The Northampton Zoning Board of Appeals met at 7:00 p. m. in
Council Chambers, Wallace J. Puchalski Municipal Building, 212 Main
Street, Northampton, to conduct a Public Hearing on the Application
of James I. Hutchins for a Special Permit under the Provisions of
Section 5.2, to allow construction of a three-family dwelling at
357 Bridge Street, in a URB District. This will replace a dwelling
that has been destroyed by fire and which will be demolished.
Present and voting were Ch. Robert C. Buscher, William Brandt, and
M. Sanford Weil, Jr.
Ch. Buscher opened the Public Hearing by reading the Legal Notice
and the Application. He then read a letter from the Applicant,
dated November 1, 1990, asking for a continuance to December 5,
1990, because he was putting together a detailed site plan as
requested by the Planning Board, which will review this on November
29. Mr. Weil moved to continue to December 5. Mr. Brandt
seconded, and the motion passed unanimously.
Also present, in addition to those mentioned, was R. J. Pascucci,
Board Secretary.

He has bettered the situation. I'd go along and let him do this. "
Mr. Weil added, "I would too."
Dr. Laband turned to the Section 10. 10 criteria, found them all to
be met, and concluded, "I 'd vote for the Special Permit with the
Planning Board's conditions, and the DPW's conditions about grading
and the driveway construction, and the plantings. " Ch. Buscher
asked if he were going to pump sewage (because of the low-lying
locus of the building) , and Mr. Hutchins replied, "If I have to, I
will. "
Dr. Laband moved that the Special Permit be granted. Mr. Weil
seconded. Ch. Buscher added, "I ' ll go along with my colleagues.
I think a significant area behind the parking lot should be
cleared. The motion passed unanimously.
Dr. Laband then moved that the Site Plan be approved, since it met
all the criteria,granted. Mr . Weil seconded, and the t Planning
Board had gran motion passed
unanimously.

The Northampton Zoning Board of Appeals met at 8: 15 P. m. on
Wednesday, December 5, 1990 in Council Chambers, Wallace J.
Puchalski Municipal Building, 212 Main Street, Northampton, to
continue, from November 7, 1990, the Public Hearing on the
Application of James I. Hutchins for a Special Permit and Site Plan
Review, all concerning his proposal to construct a three-family
dwelling at 357 Bridge Street. Present and voting were Chairman
Robert C. Buscher, Dr. Peter laband, and M. Sanford Weil, Jr.
Ch. Buscher relinquished the chair to Dr. Laband, who read the
Application, the Legal Notice, letters from the DPW and Wayne
Feiden, and a memorandum from the Planning Board. Mr. Hutchins put
his site plan on the board, and gave a brief history of his
ownership of the property, which began in 1983 . In 1986 the
dwelling was turned into a student rental, and in August, 1990,
there was a major fatal fire, and the remains of the building are
to be demolished, the plan being to replace the structure with
three units each having three bedrooms. He had a handout covering
the Section 10. 10 criteria, and he proceeded to read from it; "The
use is listed in Section 5.2 as requiring a Special Permit. 2)
The use bears a positive relationship to the public welfare in that
there is a need for three-bedroom apartments in the city, and this
house will be well back from Bridge Street, safe for children. 3)
The proposed house will not create any traffic/pedestrian problems.
The new use will have far less activity on nights and weekends. 4)
The new use will not overload any municipal systems. 5) This will
not unduly impair the integrity of the zone. This is a mixed
neighborhood, with a gas station, Sheldon Field, nine one-family
homes, six two-families, and a five-unit office condo. I will
follow all of the Planning Board's conditions."
Dr. Laband suggested, "Tell us about the driveway." Mr. Hutchins
replied, "I met with Mr. Brindis and the DPW is satisfied. " The
chair called for proponents, and none were present. He called for
opponents, and Richard Wilga rose, and identified him as Mary
MuzykaIs son-in-law (she being the immediate abutter to the north) .
He wanted to look at the plans, and came forward to do so. Mr.
Hutchins explained to them everything he planned to do. Coun.
Budgar told the Board, "I 'm apprehensive. This is called 'Kamikaze
Corner. ' It's a dangerous area for children. " Mr. Hutchins
responded, "I 've got a half-acre for kids to play in. The building
is 100 feet from Bridge Street. "
There being no one else present to speak in favor or opposition,
Dr. Laband moved that the Public Hearing be closed. Mr. Weil
seconded, and the motion passed unanimously. Ch. Buscher
commented, "Len (Coun. Budgar) has hit on the biggest issue--the
danger of it. " Dr. Laband inquired, "How can zoning address this
issue" The Ordinance says he needs a special Permit for a three-
family. He is not creating traffic congestion--it's already there.

As to the request for Site Plan Approval:
The Board finds that the criteria set forth in Section 10. 11 of
the Northampton Zoning Ordinance have either been met, or
properly waived by the Northampton Planning Board, and the Site
Plan is approved.
THE FOLLOWING CONDITIONS SHALL APPLY:
1. A turnaround for vehicles shall be added to the rear north
corner of the parking area.
2 . There shall be an area in front of each dwelling for
loading and unloading of vehicles.
3 . No dumpster shall be placed on any paved area, or in the
f loodplain.
4 . All landscaping shall be maintained, and plants be replaced
if and when they die.
li 5. Additional landscaping shall be planted on the north side
it of the property to obscure the view of the structure.
6. No plantings taller than two feet shall be planted within

the 15 foot strip located between the edge of the pavement and
the property line, on the south side of the driveway.

At a meeting held on December 5, 1990, Z
Appeals of the City of Northampton voted unanimously to GRANT
the request of James I. Hutchins for a Special Permit under the
Provisions of Section 5.2 of the Zoning Ordinance of the City
of Northampton, and voted unanimously to APPROVE his Site Plan,
under the Provisions of Section 10. 11, all to allow
construction of a three-unit dwelling, each with three
bedrooms, at 357 Bridge Street, to replace a dwelling that was
destroyed by fire in August, 1990. Present and voting were
Chairman Robert C. Buscher, Dr. Peter Laband, and M. Sanford
Weil, Jr.
As to the Special Permit, the Findings were as follows:
1. The requested use is listed in Section 5.2 of the
Northampton Zoning Ordinance as being allowed by Special Permit
in the URB. The Board noted that the replacement of the burned
out structure would be allowed by right.
2 . The requested use bears a positive relationship to the
ji public convenience and welfare, in that it creates three badly
i needed three bedroom apartments at affordable rental levels.
The new building will be safe for children, and will have a
Ijhalf-acre play area to the rear of the structure.

3. The requested use will not create undue traffic
congestion or unduly impair pedestrian safety. The proposed
construction of the driveway meets all the concerns of the
Department of Public Works, both as to percent grade, and sight
distance to the south.

4. The requested
use will have no effect whatsoever on
municipal systems.

S. The requested use will not unduly impair the integrity
or character of the district or adjoining zones, nor will it be
detrimental to the health, morals or general welfare. The use
is in harmony with the general purpose and intent of the
ordinance. The neighborhood is a mixed one, with one- and two-
Ii family dwellings, a five-unit office condominium, a service
station and a public recreational field. The landscaping that
is planned will enhance the neighborhood.
