25A-170 (18) PROGRESS INFORMATION ON DAMON RD . RIVERFRONT PARK
Despite limited state funding, DEM, under the auspices
of its Connecticut Valley Action Program, has made
three aquisitions, the Environmental Police have established
a regional headquarters , and DEM has granted a special
use permit to Friends of Umass Rowing, Inc . to establish
a temporary public boat house . Yankee Rowing Club
is providing rowing instruction programs in which
the public can participate . There is a joint management
agreement between DEM, Environmental Police and the
city Conservation Commission to provide protection
and patrolling . The boat house built by Friends of
Umass Rowing provides space for 'both 8 man shells
and singles , and provisions are 'being made to accommodate
canoes and kayaks . The Division of Forests and Parks
will begin clean up and shaping of a small parking
lot in early June. Docks are currently in place for
boaters and fishermen . Landscaping will be pr9gressing
over the summer and the bikeway over the RR bridge
is slated to go to bid next January. The Environmental
Police office and DEM planning office are in full
operation .

Dear Mr. Cichy:
I stopped by your site the other day and found that since early
June you have put roof shingles on your roof and installed
additional plywood boards on the side of the house. In addition,
I saw a newly delivered shower just outside the house, apparently
ready to be installed. The roof and plywood is clearly in
violation of the Commission' s May 9 , 1989 order to cease and desist
further violations.
When the Commission issued an enforcement order on May 9, 1989 they
ordered you to file a notice of intent or appear at a Commission
meeting by May 22, 1989. At that meeting your attorney, W. Michael
Ryan, informed the Commission that you would be preparing a notice
of intent and file it shortly and that: work, except for sealing the
plywood roof, would cease until the Commission acted on the notice.
On May 22, 1989 the Commission directed you to file the notice by
June 14 , 1989 .
Unless we hear from you otherwise, t-he Commission will take this
matter up at their next meeting and proceed with enforcement action
on this matter.

Dear Bruce:
Pursuant to your May 2, 1989 Cease & Desist Order, Alfred
Cichy of 21 Western Avenue, Northampton, Massachusetts stopped work
on his property at 400 Damon Road, Northampton, Massachusetts.
The incompleted roof leaves the completed work exposed to the
elements which could cause much damage. Pursuant to your oral
permission, I have told Mr. Cichy that he could "button up" the
cite without violating the May 2nd order.
The Conservation Commission, at their May 22, 1989 meeting,
determined that Mr. Cichy must file a Notice of Intent which he
is now preparing. It was alluded to at the meeting that Mr. Cichy
may also need a special permit to replace the structure that was
destroyed by fire in the mid-701s . Would you kindly advise if you
would require such a permit prior to re-issuing a building permit
for that purpose.
Thank you for your considered response. I have enclosed copies
of old. and recent photographs to demonstrate strict adherence to
the old structure.
