection,streets and schools. E. The request use meets all the special regulations set forth in the Zoning Ordinance in section B. F.The Planning Board found that the application complied with the following technical performance standards: 1. There will be no additional curb cuts. 2.
