1. The structure shall be designed to allow floodwater to flow through in
accordance with the building codes.
2. Prior to the issuance of a building permit, the applicant must receive a FEMA
flood elevation certification.
3. No future projects on site or within the same reach of the river off-site may
utilize the excess compensatory flood storage.
4. Compensatory storage area must be maintained, as designed, for as long as the
accessory structure remains on the site.

A. The requested use for the construction of a 1,000 square foot storage building protects adjoining premises against seriously
detrimental uses because the proposed building will be located at the rear of the property and will be used for storage purposes for the
existing business that can be easily moved in the event of a flood. In addition, the applicant has made adequate provisions for surface
water drainage,sound and sight buffers,and preservation of views as depicted on plans and information submitted to the Office of
Planning&Development.
B. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent
streets, minimize traffic impacts on the streets and roads in the area because the requested use will not generate an increase in traffic
and the existing driveway will be used to access the storage building.
C. The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape,existing buildings
and other community assets in the area because the proposed building will be located approximately 400 and 500 feet from abutting
properties and will be sheilded by hedges. In addition,the applicant has agreed to remove approximately 750 square feet of pavement
from the site in order to increase the amount of open space.
D. The requested use will not affect City services such as the City's water supply and distribution system, sanitary and storm sewage
collection and treatment systems, fire protection,streets and schools.
E. The requested use meets any special regulations set forth in the Zoning Ordinance as listed in Sections 10& 14 because the new
storage building will be constructed to allow water to flow through in the event of a flood. Additionally, compensatory storage is being
provided in excess of amount of flood storage lost.
F. The requested use bears a positive relationship to the public convenience or welfare. The use will not unduly impair the integrity of
character of the district or adjoining zones,and the use is in harmony with the general purpose and intent of the Ordinance.
G. The requested use will promote City planning objectives to the extent possible and will not adversely effect those objectives, as
defined in City master or study plans adopted under M.G.L. Chapter 41, Section 81-C and D.
In addition,in reviewing the Site Plan submitted, the Planning Board found that the application complied with the following technical
performance standards:
1. There will be no new curb cuts.
2. Pedestrian, vehicular and bicycle traffic are separated on site to the extent possible.
The Planning Board voted 7:0 to Grant the waivers as requested in the application.
