In upholding the Building Commissioner's Decision to require immediate removal of a Recreational Vehicle from a lot in the URC Zoning District, the Northampton Zoning Board of Appeals made the following Findings: 1. Per Section 5.1 Use Regulations, "No building, structure, or land shall be used except for the purposes permitted in the district as described in this article. Any use not listed shall be construed to be prohibited". 2. Recreational Vehicles and/or Mobile Trailers are not listed as principal uses per Section 5.2 Table of Use Regulations, and are therefore, not allowable as residences or primary uses anywhere in the City of Northampton. Additionally, the lot size is too small for any residential use that might be allowed in URC; a single-family home requires 6,000 square feet. 3. The Building Commissioner has determined that this recreational vehicle is being used as a residence and has ordered immediate removal of the vehicle. CERTIFICATE OF SERVICE Pursuant to M.G.L. This Decision was filed with the City Clerk on: June 26. 2001 Anyone aggrieved of this decision may file an appeal in accordance with MGL Ch. 40A, Section 17, with the Hampshire County Superior Court or the Northampton District Court and file notice of said appeal with the City Clerk within twenty(20) days of the date that this decision was filed with the City Clerk. This decision shall not take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed after the decision has been filed, or if such an appeal has been filed, that it has been dismissed or denied, is recorded in the Hampshire County Registry of Deeds or Land Court, as applicable, and indexed under the name of the owner of record or is noted on the owner's certificate of title. There is a saying that unfortunately is true that no good deed goes unpunished. Last year Mr. Bouchard claimed that he had been diagianosed with a terminal blood cancer, and that he had sold his house prior to digcovering this and he had no place to live. He also stated that he was moving to Florida and would not be returning. I gave him until Nov.l to move, (I was trying to be compassionate)with the clear understanding that he cannot return to use the area as he had. He agreed and left. I had checked the site several times this spring and felt assured that the problem was over.Needless to say when I received your letter I was extremely upset. I made a site visit that morning and confronted Mr. Bouchard. I have attached a copy of letter that I hand delivered to him that morning. I assure you that I will take all appropriate and expedient measures including fines and court action to have him removed from the site. I am truly sorry that this has come to this in light of what I was led to believe from Mr. Bouchard regarding his medical condition, If you have any questions please contact me at 587-1240, the situation will not be tolerated by this office.
