As we discussed this morning, a roof is being installed on the
Alfred Cichy cellar house on the Connecticut River next to the
Coolidge Bridge. The Conservation Commission has filed a formal
zoning complaint on this project in the past and would like any
zoning violation to be corrected immediately.
The Commission filed its zoning complaint when because of a wall
which was built on top of the enclosed cellar. The work on the
roof has only occurred within the last few days, and it appears
that the owners plan on finishing the house.
Please keep me informed of what actions you take on this site.

The building permit #376, dated 6-21-88, for the re-roofing of a one family
dwelling at 400 Damon Rd. , Northampton, is hereby revoked:
Section 114.7: Revocation of permits : The building commissioner or inspector
of buildings may revoke a permit or approval issued under the provisions of this
code in case of any false statement or misrepresentation of fact in the application
or the plans on which the permit or approval was based.
All work must cease immediately. Before any other work begins permits must first
be received from the Conservation Commission and the Zoning Board of Appeals.

It has come to the attention of the Conservation Commission that Alfred Cichy was
issued a Building Permit (4376) on June 21, 1988 to re-roof a one family dwelling on
Damon Road. The Conservation Commission had a site visit to the site last week and
is concerned that a second story is in fact being added to the house..
The addition of a second story appears to be in violation of the city' s Zoning
ordinance, specifically Section 13.3, Page 13-1, which requires a Special Permit from
the ZBA for any "substantial improvements,"
Please consider this a formal zoning complaint from the Commission and take
appropriate action. Should you have any questions or require additional information,

Dear Bruce:
Thank you for sending me a copy of your revocation of Alfred
Cichy' s building permit. The Conservation Commission has been
concerned for sometime about the work on the house because it is
within the floodplain.
Mr. Cichy has continued to work on the house since you issued the
revocation order last week. I was near the site on Sunday, May 7 ,
1989 and saw that they were continuing to work on the house in
violation of your revocation order.
The Conservation Commission would appreciate it if you could take
enforcement action as quickly as possible to insure that all work
cease immediately and that all illegal construction be removed as
quickly as possible.
