ZBA Meeting Minutes - 6/7/95
Vice Chair Weil opened the Public Hearing on the request of Wright
Builders, Inc. for a Finding under §9.3 of the Zoning Ordinance for
two additions to a pre-existing, nonconforming structure at 10 Park
Street, Florence. Weil reviewed procedures for conducting Public
Hearings and read a copy of the legal notice which was published in
the Daily Hampshire Gazette on May 24 and May 31, 1995.
Jonathan Wright of Wright Builders was present to discuss the
application. Wright reviewed the site plan and proposal. He said
there will be no alteration to the footprint of the building and no
further violation of any setbacks because the structure will be
built up and not out.
No one spoke in favor or in opposition to the proposal.
Elaine Reall moved to close the Public Hearing. Alex Ghiselin
seconded the motion which passed unanimously 3:0.

Alex Ghiselin reviewed §9.3 (D) and found that the additions to <.
pre-existing non-conforming structure will not extend the foat:_> -?ref
of the building and will not create any new violations of Uic:
Zoning Ordinance. He found that the additions would not be
substantially more detrimental to the neighborhood than the pre-
existing non-conforming structure and moved to approve the Finding.
Elaine Reall seconded the motion which passed unanimously 3:0.

Pursuant to Massachusetts General Laws (MGL) Chapter 40A, Section
11, no Finding or any extension, modification or renewal thereof,
shall take effect until a copy of the decision bearing the
certification of the City Clerk that twenty days have elapsed
after the decision has been filed, or if such an appeal has been
filed that it has been dismissed or denied, is recorded in the
Hampshire County Registry of Deeds or Land Court, as applicable,
and indexed under the name of the owner of record or is recorded
and noted on the owner's certificate of title. The fee for such
recording or registering shall be paid by the owner or applicant.
It is the owner or applicant's responsibility to pick up a the
certified decision of the City Clerk and record it at the
Registry of Deeds.
The Northampton Zoning Board of Appeals hereby certifies that a
Finding has been GRANTED and that copies of this decision and all
plans referred to in it have been filed with the Planning Board
and the City Clerk.
Pursuant to Massachusetts General Law Chapter 40A, Section 15,
notice is hereby given that this decision is filed with the
Northampton City Clerk on the date below.
If you wish to appeal this action, your appeal must be filed
pursuant to MGL Chapter 40A Section 17, with the Hampshire County
Superior Court and notice of this appeal filed with the City
Clerk within twenty (20) days of the date this decision was filed
with the City Clerk.

At a meeting conducted on June 7, 1995, the Northampton Zoning
Board of Appeals unanimously voted 3:0 to GRANT the request of
WRIGHT BIIILDERS, INC. for a FINDING under the provisions of
Section 9.3, page 9-2 in the Northampton Zoning Ordinance for two
additions to a pre-existing, non-conforming structure 10 PARK
STREET, FLORENCE.
Zoning Board Members present and voting were: Vice Chairman M.
Sanford Weil, Jr. , Alex Ghiselin, and Elaine M. Reall.
The Findings of the Board under Section 9.3 for an alteration of
a Pre-existing non-conforming structure were as follows:
1. The Board found that the additions to a pre-existing non-
conforming structure will not be substantially more
detrimental to the neighborhood than the existing non-
conforming structure.
2 . The Board found that the additions will not create a new
violation of the existing zoning requirements because the
footprint of the building will not change and because there
will be no further violation of any setback requirements
since the structure will be built up and not out.

Vice Chair Weil opened the Continuation of a Public Hearing on the
request of BayBank for a Special Permit under §7.2 of the Zoning
Ordinance to allow a larger sign than permitted at 142 Main Street.
Present and sitting on the case were: Vice Chairman M. Sanford
Weil, Jr. , Alex Ghiselin and Elaine M. Reall. Weil explained that
the Public Hearing had been continued in order for the applicant to
present additional information. Weil read a copy of a letter dated
June 2, 1995 from Agnoli Signs which stated that Agnoli Sign Co.
and BayBank are withdrawing their request for a Special Permit to
allow the green panels to remain on the building at 142 Main
Street.
Alex Ghiselin moved to close the Public Hearing. Elaine Reall
seconded the motion which passed unanimously 3:0.

without prejudice with the stipulation that they remove the two
non-conforming side panels within 60 days. Alex Ghiselin seconc>cci
