DECISION OF _ t
ZONING BOARD OF APPEALS
At a meeting held on March 18, 1987, the Zoning Board of
Appeals of the City of Northampton voted unanimously to grant
the Variance request of Joseph G. Packard, 18 Hubbard Avenue,
? Northampton, MA, for the purpose of constructing a single- ,
family dwelling which will violate setback requirements on a
lot which is nonconforming in its area at property located on
Coolidge Avenue (more particularly identified as Parcel 82 of
Sheet. 25A of the Northampton Assessors ' Maps) , Northampton, MA
(URB . Zone) . Present and voting were: Chairman Robert C.
Buscher, Peter ,Laband `and Sanford Weil, Jr.
The findings were as follows:
P. Laband stated that as the Zoning Ordinance exists, it
precludes the use of this lot as a building lot in joint
ownership with the two other lots; however, at the time the
lots were laid out, it was considered an acceptable lot and is
now in keeping with the theme of growth management recommended
by the Strategic Planning Consultants. He found that a
hardship would be created if relief is not granted, as this lot
could not be used for any other reasonable purpose; that as
other lots in the area are laid out in a similar fashion,
relief can be granted without detriment to the public good and
without nullifying the intent of the Ordinance.
S. Weil concurred, finding that the construction of a
'! single-family dwelling on that site will be an improvement to
the area.
R. Buscher also concurred, noting that the Board has taken
into consideration the minor violation of setback requirements
j, in deciding whether or not to grant the Variance.
The following restrictions shall apply:
1. That Lots #70 & 71 of Sheet 25A of the Northampton
Assessors' Maps be combined and considered as one lot
after separated from Lot #82.
2. That the exterior walls of the structure be built no
less than 14 feet away from any side lot line.
3 . That the exterior wall of the structure be built no
less than 18 feet away from the rear lot line.
4. That the proposed structure be built as a single-
family, single-story dwelling.

1) I will contact the Department of Public Works and have
an inspector check and approve the graded gravel base
prior to paving to insure compliance with slope and
location;
2) I further agree that if in the inspections any of the
permit conditions are not met that I will at no expense
to the City remove and replace the driveway as directed
